DIRECTIVE

On the management of agricultural tractors participating in road traffic

Currently, the country has nearly 120,000 various types of agricultural tractors (commonly known as horizontal and vertical agricultural tractors, self-made vehicles, etc.), including approximately 66,000 small motorized tractors and 54,000 vehicles assembled from single-cylinder diesel engines and parts of automobiles. In recent years, although agricultural tractors have played a certain role in transporting goods, especially in rural and mountainous areas, due to outdated production technology, poor quality, and inadequate management, many tractors operate without registration, have not been regularly inspected for technical safety and environmental protection standards; many drivers do not have driving licenses, leading to numerous traffic accidents, including many serious ones causing deaths and injuries, obstructing and congesting traffic, and causing public concern.

To effectively manage the operation of agricultural tractors, minimize the disruption to traffic order and safety, the Prime Minister requests:

1. Ministries, sectors at the central level and People's Committees of provinces and centrally-administered cities, according to their functions and responsibilities, need to proactively coordinate closely to manage the activities of agricultural tractors participating in road traffic in accordance with the following policy guidelines:

a) Strengthen state management; strictly implement the provisions of the Road Traffic Law regarding agricultural tractors participating in road traffic, such as requiring registration and inspection, vehicles similar to automobiles must be regularly inspected for technical safety and environmental protection standards, and drivers must hold driving licenses.

b) Suspend the production of new types of agricultural tractors (except small motorized tractors). For existing tractors that have not yet been registered, strict inspections must be conducted; if they meet current technical safety and environmental protection standards, they can be registered for use. For tractors already registered, the maximum period for participation in traffic is until December 31, 2007. Based on specific local conditions, People's Committees of provinces and centrally-administered cities may set earlier deadlines.

Relevant agencies, based on current regulations, need to develop concrete plans and measures to promote the production of light trucks at reasonable prices and establish mechanisms and policies to support and encourage vehicle owners to replace agricultural tractors before the specified deadline.

c) Clearly define the scope of operation of agricultural tractors as follows:

Prohibit agricultural tractors from operating in the inner city areas of third-class and higher cities, on expressways, and on roads with high traffic density. 2. The Ministry of Transport:

a) Coordinate with the Ministry of Public Security to inspect technical safety standards and register license plates for agricultural and forestry vehicles according to current regulations.

b) Supplement, amend, and implement technical safety standards and environmental protection standards for agricultural and forestry vehicles (excluding small tractor-trailers).

c) Guide and inspect training programs for drivers of agricultural and forestry vehicles regarding appropriate content, duration, and costs.

Organize examinations and issue driving licenses for drivers of agricultural and forestry vehicles.

d) Monitor the management and operation of agricultural and forestry vehicles to promptly address issues and report to the Prime Minister for resolution of difficulties and obstacles beyond the authority of relevant ministries and sectors.

3. Ministry of Public Security:

a) Register and issue license plates for agricultural and forestry vehicles (excluding small tractor-trailers mentioned in Clause b, Point 1) produced before this Directive takes effect, ensuring compliance with technical safety standards and environmental protection regulations as stipulated by the Road Traffic Law.

b) Register and issue license plates for small tractor-trailers that meet the technical standards set by authorized management agencies and participate in traffic.

c) Conduct inspections, control, and handle violations of agricultural and forestry vehicles and their drivers according to current regulations.

4. The Ministry of Industry:

a) Direct the automotive industry to ensure sufficient supply of light trucks meeting technical safety conditions to replace agricultural and forestry vehicles that must be phased out as specified in Clause b, Point 1.

b) Direct localities to strictly manage and prevent unauthorized production of agricultural and forestry vehicles.

5. Provincial People's Committees under the Central Government:

a) Direct departments and sectors at the local level to effectively implement the following tasks:

- Cease unauthorized production and assembly of agricultural and forestry vehicles. Guide and assist these facilities to switch to producing other suitable products.

- Statistic, inspect the quality and technical safety of agricultural and forestry vehicles to process registration and issuance of license plates according to regulations within the province or city.

- Organize propaganda and mobilize vehicle owners and local residents to comply with government policies on managing agricultural and forestry vehicles.

- Inspect and handle violations by production facilities, vehicle owners, and drivers of agricultural and forestry vehicles according to current regulations.

b) Based on local conditions, specify the scope and time frame for the operation of agricultural and forestry vehicles.

c) Organize collector roads and civilian routes to limit and eventually prohibit agricultural and forestry vehicles from operating on busy traffic routes.

This Directive shall take effect fifteen days from the date of publication in the Official Gazette.

7. Ministries: Finance, Culture and Information, Agriculture and Rural Development, Planning and Investment, National Traffic Safety Committee, and related agencies shall, based on their functions and responsibilities, coordinate with the Ministry of Transport, Ministry of Public Security, Ministry of Industry, and People's Committees of provinces and centrally-administered cities to effectively implement this Directive.

8. Propose the Vietnam Fatherland Front, the Vietnam Farmers' Association to coordinate in supporting relevant ministries, branches, and People's Committees at all levels in disseminating and mobilizing vehicle owners and local residents to strictly implement the Government's policy on managing agricultural and forestry vehicles.
