Pilot Implementation of Certain Special Allowance Regimes
for the Vietnam Maritime Administration

Pursuant to the Law on State Budget dated December 16, 2002;
Pursuant to the Law on Thrift and Combating Wastefulness dated November 29, 2005;
Pursuant to Decision No. 26/2009/QĐ-TTg dated February 20, 2009 of the Prime Minister regarding the Regulations on the Functions, Tasks, Authorities, and Organizational Structure of the Vietnam Maritime Administration under the Ministry of Transport;
At the proposal of the Minister of Transport;
The Prime Minister issues this Decision on the pilot implementation of certain special allowance regimes for the Vietnam Maritime Administration.
Article 1. Pilot implementation of certain special allowance regimes for the Vietnam Maritime Administration. The pilot period runs from 2013 to 2017.
Article 2. The subjects to which this Decision applies include officials, civil servants, and employees at the Office of the Vietnam Maritime Administration, two Branches of the Vietnam Maritime Administration, and the specialized maritime inspection force under the Vietnam Maritime Administration.
Article 3. Scope of Regulation: This Decision regulates special allowance regimes for salaries, bonuses, work uniforms, and sources of funds to ensure special allowances.
Article 4. The special allowance items and special allowance regimes shall be included in the self-governed budget as follows:
1. Average Salary: A salary coefficient of 1.8 times the state-prescribed salary level (grade and step, excluding night shift and overtime pay) shall be applied to officials, civil servants, and employees.
2. Safety and Security Bonus: A bonus of 15% of the rank-based salary (excluding allowances) shall be granted to officials and civil servants directly involved in maritime management, supervision, and safety and security assurance.
3. Work Uniforms: Work uniform expenses shall be covered. The Ministry of Transport shall stipulate the work uniform regime for the Vietnam Maritime Administration; the Ministry of Finance shall determine the work uniform expense levels according to the established uniform regulations.
Article 5. Funds to ensure special allowance regimes include: an additional salary coefficient of 0.8 times; safety and security bonuses and work uniforms shall be allocated from the retained port fee revenue for maritime administration, as specified by the Minister of Finance at the Port Maritime Administrations.
Article 6. If there is any surplus in the self-governed budget, the Vietnam Maritime Administration may allocate it to the contents prescribed in Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government on the self-governed and self-responsible regime for the use of staffing and administrative management budgets for state agencies, and related laws; among which, income supplements for officials and civil servants shall not exceed 1.0 times the state-prescribed rank-based salary.
Article 7. The Ministry of Finance is responsible for guiding the allocation of funds for the special allowance expenditures mentioned above.
Article 8. This Decision takes effect from September 15, 2013 and applies to fiscal years from 2013 to 2017. In the third quarter of 2017, the Ministry of Transport will organize a review and evaluation of the implementation results of this Decision, based on which it will coordinate with the Ministry of Finance and relevant agencies to submit a mechanism for the subsequent phase to the Prime Minister.
Ministers: Transport, Finance, Home Affairs, Labor - Invalids and Social Affairs; Director of the Vietnam Maritime Administration and Heads of relevant agencies are responsible for implementing this Decision./.
