production development support for particularly difficult communes, border communes, safe area communes,
particularly difficult hamlets and villages

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Decision No. 551/QĐ-TTg dated April 4, 2013, of the Government approving Program 135 on infrastructure investment support, production development support for particularly difficult communes, border communes, safe area communes, particularly difficult hamlets and villages;
At the proposal of the Director of the Department of Cooperative Economic and Rural Development;
The Minister of Agriculture and Rural Development issues this Circular guiding the implementation of the content of Production Development Support as stipulated in Decision No. 551/QĐ-TTg dated April 4, 2013, of the Government approving Program 135 on infrastructure investment support, production development support for particularly difficult communes, border communes, safe area communes, particularly difficult hamlets and villages.
Article 1. Scope of Regulation and Applicability

a) This Circular guides the implementation of certain contents of production development support as stipulated in Decision No. 551/QĐ-TTg dated April 4, 2013, of the Government approving Program 135 on infrastructure investment support, production development support for particularly difficult communes, border communes, safe area communes, particularly difficult hamlets and villages (hereinafter referred to collectively as Decision No. 551/QĐ-TTg).
b) Contents of production development support outside those specified in this Circular shall be implemented according to Joint Circular No. 05/2013/TTLT-UBDT-NNPTNT-KHĐT-TC-XD dated November 18, 2013, of the State Committee for Ethnic Affairs, the Ministry of Agriculture and Rural Development, the Ministry of Planning and Investment, the Ministry of Finance, and the Ministry of Construction guiding the implementation of Decision No. 551/QĐ-TTg (hereinafter referred to collectively as Joint Circular No. 05).
2. Scope of application: Poor households, near-poor households, and groups of households as defined in point a, Clause 1, Article 4 of Joint Circular No. 05.
Article 2. Principles of Support
1. For Production Development Support Projects:
a) In line with local socio-economic development planning, land use planning, agricultural production development, and new rural construction planning;
b) Suitable for the conditions, characteristics, and production needs of poor and near-poor households;
c) Ensuring transparency, democracy, and participation and commitment of the people in project design and implementation;
d) Participants in the project will be supported according to the content of the project. The level of support for each household and the ratio of support for poor, near-poor, and non-poor households within the group shall be decided by the Provincial People's Committee.
2. For poor and near-poor households:
a) Possessing land, labor, and production materials that meet the requirements of the project;
b) Committing to implement the registered production activities.
3. Regarding groups of households:
a) Members of the group possess land, labor, and production materials suitable for the project content.
b) Committing to implement the registered production activities.
Article 3. Production Development Support Projects
1. Production Development Support Projects include the following basic contents:
a) Objectives of the project;
b) Contents of the project;
c) Activities of the project;
d) Implementation organization of the project;
d) Inspect, evaluate, summarize and report on the results of implementing the project.
2. Supporting people participating in projects:
a) Support content as stipulated in point c, Clause 1, Article 4 of Joint Circular No. 05;
b) Depending on the purpose, content of the project, and specific conditions of the locality, participants in the project may be supported with types of crop seeds, livestock breeds, aquatic seedlings, fertilizers, and other materials as follows:
- Crop seeds, livestock breeds, aquatic seedlings with economic value included in the list of permitted production and trading seeds as prescribed by the Ministry of Agriculture and Rural Development; suitable for sector restructuring plans and local conditions;
- Fertilizers and materials according to technical standards applicable to each type of crop, livestock breed, and aquatic seedling;
- Pesticides, veterinary drugs, vaccines for dangerous diseases as prescribed by veterinary regulations.
Article 4. Construction, review, approval, and implementation of development production support projects
1. Construction of development production support projects:
a) People's Committee of the commune (project sponsor)
- Propose development production support projects in accordance with Circular Joint No. 05 and Article 3 of this Circular;
- Compile a list of households and groups of households registered to participate in the project, construct the development production support project, prepare the dossier for submission to the People's Committee of the district for review and approval.
b) Village head
- Disseminate the commune's policy on proposed development production support projects, production development support policies under Program 135, and issue applications to poor households, near-poor households, and other households interested in participating in the development production support project;
- Based on the registration forms of households and the content of the development production support project, the village head organizes a village meeting to evaluate households and groups of households participating in the project and compile a list of households and groups of households to be submitted to the People's Committee of the commune.
2. Review and approval of development production support projects:
a) The People's Committee of the commune sends one set of documents to the People's Committee of the district (Department of Agriculture and Rural Development) directly or through postal service.
b) Documents include:
- A report from the People's Committee of the commune requesting the People's Committee of the district to approve the project;
- Registration forms of households participating in the development production support project (Annex 01 issued together with this Circular);
- Minutes of the village meeting (Annex 02 issued together with this Circular);
- List of households and groups of households registered for the development production support project (Annex 03 issued together with this Circular);
- Detailed description of the development production support project (Annex 04 issued together with this Circular).
c) Procedure:
- The People's Committee of the district (Department of Agriculture and Rural Development) receives the dossier and issues a receipt to the People's Committee of the commune (in case of direct submission). Within three working days from the date of receiving the dossier, the People's Committee of the district must respond in writing regarding the validity of the dossier to proceed with review or not to review;
- The Department of Agriculture and Rural Development leads the review of the contents of the development production support project within ten working days from the date of receiving the valid dossier;
- After completing the review, the Department of Agriculture and Rural Development submits to the People's Committee of the district for issuance of a decision approving the development production support project and returns the result to the People's Committee of the commune within two working days.
3. Implementation of the project
On the basis of the approved project, the People's Committee of the commune shall implement as follows:
a) Informing the public about the content of the development production support project; support policies; list of households and groups of households participating in the project;
b) Organizing the implementation of the project according to the approved content;
c) Assigning technical staff to guide, inspect, and supervise throughout the implementation process of the project;
d) Summarizing, evaluating, and reporting the results of the project implementation.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Department of Cooperative Economy and Rural Development shall take the lead and coordinate with relevant units to perform the following tasks:
a) Guiding, inspecting, urging localities to implement the project and proposing policies and solutions to adjust and supplement to promote effective project implementation;
b) Compiling the situation of project implementation every six months and annually, conducting analysis and evaluation of the results and sending them to the Program 135 Standing Office;
c) Organizing mid-term and final reviews for localities participating in the program to summarize, evaluate, and promote the effective operation of the project and achieve the planned progress.
2. Provincial People's Committees:
a) Being responsible for directing the implementation of projects in the area;
b) Entrusting the Department of Agriculture and Rural Development to be the main agency of the project, coordinating with relevant departments in the province to assist the provincial People's Committee in implementing the development production support project in the area, directing some pilot models to draw lessons for general guidance. Summarizing, evaluating the results of project implementation in the area and reporting regularly every six months and annually to the Ministry of Agriculture and Rural Development as prescribed.
3. People's Committee at the district level
a) Being responsible for directing the implementation of projects in the district:
- Organizing the review and approval of projects for communes; compiling annual plans and reporting to the Department of Agriculture and Rural Development;
- Training, supporting the People's Committee of the commune to perform well the tasks of the project sponsor;
- Directing, inspecting, and evaluating the results of project implementation in the district;
- Directing some pilot models to draw lessons for replication.
b) Summarizing, evaluating, and reporting regularly every six months and annually to the Department of Agriculture and Rural Development and the Program 135 Standing Office of the province.
4. District People's Committees:
a) Constructing and implementing the project democratically, transparently, and accurately targeting the intended beneficiaries;
b) Inspecting and urging households and groups of households to implement the project content effectively;
c) Summarizing, evaluating, and reporting the results of project implementation regularly every six months and annually to the People's Committee of the district (Annex 05 issued together with this Circular).
Article 6. Implementation Provisions
1. This Circular takes effect from January 21, 2015.
2. During the implementation process, if any difficulties arise, localities need to report to the Ministry of Agriculture and Rural Development (Rural Economy and Agricultural Development Department) for supplementation and adjustment./.
