On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Infrastructure Structure Department and the General Director of the Vietnam Highway Administration,
The Minister of Transport shall issue a Circular to stipulate the load capacity and width limits of roads; operation of overloaded vehicles, vehicles exceeding width limits, tracked vehicles on roads; transportation of oversized and overweight cargo and loading limits for goods on road transport vehicles when participating in traffic on roads.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates the load capacity and width limits of roads; publication of the load capacity and width limits of roads; operation of overloaded vehicles, vehicles exceeding width limits, tracked vehicles on roads; transportation of oversized and overweight cargo and loading limits for goods on road transport vehicles when participating in traffic on roads.
Article 2. Applicability
This Circular applies to organizations and individuals related to the publication of the load capacity and width limits of roads; operation of overloaded vehicles, vehicles exceeding width limits, tracked vehicles on roads; transportation of oversized and overweight cargo and loading limits for goods on road transport vehicles when participating in traffic on roads.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. The total weight (gross mass) of a vehicle includes the weight (mass) of the vehicle itself plus the weight (mass) of people, luggage, and cargo loaded onto the vehicle (if any).
2. Axle load of a vehicle is the total weight of the vehicle distributed on each axle or axle group.
3. The maximum permissible dimensions of motorized road transport vehicles are the outer dimensions including the width, height, and length of the vehicle, including cargo loaded onto the vehicle (if any), allowed to participate in traffic on roads.
4. Tracked vehicles are self-propelled machines moving on tracks, which may cause damage to the road surface and shoulders when participating in traffic on roads.
5. A vehicle combination consists of a single-unit vehicle towing a trailer or a tractor towing a semi-trailer.
6. Single-axle trailer is a trailer with only one axle located in the middle of its length.
7. Multi-axle trailer is a trailer with a front axle or axle group connected to the drawbar and a rear axle or axle group.
8. Non-detachable cargo (non-separable cargo) is cargo in a unit still sealed with lead seals or security seals by customs, security, defense authorities, or a set of components, equipment, machinery that would be damaged or lose functionality if disassembled or separated.
9. A level crossing is a section of road intersecting at the same level with railway tracks, permitted for construction and operation by authorized agencies.
Chapter II
PROVISIONS ON LOAD CAPACITY AND WIDTH LIMITS OF ROADS;
PUBLICATION OF LOAD CAPACITY AND WIDTH LIMITS OF ROADS
Article 4. Load Capacity of Roadways
1. Road load capacity is the ability of bridges and roads to bear loads during exploitation to ensure their design lifespan.
2. The load-bearing capacity of bridges is determined based on the bridge design documentation and the actual technical condition of the bridge, published by authorized agencies or indicated by traffic signs limiting the total weight of vehicles crossing the bridge.
3. The load-bearing capacity of roads is determined based on the road surface design documentation and the actual technical condition of the road, published by authorized agencies or indicated by traffic signs limiting axle weight according to traffic sign regulations.
Article 5. Width Limit of Roadways
1. The width limit of roads is the space with limited dimensions regarding height and width of roads, bridges, ferry terminals, and road tunnels for vehicles, including cargo loaded onto the vehicles, to pass safely.
2. The height limit of roads is 4.75 meters for expressways, first, second, and third-grade roads, and 4.5 meters for fourth-grade roads and below.
3. The width limit of roads is the lane width limit, depending on the technical grade of the road and the terrain of the road construction route.
Article 6. Announcing the load capacity and width limit of roads and the technical condition of level crossings
1. The Vietnam Highway Corporation shall be responsible for announcing the load capacity and width limit of national highways; updating the load capacity, width limit of roads and the technical condition of level crossings nationwide on the Vietnam Highway Corporation's electronic information website.
2. The Department of Transport shall be responsible for announcing the load capacity and width limit of local roads; simultaneously sending data to the Vietnam Highway Corporation to update on the Vietnam Highway Corporation's electronic information website.
3. The Vietnam Railway Administration shall be responsible for announcing the technical condition of level crossings on the railway network; simultaneously sending data to the Vietnam Highway Corporation to update on the Vietnam Highway Corporation's electronic information website.
Article 7. Adjusting the announcement of the load capacity and width limit of roads and the technical condition of level crossings
1. The Vietnam Highway Corporation shall be responsible for updating the load capacity, width limit of roads and the technical condition of level crossings nationwide on a six-monthly basis (before June 20th and December 20th each year).
2. The Department of Transport shall be responsible for updating the load capacity, width limit of local roads; simultaneously sending data to the Vietnam Highway Corporation to update on the Vietnam Highway Corporation's electronic information website on a six-monthly basis (before June 15th and December 15th each year).
3. The Vietnam Railway Administration shall be responsible for updating the technical condition of level crossings on the railway network; simultaneously sending data to the Vietnam Highway Corporation to update on the Vietnam Highway Corporation's electronic information website on a six-monthly basis (before June 15th and December 15th each year).
4. Investors under public-private partnership models shall be responsible for updating the load capacity, width limit of road sections within their management scope; simultaneously sending data to the Department of Transport (for local roads) and the Vietnam Highway Corporation (for national highways) to update on the Vietnam Highway Corporation's electronic information website on a six-monthly basis (before June 10th and December 10th each year).
5. Bridges on routes and sections of roads that have been announced but not yet upgraded synchronously with the announced load capacity and width limit of roads must have signs indicating the actual load capacity and width limit of the bridge installed by the road management authority.
Article 8. Circulation of motorized vehicles on roads
1. Motorized vehicles on roads that meet the conditions of the announced load capacity and width limit of roads and the regulations on cargo loading limits set forth in Articles 16, 17, 18, and 19 of this Circular may circulate normally on announced routes and sections.
2. On other routes and sections of roads outside the published list of load capacity and width limit of roads, vehicle owners, transport lessees, and vehicle drivers must comply with weight restriction signs, permissible width limits of roads, speed limits, and distance between vehicles when circulating on roads.
3. In cases where it is necessary to transport indivisible cargo or circulate vehicles with total weight or size exceeding the load capacity or width limit of roads, vehicle owners, transport lessees, or vehicle drivers must apply to the competent authority for a Vehicle Operation Permit before putting the vehicle into traffic on roads.
Chapter III
REGULATIONS ON OVERLOAD VEHICLES, OVERWIDTH VEHICLES,
TRACK-LAYING VEHICLES CIRCULATING ON ROADS
Article 9. Provisions on Overloaded Vehicles and Vehicles Exceeding Size Limits for Circulation on Roadways
1. An overloaded vehicle is a road motor vehicle whose total weight or axle load exceeds the permissible load capacity of the roadway.
2. A vehicle exceeding size limits is a road motor vehicle where one of its external dimensions including cargo loaded on the vehicle (if any) exceeds the maximum allowable dimensions for vehicles participating in traffic on roadways, specifically as follows:
a) Length greater than 20 meters or more than 1.1 times the overall length of the vehicle;
b) Width greater than two point five meters;
c) Height measured from the surface of the roadway upwards exceeding 4.2 meters (except container-carrying vehicles).
3. Special-purpose machines with total vehicle weight or axle load exceeding the permissible load capacity of the roadway or external dimensions exceeding the maximum allowable dimensions prescribed in Clause 2 of this Article when participating in traffic on roadways shall be considered as overloaded vehicles or vehicles exceeding size limits.
Article 10. Provisions on Track-Laying Vehicles Participating in Traffic on Roadways
Track-laying vehicles participating in traffic on roadways must implement mandatory measures such as fitting track shoes, spreading matting, recording, or other measures to protect the roadway surface. In cases where these mandatory measures are not implemented, track-laying vehicles must be transported on other conveyance vehicles.
Article 11. Circulation of Overloaded Vehicles, Vehicles Exceeding Size Limits, and Track-Laying Vehicles on Roadways
1. The circulation of overloaded vehicles, vehicles exceeding size limits, and track-laying vehicles on roadways must ensure traffic safety and the safety of road infrastructure.
2. Organizations and individuals who are the owners of the means of transport, carriers, cargo lessees, or drivers when circulating overloaded vehicles, vehicles exceeding size limits, and track-laying vehicles on roadways must comply with the following regulations:
a) Possess a Permit for Circulating Overloaded Vehicles, Vehicles Exceeding Size Limits, and Track-Laying Vehicles on Roadways issued by the competent authority;
b) Adhere to the provisions recorded in the Permit for Circulating Vehicles.
3. Vehicles carrying cargo exceeding the permitted cargo volume according to the design of the manufacturer or exceeding the cargo volume recorded in the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle are not allowed to circulate on roadways.
Chapter IV
SUPER-DIMENSIONAL AND OVERWEIGHT CARGO TRANSPORTATION ON ROADWAYS
Article 12. Provisions on Super-Dimensional and Overweight Cargo
1. Super-dimensional cargo is indivisible cargo, when loaded onto a conveyance vehicle, has one of the following external dimensions (of the combination of conveyance vehicle and cargo loaded on it):
a) Length greater than twenty meters;
b) Width greater than two point five meters;
c) Height measured from the highest point of the vehicle's running surface upwards exceeding 4.2 meters; for container-carrying vehicles, exceeding 4.35 meters.
2. Overweight cargo is indivisible cargo with a weight exceeding 32 tons.
Article 13. Conveyance Vehicles for Transporting Super-Dimensional and Overweight Cargo
1. Conveyance vehicles for transporting super-dimensional and overweight cargo are vehicles with dimensions and load capacity suitable for the type of cargo being transported; simultaneously, they must be consistent with the specifications recorded in the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle.
2. In cases where modular semi-trailers capable of connecting to each other are used to transport super-dimensional and overweight cargo, the inspection agency confirms in the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle with the content: "Permitted to connect modules together and must have a Permit for Circulating Vehicles issued by the competent authority."
Article 14. Circulation of vehicles transporting oversized and overweight cargo on roads
1. Vehicles transporting oversized and overweight cargo circulating on roads must comply with the provisions set forth in Article 11 of this Circular.
2. The driver of a vehicle transporting oversized and overweight cargo when circulating on roads must adhere to the conditions specified in the Vehicle Circulation Permit; simultaneously, they must follow the guidance of traffic support personnel leading and escorting the vehicle (if any).
3. Cases requiring escort vehicles:
a) When loading cargo onto a transport vehicle with one of the following dimensions exceeding the standard limits (of the combination of the vehicle and cargo loaded on it): width greater than 3.5 meters; length greater than 20 meters;
b) At locations where road reinforcement is required for construction projects.
4. Cases requiring road survey:
a) When loading cargo onto a transport vehicle with one of the following dimensions exceeding the standard limits: width greater than 3.75 meters or height greater than 4.75 meters or length greater than 20 meters for roads of Class IV or lower, or greater than 30 meters for roads of Class III or higher;
b) Road motor vehicles with total weight of the vehicle or axle load exceeding the capacity of the road.
Chapter V
LIMITS FOR LOADING CARGO ON ROAD TRANSPORT VEHICLES
WHEN PARTICIPATING IN ROAD TRAFFIC
Article 15. Limits for loading cargo on road transport vehicles when participating in road traffic
1. Loading cargo on road transport vehicles when participating in road traffic must comply with the provisions regarding the total weight of the vehicle, axle load, height, width, and length of cargo allowed as stipulated in Articles 16, 17, 18, and 19 of this Circular, and shall not exceed the permissible cargo weight for transportation recorded in the Vehicle Safety Technical Inspection and Environmental Protection Certificate.
2. Cargo loaded on the vehicle must be neatly arranged, securely fastened, and not obstruct the operation of the vehicle, ensuring safe participation in road traffic.
Article 16. Axle Load Limits
1. Single axle: axle load £ 10 tons.
2. Double axle group, depending on the distance (d) between the two axle centers:
a) In case d < 1.0 meter, axle load of the axle group £ 11 tons;
b) In case 1.0 meter £ d < 1.3 meters, axle load of the axle group £ 16 tons;
c) In case d ³ 1.3 meters, axle load of the axle group £ 18 tons.
3. Triple axle group, depending on the distance (d) between adjacent axle centers:
a) In case d £ 1.3 meters, axle load of the axle group £ 21 tons;
b) In case d > 1.3 meters, axle load of the axle group £ 24 tons.
Article 17. Total Weight Limits of the Vehicle
1. For single-body vehicles with a total number of axles:
a) Two, total weight of the vehicle £ 16 tons;
b) Three, total weight of the vehicle £ 24 tons;
c) Four, total weight of the vehicle £ 30 tons;
d) Five or more, and distance from the center of the first axle to the center of the last axle:
- Less than or equal to 7 meters, total weight of the vehicle £ 32 tons;
- Greater than 7 meters, total weight of the vehicle £ 34 tons.
2. For tractor-trailer combinations with a total number of axles:
a) Three, total weight of the combination £ 26 tons;
b) Four, total weight of the combination £ 34 tons;
c) Five, and distance from the center of the coupling pin to the center of the first axle of the semi-trailer:
- From 3.2 meters to 4.5 meters, total weight of the combination £ 38 tons;
- Greater than 4.5 meters, total weight of the combination £ 42 tons.
d) Six or more, and distance from the center of the coupling pin to the center of the first axle of the semi-trailer:
- From 3.2 meters to 4.5 meters, total weight of the combination £ 40 tons; in case of carrying one container, total weight of the combination £ 42 tons;
- Greater than 4.5 meters to 6.5 meters, total weight of the combination £ 44 tons;
- Greater than 6.5 meters, total weight of the combination £ 48 tons.
3. For single-body vehicles towing a trailer: the total weight of the combination includes the total weight of the single-body vehicle (corresponding to the total weight of the vehicle as prescribed in Clause 1 of this Article) and the total axle load of the trailer being towed (corresponding to the axle load prescribed in Article 16), specifically as follows:
a) In case a single-body vehicle tows a trailer with one axle group, with the distance from the center of the coupling hole of the drawbar to the midpoint of the axle group of the trailer measured horizontally on the plane of the drawbar being greater than or equal to 3.7 meters, the total weight of the combination £ 45 tons;
b) In case a single-body vehicle tows a trailer with multiple axle groups, with the distance from the center of the coupling hole of the drawbar to the center of the front axle or midpoint of the front axle group of the trailer measured horizontally on the plane of the drawbar being greater than or equal to 3.0 meters, the total weight of the combination £ 45 tons.
4. In cases where the tractor-trailer combination towing a semi-trailer (as prescribed in Clause 2 of this Article) has a distance from the center of the coupling pin to the center of the first axle of the semi-trailer < 3.2 meters, or the single-body vehicle towing a trailer with one axle group has a distance from the center of the coupling hole of the drawbar to the midpoint of the axle group of the trailer less than 3.7 meters, or the single-body vehicle towing a trailer with multiple axle groups has a distance from the center of the coupling hole of the drawbar to the center of the front axle or midpoint of the front axle group of the trailer less than 3.0 meters, the total weight of the combination must decrease by 2 tons for each meter shorter.
5. For vehicles or combinations with auxiliary axles (with auxiliary axle lifting mechanism), the total weight of the vehicle or combination is determined according to the provisions of Article 16 and Clauses 1, 2, and 3 of this Article corresponding to the actual number of axles directly acting on the road surface during circulation on the road.
Article 18. Height of Cargo Stacking on Road Transport Vehicles
1. For open-box trucks with a canopy, the permitted height of cargo stacking is the height limit within the truck bed according to the manufacturer's design or the approved modified design by the competent authority.
2. For open-box trucks without a canopy, cargo stacked higher than the truck bed (according to the manufacturer's design or the approved modified design by the competent authority) must be securely fastened, padded, and braced to ensure safety when traveling on roads. The permitted height of cargo stacking shall not exceed the following heights measured from the highest point of the road surface:
a) Trucks carrying goods weighing 5 tons or more (as recorded in the Vehicle Safety Technical Inspection and Environmental Protection Certificate): the height of cargo stacking shall not exceed 4.2 meters;
b) Trucks carrying goods weighing from 2.5 tons to less than 5 tons (as recorded in the Vehicle Safety Technical Inspection and Environmental Protection Certificate): the height of cargo stacking shall not exceed 3.5 meters;
c) Trucks carrying goods weighing less than 2.5 tons (as recorded in the Vehicle Safety Technical Inspection and Environmental Protection Certificate): the height of cargo stacking shall not exceed 2.8 meters.
3. Special-purpose vehicles and container-carrying vehicles: the height of cargo stacking measured from the highest point of the road surface shall not exceed 4.35 meters.
4. In cases where vehicles carry loose materials such as soil, rock, sand, gravel, coal, ore, or similar goods, the height of cargo stacking shall not exceed the height of the truck bed as recorded in the Vehicle Safety Technical Inspection and Environmental Protection Certificate.
Article 19. Width and Length of Cargo Stacking on Road Transport Vehicles When Traveling on Roads
1. The permitted width of cargo stacking on motorized road transport vehicles is the width of the truck bed according to the manufacturer's design or the approved modified design by the competent authority.
2. The permitted length of cargo stacking on motorized road transport vehicles shall not exceed 1.1 times the total length of the vehicle according to the manufacturer's design or the approved modified design by the competent authority, and shall not exceed 20.0 meters. When transporting goods longer than the truck bed, warning signals must be displayed as required, and the goods must be securely fastened to ensure safety when traveling on roads.
3. Passenger vehicles are not allowed to stack cargo or luggage that protrudes beyond the outer dimensions of the vehicle.
4. Motorcycles and motorbikes are not allowed to stack cargo or luggage exceeding the width of the cargo rack by 0.3 meters on each side as designed by the manufacturer, and exceeding 0.5 meters behind the cargo rack. The height of cargo stacking measured from the road surface shall not exceed 1.5 meters.
5. Non-motorized vehicles are not allowed to stack cargo extending more than one-third of the length of the vehicle body forward and backward, and not more than 1.0 meter; and not exceeding 0.4 meters on each side of the wheels.
Chapter VI
ISSUE PERMITS FOR OVERWEIGHT VEHICLES, OVERSIZE VEHICLES, TRACK-TYPE VEHICLES,
ROAD TRANSPORT OF SUPER-LENGTH AND SUPER-WEIGHT GOODS
Article 20. General Provisions on Issuing Permits for Overweight Vehicles, Oversized Vehicles, Tracked Vehicles, and Extra-Long and Extra-Heavy Cargo Transport Vehicles on Roads
1. Permits for overweight vehicles, oversized vehicles, tracked vehicles, and extra-long and extra-heavy cargo transport vehicles (hereinafter referred to as "Vehicle Permit") shall only be issued on roads in exceptional cases when there are no other transportation options available or when it is not possible to use other types of road motor vehicles suitable for transporting on roads.
2. The authority issuing Vehicle Permits:
a) Shall select reasonable routes based on ensuring traffic safety and the safety of road infrastructure;
b) Shall not issue a Vehicle Permit if the cargo exceeds the load capacity designed by the manufacturer or exceeds the permitted load capacity of the vehicle after design modifications have been approved and recorded on the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle;
c) When allowing operation on expressways, specific conditions for safe participation in traffic such as speed, lane, and permissible operating time must be clearly stipulated in the Vehicle Permit.
3. In cases where the operation of vehicles exceeds the carrying capacity of the road and requires surveying, inspection, or reinforcement of the road, organizations or individuals requesting the operation of such vehicles shall bear full responsibility for all related costs. The competent authority shall issue a Vehicle Permit only after the organizations or individuals have completed the aforementioned tasks.
4. Validity period of the Vehicle Permit:
a) For overweight vehicles and oversized vehicles that do not need to comply with mandatory conditions such as following designated lanes, having escort vehicles, or reinforcing the road: if operating on improved and upgraded roads, the validity period of the Vehicle Permit shall not exceed 60 days; if operating on unimproved or partially upgraded roads, the validity period of the Vehicle Permit shall not exceed 30 days.
b) For overweight vehicles, oversized vehicles, and extra-long and extra-heavy cargo transport vehicles that must comply with mandatory conditions such as following designated lanes, having escort vehicles, or reinforcing the road: the validity period of the Vehicle Permit shall not exceed 30 days.
c) For self-propelled tracked vehicles operating on roads: the validity period of the Vehicle Permit is the duration of each trip from departure to destination.
d) The validity period of the Vehicle Permit specified in points a, b, and c of this clause must fall within the validity period of the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle; if the validity period of the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle is shorter than the periods specified in points a, b, and c of this clause, the validity period of the Vehicle Permit shall be equal to the remaining validity period of the Certificate of Technical Safety Inspection and Environmental Protection of the vehicle.
Article 21. Procedure for Issuing Circulation Permit for Vehicles
1. Organizations and individuals requesting issuance of a Circulation Permit for Vehicles shall prepare one set of application documents to submit directly, through postal services, or at locations specified for online submission to the issuing authority.
2. The application package includes:
a) An application form in accordance with Form 1 and Form 2 attached to this Circular;
b) A copy of the Vehicle Registration Certificate or Temporary Vehicle Registration Certificate for newly received vehicles;
c) A copy of the Technical Inspection Certificate for road safety and environmental protection of motor vehicles; a copy of the technical specifications of the vehicle for newly received vehicles (provided by the manufacturer along with the vehicle);
d) Transportation plan in cases requiring road survey (if applicable), including the following contents: information on the transportation route; information on the transportation vehicle; cargo dimensions (length x width x height in meters) confirmed by the consignor; weight, images (if available); transportation contract or documentation designating the transportation unit by the consignor or the hired transportation unit.
3. Within no more than two working days from the date of receiving complete application documents in accordance with regulations, based on the inspection results, the competent authority as stipulated in Article 22 of this Circular shall issue a Circulation Permit for Vehicles in accordance with Forms 3 and 4 attached to this Circular; if the conditions for issuing a Circulation Permit for Vehicles are not met, a written response must be provided with clear reasons stated.
4. In cases where a road survey is required to establish traffic participation conditions or to reinforce roads, within two working days from the date of receiving valid application documents as stipulated in Clause 2 of this Article, the competent authority issuing the Circulation Permit for Vehicles must issue a written request for organizations and individuals requesting a Circulation Permit for Vehicles on roads to conduct a road survey or reinforcement.
The time limit for reviewing and issuing a Circulation Permit for Vehicles shall not exceed two working days from the date of receipt of the report on the survey results or the completion report of road reinforcement works by qualified consulting organizations ensuring safe vehicle circulation.
Article 22. Authority to Issue Circulation Permit for Vehicles
1. The Director of the Department of Transport, the Director of the Road Administration Bureau shall issue Circulation Permits for Vehicles on the national road network.
2. In special cases serving security, defense, energy projects, disaster prevention and rescue operations, the Minister of Transport shall decide.
Article 23. Responsibilities of the Authority Issuing Circulation Permit for Vehicles
1. The authority issuing Circulation Permits for Vehicles shall bear responsibility under the law for issuing Circulation Permits for Vehicles that comply with the intended subjects, are suitable for the condition of the road network, transportation vehicles, and ensure traffic safety.
2. Has the right to revoke the Circulation Permit for Vehicles in cases of violation of conditions stipulated in the Circulation Permit for Vehicles or causing damage to road infrastructure without completing repair and remediation work.
3. Guide organizations and individuals needing transportation to choose reasonable transportation routes to ensure safety for road infrastructure and transportation vehicles.
4. Provide the current status of the road network on the transportation route upon request of organizations and individuals in need or related issuing authorities.
5. Collect and use fees for issuing Circulation Permits for Vehicles in accordance with regulations of the Ministry of Finance.
Chapter VII
IMPLEMENTATION
Article 24. Inspection, examination, handling of violations, and compensation for damages
1. The inspection, examination, and handling of violations of this Circular shall be carried out in accordance with the current laws on inspection, examination, and handling of violations.
2. In cases where damage to road construction occurs due to the operation of overloaded vehicles, oversized vehicles, tracked vehicles, or vehicles transporting extra-long and extra-heavy goods on roads without complying with the provisions of this Circular, the organizations and individuals violating such provisions shall bear responsibility for compensating for the damage in accordance with the law.
Article 25. Implementation Provisions
1. This Circular takes effect from December 1, 2015, and replaces Circular No. 07/2010/TT-BGTVT dated February 11, 2010, issued by the Minister of Transport regarding the load capacity and dimensional limits of roads; announcing the load capacity and dimensional limits of roads; operating overloaded vehicles, oversized vehicles, and tracked vehicles on roads; transporting extra-long and extra-heavy goods and cargo stacking limits on road transport vehicles when participating in road traffic (hereinafter referred to as Circular No. 07/2010/TT-BGTVT); Circular No. 03/2011/TT-BGTVT dated February 22, 2011, issued by the Minister of Transport amending and supplementing Circular No. 07/2010/TT-BGTVT (hereinafter referred to as Circular No. 03/2011/TT-BGTVT); and Circular No. 65/2013/TT-BGTVT dated December 31, 2013, issued by the Minister of Transport amending and supplementing Circular No. 07/2010/TT-BGTVT.
2. For domestically produced and assembled vehicles:
a) Certificates of Technical Safety and Environmental Protection Quality already issued for vehicle types that do not comply with the provisions of this Circular will lose their validity from the date this Circular takes effect;
b) Vehicle quality inspection certificates issued before the date this Circular takes effect will still be valid for registering vehicles and inspecting technical safety and environmental protection quality.
3. For imported vehicles:
a) Imported vehicles arriving at ports or reaching border gates of Vietnam before the date this Circular takes effect will continue to have their total weight recorded in the Certificate of Technical Safety and Environmental Protection Quality determined according to Circular No. 07/2010/TT-BGTVT and Circular No. 03/2011/TT-BGTVT of the Minister of Transport;
b) Certificates of Technical Safety and Environmental Protection Quality for imported motor vehicles, notifications exempting imported motor vehicles from technical safety and environmental protection quality inspections issued for vehicles arriving at ports or reaching border gates of Vietnam before the date this Circular takes effect will remain valid for importing procedures, initial technical safety and environmental protection quality inspections, pre-tax registration, and vehicle registration according to regulations.
4. Motor vehicles that have been issued Certificates of Technical Safety and Environmental Protection Quality before the date this Circular takes effect, if they carry goods exceeding the permitted cargo weight, must adjust relevant parameters in accordance with the provisions of this Circular.
Article 26. Implementation
1. The General Department of Roads of Vietnam shall be responsible for:
a) Organizing, inspecting, and supervising the implementation of the provisions of this Circular; taking the lead and coordinating with agencies issuing vehicle operation permits in connecting data networks to the General Department of Roads of Vietnam; managing data on vehicle operation permits in accordance with regulations;
b) Organizing training on the implementation of this Circular; guiding the use of software for vehicle permit issuance to issuing authorities;
c) Regularly, periodically, and randomly inspecting and supervising the issuance of permits by agencies issuing vehicle operation permits; handling or recommending the handling of violations by organizations and individuals issuing vehicle operation permits in accordance with the law.
2. The Road Administration Bureau, Provincial Departments of Transport shall be responsible for:
a) Adhering to the provisions of this Circular;
b) Publicizing procedures, fees, and processing times for vehicle permits;
c) Implementing storage and reporting systems as prescribed; connecting, securing passwords, and updating data from the network provided by the General Department of Roads of Vietnam;
d) Adhering to and facilitating the inspection, examination, and supervision of vehicle operation permit issuance activities by competent authorities;
đ) Reporting quarterly and annually on the situation of vehicle operation permit issuance to the General Department of Roads of Vietnam using the templates in Appendices 5a, 5b, 5c, and 6 attached to this Circular. Quarterly reports are due by the last day of the quarter, and annual reports are due by December 15.
3. The Heads of the Ministry's Office, the Inspectorate of the Ministry, the Heads of Departments, the Director of the General Department of Roads of Vietnam, the Directors of the Vietnam Vehicle Inspection Bureau, the Director of the Vietnam Railway Administration, the Directors of Provincial Departments of Transport, and the Heads of related agencies, organizations, and individuals are responsible for implementing this Circular.
4. During the implementation process, agencies, organizations, and individuals should promptly report any arising issues to the Ministry of Transport for consideration and resolution./.
