Foreword
QCVN 19-1:2015/BYT was Drafted by the working group for drafting national technical standards for food additives and processing aidsof the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairsand supporting materials compiled, reviewed by the Food Safety Agency, examined by the Ministry of Science and Technology, and promulgated pursuant to Circular No. 46/2015/TT-BYT dated December 1, 2015 of the Minister of Health.

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This regulation sets out technical requirements and management requirements for vanilla flavoring substances used as food flavorings (hereinafter referred to as vanilla flavoring substances).

2.1. Organizations and individuals importing, producing, and trading vanilla flavoring substances in Vietnam.
2.2. Relevant state management agencies.

In this regulation, the following abbreviations have the meanings set forth below:

II. TECHNICAL REQUIREMENTS, TESTING METHODS, SAMPLING AND LABELING
1. Technical Requirements and Testing Methods
Technical requirements for vanilla flavoring substances are specified in the appendices attached to this regulation as follows:
1.1. Appendix 1: Technical testing requirements for Vanillin.
1.2. Appendix 2: Technical requirements for Ethylvanillin.
The testing methods provided in this regulation are not mandatory and other equivalent accurate testing methods may be used.
2. Sampling Provisions
Sampling shall be carried out in accordance with the guidance provided in Circular No. 26/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology "Regulations on State Quality Control of Goods Circulating in the Market" and other relevant laws.
3. Labeling Requirements
Labeling of solvents must comply with the provisions of Decree No. 89/2006/NĐ-CP dated August 30, 2006 of the Government on product labeling, Circular Joint No. 34/2014/TTLT-BYT-BNNPTNT-BCT dated October 27, 2014 of the Ministers of Health, Agriculture and Rural Development, and Industry and Trade guiding labeling of products for food, food additives, and processed food ingredients, and other relevant laws.
III. MANAGEMENT REQUIREMENTS
1. Declaration of Conformity
1.1. Vanilla flavoring substances must be declared in compliance with the provisions of this regulation.
1.2. The method, procedure, and process for declaring conformity is implemented according to Article 6 and Article 7 of Decree No. 38/2012/NĐ-CP dated April 25, 2012 of the Government detailing implementation of certain provisions of the Food Safety Law and Article 4, Article 5, Article 7, and Article 9 of Circular No. 19/2012/TT-BYT dated November 9, 2012 of the Minister of Health guiding declaration of conformity and compliance with food safety regulations and other relevant laws.
2. Supervision, inspection, and handling of violations
Competent state authorities shall carry out supervision, inspection, and handling of violations by organizations and individuals importing, producing, and trading vanilla flavoring substances that violate the technical and management provisions set out in this regulation and other relevant laws.
IV. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
1. Organizations and individuals importing, producing, and trading vanilla flavoring substances must declare conformity in accordance with the requirements of this regulation.
2. Organizations and individuals are only allowed to import, produce, and trade vanilla flavoring substances after receiving the Declaration of Conformity Acceptance Certificate from the Food Safety Agency and complying with other current relevant laws.
V. IMPLEMENTATION
1. Entrust the Food Safety Agency to take the lead and coordinate with relevant functional agencies to guide implementation and organization of enforcement of this regulation.
2. Based on management requirements, the Food Safety Agency has the responsibility to propose the Minister of Health to amend and supplement this regulation.
3. In case international guidelines on testing methods and laws cited in this regulation are amended, supplemented, or replaced, the new document shall apply.
