Amending and supplementing some articles of Circular No. 21/2015/TT-BCT dated June 23, 2015 issued by the Minister of Industry and Trade stipulating the method for determining the price of system ancillary services, procedures for inspecting

contracts for providing system ancillary services

Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Based on the Electricity Law dated December 3, 2004, and the Law Amending and Supplementing Certain Provisions of the Electricity Law dated November 20, 2012;

Based on Decree No. 137/2013/NĐ-CP dated October 21, 2013, issued by the Government, detailing the implementation of certain provisions of the Electricity Law and the Law Amending and Supplementing Certain Provisions of the Electricity Law;

At the proposal of the Director of the Electricity Regulatory Authority,

The Minister of Industry and Trade issues this Circular to amend and supplement some articles of Circular No. 21/2015/TT-BCT dated June 23, 2015 issued by the Minister of Industry and Trade stipulating the method for determining the price of system ancillary services, procedures for inspecting contracts for providing system ancillary services. Amending and supplementing some articles of Circular No. 21/2015/TT-BCT dated June 23, 2015 issued by the Minister of Industry and Trade stipulating the method for determining the price of system ancillary services, procedures for inspecting contracts for providing system ancillary services (hereinafter referred to as Circular No. 21/2015/TT-BCT) as follows:

Article 1. 1. Amending and supplementing Clause 1, Clause 2 and Clause 3 Article 2 as follows: Expected available capacity of the unit

is the maximum capacity expected to be achieved when the unit operates continuously and stably over a certain period agreed upon by both parties in accordance with the technical specifications of the unit.

“1. Ancillary service includes the following services:

2. a) Rapid start-up ancillary service; b) Mandatory ancillary service operation to ensure power system security:

- Continuous mandatory ancillary service operation of power plants to ensure power system security;

- Mandatory ancillary service operation of gas turbine power plants according to the orders of the Power System Operation Unit and the electricity market to ensure power system security (referred to as mandatory ancillary service operation of gas turbine power plants) when the plant operates in simple cycle or lacks primary fuel and must use part or all of the secondary fuel.

c) Spinning reserve ancillary service;

d) Frequency regulation ancillary service;

đ) Voltage regulation ancillary service;

e) Black start ancillary service.

Ancillary service provider

is a power generation unit owning one or more power plants that are mobilized to provide ancillary services at the request of the Power System Operation Unit and the electricity market to ensure power system security.

3. "1. For power plants listed to provide rapid start-up ancillary services and continuous mandatory ancillary services to ensure power system security: The ancillary service price shall be determined based on the principle of ensuring sufficient compensation for actual reasonable and legitimate costs necessary and reasonable profit in a year for the ancillary service providers which are thermal power plants; the ancillary service price does not include value-added tax, other taxes, and payments required by relevant laws. The ancillary service price for this entity includes the following components: a) Fixed price;

b) Variable price;

c) Start-up price;

d) Other expenses (if any).

2. For frequency regulation ancillary services, the pricing principle is as follows:

a) For strategic multi-purpose hydropower plants of Vietnam Electricity Corporation not directly participating in the electricity market and listed to provide frequency regulation ancillary services: Reasonable and legitimate costs incurred due to providing frequency regulation ancillary services are included in the annual cost of strategic multi-purpose hydropower plants according to the provisions on the method and procedure for determining annual costs and electricity prices of strategic multi-purpose hydropower plants issued by the Ministry of Industry and Trade;

b) For power plants directly participating in the electricity market and listed to provide frequency regulation ancillary services: Revenue is calculated according to the Provisions on Competitive Electricity Market Operations issued by the Ministry of Industry and Trade.

3. For spinning reserve ancillary services, the pricing principle is as follows:

a) For strategic multi-purpose hydropower plants of Vietnam Electricity Corporation not directly participating in the electricity market and listed to provide spinning reserve ancillary services: Reasonable and legitimate costs incurred due to providing spinning reserve ancillary services are included in the annual cost of strategic multi-purpose hydropower plants according to the provisions on the method and procedure for determining annual costs and electricity prices of strategic multi-purpose hydropower plants issued by the Ministry of Industry and Trade;

b) For power plants directly participating in the electricity market and listed to provide spinning reserve ancillary services: Revenue is calculated according to the Provisions on Competitive Electricity Market Operations issued by the Ministry of Industry and Trade.

4. For voltage regulation ancillary services, mandatory ancillary service operation of gas turbine power plants, and black start ancillary services, the pricing principle is as follows:

a) For strategic multi-purpose hydropower plants of Vietnam Electricity Corporation listed to provide voltage regulation ancillary services and black start ancillary services: Reasonable and legitimate costs incurred due to providing voltage regulation ancillary services and black start ancillary services are included in the annual cost of strategic multi-purpose hydropower plants according to the provisions on the method and procedure for determining annual costs and electricity prices of strategic multi-purpose hydropower plants issued by the Ministry of Industry and Trade;

b) For power plants listed to provide voltage regulation ancillary services, mandatory ancillary service operation of gas turbine power plants, and black start ancillary services that are not strategic multi-purpose hydropower plants of Vietnam Electricity Corporation: The ancillary service provider is responsible for negotiating the ancillary service price, negotiating and signing ancillary service provision contracts with Vietnam Electricity Corporation. The method for determining the cost of voltage regulation ancillary services, mandatory ancillary service operation of gas turbine power plants, and black start ancillary services is implemented according to the provisions of Section 3 Chapter II of this Circular.

3. Amending the name of Section 2 Chapter II as follows:

METHOD FOR DETERMINING THE PRICE OF RAPID START-UP ANCILLARY SERVICES AND CONTINUOUS MANDATORY ANCILLARY SERVICES OF POWER PLANTS TO ENSURE POWER SYSTEM SECURITY

4. Amending and supplementing the beginning of Article 5; Clause 1; Point b, Point c, Point đ, Point e and Point g Clause 2 Article 5; supplementing Clause 3a Article 5 as follows:

"Section 2

METHODS FOR DETERMINING THE VALUE OF QUICK START SUPPORT SERVICES AND REGULAR OPERATIONAL SUPPORT SERVICES OF ELECTRIC POWER PLANTS TO ENSURE THE SECURITY OF THE ELECTRIC POWER SYSTEM

4. AMEND AND SUPPLEMENT THE BEGINNING OF ARTICLE 5; CLAUSE 1; POINT b, POINT c, POINT đ, POINT e AND POINT g OF CLAUSE 2 OF ARTICLE 5; ADD CLAUSE 3a OF ARTICLE 5 AS FOLLOWS:

a) Amend and supplement the beginning of Article 5 as follows:

"Fixed revenue year N (G") of the Service Support Unit is determined according to the following formula:

CSCL:

The total depreciation cost of fixed assets year N of the Service Support Unit is determined in accordance with Clause 1 of this Article (in dong);

The total interest payment and other fees for borrowing funds payable in year N for investment in assets of the Service Support Unit (in dong);

Prescribed profit year N (in dong).”

b) Amend and supplement Clause 1 of Article 5 as follows:

“1. The total depreciation cost of fixed assets (CSCL) of the Service Support Unit in year N is determined as follows:

The period of use and method of depreciation of fixed assets shall be implemented in accordance with the Circular guiding the Ministry of Finance and other relevant guiding documents of competent state agencies. The total depreciation cost of fixed assets is the estimated value of depreciation of fixed assets expected to be accrued in year N at the time both parties negotiate the pricing plan to submit for the valuation of service support provided by the power plant.

In case there is a difference between the estimated depreciation value of fixed assets in the service support pricing plan of year N-1 and the actual implementation in year N-1, this difference will be considered for adjustment in the depreciation cost in the service support pricing plan of year N if necessary.”

c) Amend and supplement Points b, c, đ, e, and g of Clause 2 of Article 5 as follows:

“b) Method for determining the total labor cost (CTL)

Total labor cost year N (CTL) includes total labor costs and other costs with the nature of wages such as health insurance, social insurance, unemployment insurance, and trade union fees, which are determined in accordance with relevant laws.

In case there is a difference between the total labor costs and other costs with the nature of wages such as health insurance, social insurance, unemployment insurance, and trade union fees estimated in the service support pricing plan of year N-2 and the actual implementation in year N-2 in accordance with the regulations of competent state agencies, both parties may consider adjusting these costs in the service support pricing plan of year N if necessary.

c) Method for determining the total major repair cost (CMN)

Total major repair cost (CMN) year N is agreed upon based on the approved value by the competent authority. In case there is a difference between the estimated major repair value in the service support pricing plan of year N-2 and the actual implementation in year N-2 due to changes in repair items, repair schedules, and repair contents, both parties may consider adjusting the major repair cost in the service support pricing plan of year N if necessary.

đ) Method for determining the total other monetary costs (CK)

Total other monetary costs year N (CK) are determined excluding taxes and fees.

Meal allowance and land rental fee for year N are determined in accordance with the regulations. Total other monetary costs year N (CK) do not include meal allowance and land rental fee, which are determined based on the audited costs of year N-2, adjusted for inflation at 2.5% per year, excluding abnormal expenses of year N-2 and including reasonable anticipated expenses of year N that were not included in year N-2.

e) Exchange rate differential cost year N is calculated based on the foreign currency loan contract, the actual repayment plan for the principal of foreign currency loans, and the exchange rate expected to be paid in year N. In case there is a difference between the estimated exchange rate differential in the service support pricing plan of year N-2 and the actual implementation in year N-2, both parties may consider adjusting the exchange rate differential cost in the service support pricing plan of year N if necessary;

g) In case the material costs, external service costs, and other monetary costs of year N-1 have been audited and settled, both parties have the right to agree to use these figures to calculate the corresponding costs for year N.”

d) Supplement Clause 3a after Clause 3 of Article 5 as follows:

“3a. Adjusted fixed revenue (GĐC) of the Service Support Unit in year N is determined based on the difference between the actual availability factor and the planned availability factor in the pricing plan due to changes in repair schedules and downtime for repairs in year N-2 (excluding downtime shortened due to the efforts of the power plant).”

5. Supplement Article 5a after Article 5 as follows:

“Article 5a. Method for Determining Long-Term Service Support Prices

1. The long-term pricing cycle is equal to the term of the long-term service support supply contract stipulated in the Service Support Supply Contract.

The long-term service support price is determined annually from year N (the first year of the pricing cycle) until the end of the contract term.

2. Annual Pricing Principles

a) Fixed prices, total fixed revenues, depreciation costs of fixed assets, interest payment costs, fixed material costs, labor costs, major repair costs, external service costs, other monetary costs, and profits for each year within the pricing cycle are determined in accordance with the provisions similar to those in Section 2 of Chapter II of this Circular.

b) Material costs, external service costs, and other monetary costs (excluding meal allowances and land rentals) for year N are determined in accordance with the provisions similar to those in Section 2 of Chapter II of this Circular, from year N+1 to the end of the contract term, these costs are adjusted for inflation at 2.5% per year starting from year N. Meal allowances and land rentals are determined in accordance with relevant laws.

3. Mechanism for Adjusting Service Support Prices Annually

a) Before November 1st each year, when the settlement and audit data of the previous year are available, in case there is a difference between the actual major repair costs, labor costs, exchange rate differentials, and availability factors compared to the pricing plan and the actual implementation of the previous year, both parties may consider adjusting these differences into the pricing plan for the next year if necessary.

b) Before November 1 of each year, in cases where there is a difference in depreciation of fixed assets between the pricing scheme for auxiliary services and the actual situation of that year, both parties shall consider adjusting this difference into the pricing scheme for auxiliary services of the following year if necessary.

c) Before November 1 of each year, when there are audit figures from the previous adjacent year regarding material costs, external service costs, and other monetary costs, both parties shall consider updating these costs into the pricing scheme for auxiliary services of the following year if necessary.

d) Before November 1 of each year, in cases where there are new state regulations on wages, taxes, and finance, both parties shall consider calculating and adjusting these into the price of auxiliary services of the following year.

6. Amend and supplement Section 3 Chapter II as follows:

"Section 3

METHODS FOR DETERMINING COSTS OF AUXILIARY SERVICES FOR BLACK START, VOLTAGE REGULATION AUXILIARY SERVICES AND OTHER AUXILIARY SERVICES

REQUIRED TO OPERATE GAS TURBINE POWER PLANTS

Article 8. Method for Determining Black Start Cost

1. For thermal power plants

The total black start cost (ofk,i,j) of the Auxiliary Service Provider is determined as follows:

 

a) The black start cost ( ) for each black start of unit i under each black start mode is determined according to the following formula:

b) The black start maintenance cost (Cdt) includes the cost of black start drills as stipulated in the National Black Start and System Restoration Regulations issued by the Ministry of Industry and Trade and the maintenance cost of equipment for black start (if any).

2. For hydropower plants

a) For strategic multi-purpose hydropower plants of Vietnam Electricity Corporation: Reasonable and legitimate costs incurred due to providing black start auxiliary services are included in the annual cost of strategic multi-purpose hydropower plants as stipulated in the Regulations on Methods and Procedures for Determining Annual Costs and Electricity Prices of Strategic Multi-Purpose Hydropower Plants issued by the Ministry of Industry and Trade;

b) For hydropower plants that are not strategic multi-purpose hydropower plants of Vietnam Electricity Corporation: The total black start cost (Gk,i,j) of the Auxiliary Service Provider is determined based on the black start maintenance cost (Cdt) as stipulated in Point b Clause 1 of this Article.

3. The payment period for black start costs is agreed upon and unified in the Black Start Auxiliary Services Supply Contract.

Article 8a. Method for Determining Costs of Voltage Regulation Auxiliary Services

1. The total cost of voltage regulation auxiliary services is determined by the reactive power running cost of power plants providing auxiliary services during the time units are mobilized to run reactive power (Rcb), determined as follows:

The amount Buyer must pay Seller for the received electricity volume serving reactive power running (VND);

D:

Total number of days in the month;

Transaction day for the received electricity volume serving reactive power running;

Acb:

The received electricity volume serving reactive power running is determined according to the electricity volume receipt statement for reactive power running issued by the Power System Operation and Electricity Market Unit (kWh);

ofsx:

The retail electricity price corresponding to peak, off-peak, and normal hours for industries using reactive power running according to the regulated voltage level (VND/kWh);

Cbd:

Maintenance cost of reactive power running equipment (if any).

2. The payment period for reactive power running costs for voltage regulation is agreed upon and unified in the Voltage Regulation Auxiliary Services Supply Contract.

Article 8b. Method for Determining the Cost of Ancillary Services Operation Must Supply of Gas Turbine Power Plants 1. The ancillary services operation must supply of gas turbine power plants shall be paid for fuel costs, operating costs, and maintenance expenses as stipulated in the Ancillary Services Supply Contract. Fixed costs (or capacity fees) and other costs shall be agreed upon by both parties to ensure they are not double-counted in accordance with the law.

2. The payment period for the ancillary services operation must supply of gas turbine power plants shall be agreed upon by both parties in the Ancillary Services Supply Contract.

7. Amend Clause 1 of Article 9 as follows:

"1. Before November 15 of year N-1, Vietnam Electricity Corporation shall be responsible for submitting to the Electricity Regulatory Authority for review the price of quick-start ancillary services and the ancillary services operation must supply of power plants for year N (for annual Ancillary Services Supply Contracts) or each year during the term of the contract (for long-term Ancillary Services Supply Contracts) to ensure the security of the power system of ancillary service providers according to Articles 4, 5, 6, and 7 of this Circular."

"1. The model contract for providing ancillary services prescribed in the Appendix attached to this Circular shall apply to the provision of quick-start services, regular operation must supply of power plants to ensure the security of the power system, voltage regulation ancillary services, ancillary services operation must supply of gas turbine power plants, and black start ancillary services between the designated ancillary service provider and Vietnam Electricity Corporation.

8. Amend Article 11 as follows:

2. For the provisions on payment for voltage regulation ancillary services, ancillary services operation must supply of gas turbine power plants, and black start ancillary services, they shall comply with the provisions of Section 3 Chapter II of this Circular."

1. The Electricity Regulatory Authority shall be responsible for:

9. Amend and supplement Article 14 as follows:

a) Issuing the Procedures for Determining and Operating Ancillary Services, and the list of power plants providing ancillary services according to the transmission system regulations issued by the Ministry of Industry and Trade;

b) Reviewing and approving the list of power plants providing black start ancillary services according to the transmission system regulations and the national black start and system recovery regulations issued by the Ministry of Industry and Trade;

c) Approving the price of ancillary services provided by power plants offering quick-start ancillary services, ancillary services operation must supply to ensure the security of the power system, voltage regulation ancillary services, and black start ancillary services after reviewing by the Minister of Industry and Trade;

d) Inspecting the Ancillary Services Supply Contracts;

đ) Directing, inspecting the implementation of this Circular and resolving disputes arising therefrom.

2. Vietnam Electricity Corporation shall be responsible for:

a) Compiling the list of power plants providing ancillary services according to the transmission system regulations and the national black start and system recovery regulations issued by the Ministry of Industry and Trade;

b) Agreeing and approving the repair schedule for power plants providing ancillary services based on the actual repair time of similar components at the plant and the equipment manufacturer's standards;

c) Reviewing the costs already included in the electricity purchase contract prices of power plants listed as providing voltage regulation ancillary services and black start ancillary services to ensure that they are not double-counted or overcharged in ancillary service costs;

d) Agreeing and unifying the price and cost of ancillary services with the ancillary service provider;

đ) Negotiating, signing, or authorizing the Electricity Purchasing Company to negotiate and sign contracts for ancillary services with the ancillary service provider; submitting the ancillary services supply contract to the Electricity Regulatory Authority for inspection;

e) Submitting to the Electricity Regulatory Authority for approval the price of ancillary services agreed upon with the ancillary service provider.

3. The ancillary service providers offering quick-start services, ancillary services operation must supply to ensure the security of the power system, spinning reserve ancillary services, frequency regulation ancillary services, voltage regulation ancillary services, and black start ancillary services shall be responsible for:

Negotiating and signing ancillary services supply contracts;

  1. Providing complete information; ensuring the accuracy, reasonableness, and validity of the data and documents provided to relevant units and agencies during negotiations and inspections of ancillary services supply contracts."
  2. 10. Amend and supplement Clause 2 of Article 15 as follows:

"2. Vietnam Electricity Corporation and the ancillary service provider may choose to calculate the long-term ancillary service price according to the major equipment overhaul cycle of the power plant according to the method prescribed in Article 5a of this Circular.

In determining the long-term ancillary service price, Vietnam Electricity Corporation shall be responsible for negotiating and agreeing on the long-term ancillary service price with the ancillary service provider, applying it uniformly to the ancillary service providers according to the provisions of this Circular."

11. Amend Clause 2 of Article 2 of the Model Ancillary Services Supply Contract issued under Circular No. 21/2015/TT-BCT as follows:

"2. Term of the Contract

 

Unless the contract is extended or terminated before the term specified in Article 9 of this Contract, the contract term shall be agreed upon by both parties in accordance with the term specified in the list of power plants providing ancillary services issued by the competent state authority."

12. Repeal Clause 3 of Article 1 and Article 13 of Circular No. 21/2015/TT-BCT.

1. This Circular shall take effect from the date of
