Regulations on job code, occupational standards, and salary grading for civil servantsspecializing in road project management

Pursuant to the Law VDecree No. 249/2010/ND-CP dated November 15, 2010; Law Amending and Supplementing Certain Provisions of the Civil Servants Law and the Civil Servant Law dated November 25, 2019;

Pursuant to the Government Decree Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forces; Decree No. 17/2013/NĐ-CP dated February 19, 2013 and Decree No. 117/2016/NĐ-CP dated July 21, 2016 of the Government amending and supplementing certain provisions of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary system for cadres, public officials, civil servants, and armed forcesonFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract. salary for civil servants, public officials, and members of the armed forces;

Minister of Ministry of Transport issues this Circular stipulating job code, Technical requirements occupational standards and salary grading for civil servants specializing in road project management highway project.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the job code, occupational standards, and salary grading for civil servants specializing in road project management.

Article 2. This Circular applies to civil servants specializing in road project management at public service organizations and related organizations and individuals.

Article 3. Non-public service organizations may apply the provisions of this Circular.

Article 3. Job codes for occupational titles of civil servants specializing in road project management

1. Level I Road Project Management Job Code: V.12.23.01

2. Level II Road Project Management Job Code: V.12.23.02

3. Level III Road Project Management Job Code: V.12.23.03

4. Level IV Road Project Management Job Code: V.12.23.04

Article 3. General standards for professional ethics

1. Implement the Party's policies and State laws.

2. Be honest, objective, and highly responsible for assigned tasks; fulfill all obligations of a civil servant in professional activities.

3. Cultivate moral integrity, maintain professional reputation and prestige; refrain from abusing work positions for personal gain; foster teamwork, creativity, and continuous self-improvement; actively participate in scientific research projects and technical improvements to enhance professional development and competence.

Chapter II

OCCUPATIONAL STANDARDS

Article 4. Level I Road Project Management - Job Code: V.12.23.01

1. Duties:

a) Lead the implementation of tasks related to road project management within the functions and duties of public service organizations as prescribed by law;

b) Lead the research, proposal, and development of policies, guidelines, plans, and technological applications in road project management activities;

c) Lead the development of regulations for specialized road project management operations;

d) Lead the research of topics, programs, and scientific studies aimed at improving and perfecting management mechanisms, enhancing the effectiveness of road project management activities;

đ) Lead the compilation and development of professional guidance materials for specialized road project management; organize specialized training sessions, vocational training, or dissemination of knowledge and experience in road project management;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for civil servants specializing in road project management.

3. Qualifications regarding professional expertise and skills:

a) Proficient in the Party's viewpoints, policies, and State laws, and industry and sectoral strategies; knowledgeable in professional and operational skills in road project management within the industry and sector;

b) Familiar with the development trends of the road sector both domestically and internationally; have in-depth knowledge of road project management; capable of applying technology within the scope of assigned tasks;

c) Capable of researching, developing proposals, programs, and action plans; capable of advising on strategic planning, master planning, policy formulation, and operational procedures related to specialized road project management;

d) Capable of implementing assigned tasks; able to analyze practical issues and propose solutions to improve specialized road project management policies;

đ) Skilled in drafting, presenting, developing, and implementing projects, proposals, and programs related to road project management activities;

e) Possess basic information technology skills and be able to use foreign languages or ethnic minority languages for civil servants working in ethnic minority areas according to job requirements.

Article 4. Criteria and conditions for registering to take the examination or be considered for promotion to the Level I Road Project Management position:

a) Have held the Level II Road Project Management position or equivalent for at least six years. In cases where the equivalent period is shorter, there must be at least one year (twelve months) holding the Level II Road Project Management position up to the deadline for submitting the application for examination or promotion;

b) During the time holding the Level II Road Project Management position or equivalent, meet at least one of the following criteria:

Civil servants can register to take the examination or be considered for promotion to the Level I Road Project Management position when they meet all the criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, utilization, and management of civil servants, and the following criteria and conditions:

Lead the development of one scientific and technological program at the ministry or provincial level that has been approved or accepted by the competent authority;

Lead the development of two scientific and technological programs at the organizational level that have been approved or accepted by the competent authority;

Have served as the director of project management for one Class A project or two Class B projects of the same type; or have led the design or review of two Class I projects or three Class II projects;

Have led the execution of cost management for one Class A project or two Class B projects or one Class I project or two Class II projects; 

Has participated in managing one project group A or two projects group B of the same type and holds one of the four professional certificates: Project Management Class I, Construction Design Class I, Construction Supervision Class I, or Construction Valuation Class I.

Article 5. Highway Project Management Class II - Code: V.12.23.02

1. Duties:

a) To lead or participate in performing tasks related to highway project management within the functions and responsibilities of public service units as prescribed by law;

b) To lead or participate in organizing the compilation and construction of specialized technical guidance materials for highway project management; to lead or participate in organizing specialized training sessions, vocational training, or disseminating knowledge and experience in highway project management;

c) To lead or participate in researching and establishing regulations on specialized vocational management for highway project management;

d) To lead or participate in researching topics, programs, scientific research works aimed at innovating and perfecting management mechanisms, enhancing the effectiveness of highway project management activities;

e) To participate in researching, proposing, and constructing policies, orientations, plans for the development and application of science and technology in highway project management activities;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for civil servants specializing in road project management.

3. Qualifications regarding professional expertise and skills:

a) To thoroughly understand the viewpoints, policies, and guidelines of the Party, state laws and policies; to be well-versed in knowledge and specialized skills in highway project management activities within the industry;

b) To be aware of the situation and trends in the development of the industry both domestically and internationally; to have in-depth knowledge about highway project management; to have knowledge and experience in developing, applying, and implementing technology within the scope of work undertaken;

c) To have the ability to research and draft normative legal documents, programs, projects, action plans, and guidelines for implementing systems, policies, and regulations on state administration within the industry;

d) To have the ability to research, summarize practical experiences, and propose solutions to improve the quality and efficiency of work within the assigned industry;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

4. Criteria and Conditions for Registering to Take the Examination or Being Considered for Promotion to the Title of Highway Project Management Class II Professional:

a) To have held the title of Highway Project Management Class III or equivalent for at least nine years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (full twelve months) holding the title of Highway Project Management Class III up to the deadline for submitting registration applications for examination or promotion;

b) During the period of holding the title of Highway Project Management Class III or equivalent, to meet at least one of the following criteria and conditions:

Civil servants may register to take the examination or be considered for promotion to the title of Highway Project Management Class II when they meet all the criteria and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, employment, and management of civil servants and the following criteria and conditions:

Participate in building one topic, program, project, or scientific and technological program at the ministry level or provincial level and above that has been issued or accepted by the competent authority;

Participate in building two topics, programs, projects, or scientific and technological programs at the grassroots level where the employing agency is responsible for research and construction, which have been issued or accepted by the competent authority;

Has served as the director managing one project group B or two projects group C of the same type;

Has led or reviewed the design of two class II projects or three class III projects;

Has led the implementation of one of the cost management tasks of one project group B or two projects group C or one class II project or two class III projects;

Has participated in managing at least one project group B or two projects group C and holds one of the four professional certificates: Project Management Class II, Construction Design Class II, Construction Supervision Class II, or Construction Valuation Class II.

Article 6. Management of Class III Road Projects - Code: V.12.23.03

1. Duties:

a) Participate in building plans and specific business procedures to implement assigned tasks;

b) Participate in researching and proposing policies, orientations, development plans, and the application of science and technology within the scope of assigned tasks;

c) Study and resolve issues within the scope of assigned tasks according to authority or advise higher authorities to resolve such issues; propose measures to enhance management efficiency within the scope of assigned tasks;

d) Directly carry out specialized activities related to project management; participate in establishing internal regulations;

đ) Inspect, collect information, compile statistics, manage files, and store data on issues related to the assigned field to ensure strict, accurate, and principled state management;

e) Perform other tasks assigned by competent authorities.

2. Qualifications regarding education and training:

a) Hold a bachelor’s degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for civil servants specializing in road project management.

3. Qualifications regarding professional expertise and skills:

a) Master the viewpoints, policies, and guidelines of the Party and the laws and policies of the State; understand the orientation and tasks of development in the road sector;

b) Possess professional knowledge in road project management; propose and research scientific advancements and apply technological progress to improve the efficiency of professional and business activities;

c) Be proficient in professional business procedures, understand methods for organizing the implementation of assigned tasks; be familiar with the process of developing plans and proposals; have skills in drafting documents and presenting assigned issues;

d) Have analytical, synthesis, and situation handling skills related to professional work;

đ) Have basic computer skills and be able to use foreign languages or ethnic minority languages as required by the position for civil servants working in ethnic minority areas.

4. Standards and Conditions for Registering to Take Examinations or Apply for Promotion to the Title of Class III Road Project Manager:

a) Have held the title of Class IV Road Project Manager or equivalent for at least three years (excluding probationary and trial periods). In cases with equivalent time, there must be at least one year (twelve months) holding the title of Class IV Road Project Manager up to the deadline for submitting examination registration or promotion application forms;

b) During the period of holding the title of Class IV Road Project Manager or equivalent, meet at least one of the following standards and conditions:

Civil servants may register to take examinations or apply for promotion to the title of Class III Road Project Manager when meeting all standards and conditions stipulated in Article 32 of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government on recruitment, employment, and management of civil servants, and the following standards and conditions:

Have participated in managing one Class C project of the same type;

Have led the design or review or verification of two Class III works;

Have led the execution of one of the cost management tasks of one Class C project or one Class III work;

Have participated in managing one Class C construction investment project and hold one of the four professional certificates: Class III Project Management, Class III Construction Design, Class III Construction Supervision, or Class III Construction Valuation.

Article 7. Management of Class IV Road Projects - Code: V.12.23.04

1. Duties:

a) Carry out specialized activities related to road project management according to assigned tasks;

b) Advise higher authorities to make decisions on handling specific issues within the assigned field based on job positions and legal provisions;

c) Collect information, compile statistics, manage files, and store data on issues related to assigned tasks, ensuring strictness, accuracy, and adherence to principles;

d) Perform other tasks assigned by higher authorities.

2. Qualifications regarding education and training:

a) Hold a college degree or higher in a relevant field that meets the requirements of the position;

b) Hold a certificate in professional development according to the occupational standards for civil servants specializing in road project management.

3. Qualifications regarding professional expertise and skills:

a) Master the viewpoints, policies, and guidelines of the Party and the laws and policies of the State; understand the orientation and tasks of development in the road sector;

b) Possess professional knowledge in road project management; directly execute assigned tasks;

c) Understand administrative procedures, management operations, and task execution processes;

d) Proficiently use office equipment and other tools necessary for task requirements.

Chapter III

SALARY FOR THE PROFESSIONAL TITLE OF CIVIL SERVANTS

ROAD PROJECT MANAGEMENT SPECIALTY

Article 8. Principles for grading salaries for professional positions in the project management profession for road construction

1. The appointment and salary grading for professional positions in the project management profession for road construction must be based on the job position, responsibilities, expertise, and vocational qualifications currently held, and must fully meet the standards as prescribed in this Circular.

2. When transferring to a corresponding professional position in the project management profession for road construction, it shall not combine with salary grade promotion or professional position advancement for civil servants.

Article 9. Grading salaries for professional positions in the project management profession for road construction

1. From the date this Circular takes effect, in cases where civil servants do not yet meet the criteria and conditions for appointment to professional positions in the project management profession for road construction as stipulated in Articles 4, 5, 6, and 7 of this Circular, the following measures shall be implemented:

a) If the civil servant has less than five years (60 months) until retirement, they shall continue to hold their current rank or professional position level and be graded according to the current salary scale.

b) If the civil servant has five years (60 months) or more until retirement, within three years (36 months), the employing agency shall be responsible for arranging training to ensure that the civil servant meets the criteria for the professional position level in the project management profession for road construction as stipulated in this Circular. After the time specified in this point, if the civil servant does not meet the criteria as stipulated in this Circular, the head of the public service unit shall consider assigning other suitable work or implementing policies as prescribed.

2. The professional positions for civil servants in the project management profession for road construction as prescribed in this Circular shall apply the Salary Scale for Professional Expertise and Vocational Qualifications for Civil Servants and Employees in State Public Service Units (Table 3) issued together with Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on the salary system for civil servants, employees, and armed forces personnel, as follows:

a) The professional position Project Manager for Road Construction Level I shall apply the salary coefficient for employee type A3, group 1 (A3.1) from coefficient 6.20 to coefficient 8.00;

b) The professional position Project Manager for Road Construction Level II shall apply the salary coefficient for employee type A2, group 1 (A2.1) from coefficient 4.40 to coefficient 6.78;

c) The professional position Project Manager for Road Construction Level III shall apply the salary coefficient for employee type A1 from coefficient 2.34 to coefficient 4.98;

d) The professional position Project Manager for Road Construction Level IV shall apply the salary coefficient for employee type A0 from coefficient 2.10 to coefficient 4.89.

3. The transfer of salary grading for civil servants in the project management profession for road construction who are currently graded under existing civil servant and employee ranks to the professional positions in the project management profession for road construction as prescribed in this Circular shall be carried out in accordance with the guidance provided in Clause 2, Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Minister of Home Affairs on salary grading when advancing ranks, transferring ranks, or changing types of civil servants and employees, specifically as follows:

a) Grade the professional position Project Manager for Road Construction Level I, code V.12.23.01 for civil servants currently graded at type A3, group 1 (A3.1);

b) Grade the professional position Project Manager for Road Construction Level II, code V.12.23.02 for civil servants currently graded at type A2, group 1 (A2.1);

c) Grade the professional position Project Manager for Road Construction Level III, code V.12.23.03 for civil servants currently graded at type A1;

d) Grade the professional position Project Manager for Road Construction Level IV, code V.12.23.04 for civil servants currently graded at type A0.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from March 1, 2023.

2. In cases where the regulatory legal documents cited in this Circular are amended, supplemented, or replaced, implementation shall be in accordance with the provisions of the amended, supplemented, or replacing document.

Article 11. Implementation Organization

The Head of the Ministry’s Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Heads of agencies, units, organizations, and individuals concerned are responsible for enforcing this Circular./.
