Decree No. 46-CP on living expenses for cadres of the Party and state authorities and operating funds for people's mass organizations at communes, wards, and towns

DECREE

Regarding the living expenses system for Party cadres and government officials and

operating funds for people's mass organizations at communes, wards, and towns.

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Considering the proposal of the Minister, Head of the Government Organizational and Cadre Management Board, and the Minister of Finance;

DECREE:

Article 1.- Now it is stipulated that the number of Party and administrative cadres working at communes, wards, and towns (hereinafter referred to as commune) entitled to living expenses shall be as follows:

1. Commune with less than 5,000 residents: 8 cadres.

2. Commune with 5,000 to less than 10,000 residents: 9 cadres.

3. Commune with 10,000 residents or more: 11 cadres.

Based on the general number specified above, the Minister, Head of the Government Organizational and Cadre Management Board shall provide specific guidance to ensure that mountainous communes have more cadres than those in lowland areas, and that the number of commune cadres exceeds that of ward and town cadres.

Article 2.- The monthly living expense for the cadres mentioned in Article 1 above shall be as follows:

1. Secretary of the Commune Party Committee (or Secretary of the Commune Party Branch for places without a Commune Party Committee), Chairman of the Commune People's Committee: VND 160,000/month.

2. Deputy Secretary of the Commune Party Committee (or Standing Deputy of the Commune Party Committee), Deputy Chairman of the Commune People's Committee, Secretary of the Commune People's Council, Chief of the Commune Militia: VND 140,000/month.

3. Other positions: VND 120,000/month.

Article 3.- Commune cadres who have retired and are receiving benefits under Decisions No. 130-CP dated June 20, 1975 of the Council of Ministers and No. 111-HĐBT dated October 13, 1981 of the Council of Ministers shall now receive allowances as follows:

1. Secretary of the Commune Party Committee, Chairman of the Commune People's Committee: VND 40,000/month.

2. Other positions: VND 30,000/month.

Article 4. - From now on, commune cadres who have continuously worked in the commune for ten years or more and have not violated discipline will receive a one-time allowance upon retirement. This allowance is calculated based on the number of years of service, with each year of service entitling them to one month's living expense before retirement. The Chairman of the District, City Ward, or Town People's Committee shall issue specific decisions for these cadres receiving allowances.

Article 5.- State civil servants who have already received retirement benefits, disability benefits, or one-time allowances, if they work in the commune, shall also receive the monthly living expense as stipulated in Article 2, but when they stop working in the commune, they will not be entitled to the allowances mentioned in Articles 3 and 4 above.

Article 6- Operating funds and living expenses for cadres of people's mass organizations at the commune level, including the Fatherland Front, Women's Union, Ho Chi Minh Communist Youth Union, Farmers' Association, and Veterans' Association, shall be as follows:

1. For communes with fewer than 10,000 residents, each organization: VND 1,500,000/year (one million five hundred thousand dong/year).

2. For communes with more than 10,000 residents, each organization: VND 2,000,000/year (two million dong/year).

Based on the provisions set forth in this Article, each people's mass organization at the commune level shall determine the monthly living expense for its cadres.

Article 7.- The sources of funds to cover the expenses stipulated in Articles 2, 3, 4, and 6 of this Decree shall be balanced within the commune budget. Communes facing financial difficulties and unable to cover the aforementioned expenses shall receive subsidies from the provincial budget to make up the difference.

Article 8.- This Decree takes effect from June 1, 1993. Decisions No. 130-CP dated June 20, 1975 of the Council of Ministers regarding supplementary policies and preferential treatment for commune cadres, No. 111-HĐBT dated October 13, 1981 of the Council of Ministers regarding amendments and supplements to certain policies and preferential treatments for commune, ward, and town cadres, Decision No. 57-TTg dated February 15, 1993 of the Prime Minister regarding allowances for mountainous commune cadres and cadres in difficult communes, and other previous regulations contrary to this Decree are hereby abolished.

Article 9.- The Government Organizational and Cadre Management Board and the Ministry of Finance shall provide detailed guidance on the implementation of this Decree.

Article 10.- The Minister, Head of the Government Organizational and Cadre Management Board, the Minister of Finance, the Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and the Chairmen of Provincial People's Committees directly under the Central Government shall be responsible for implementing this Decree./.
