DECREE
Amending and supplementing certain articles of Decree No. 82/2011/NĐ-CP
dated September 16, 2011 of the Government on the enforcement of capital punishment
by lethal injection

Pursuant to the Law on the Organization of the Government dated December 25, 2001;
Pursuant to the Criminal Enforcement Law dated June 17, 2010;
At the proposal of the Minister of Public Security;
The Government promulgates this Decree amending and supplementing certain articles of Decree No. 82/2011/NĐ-CP dated September 16, 2011 of the Government on the enforcement of capital punishment by lethal injection,
Article 1. Amending and supplementing certain articles of Decree No. 82/2011/NĐ-CP dated September 16, 2011 of the Government on the enforcement of capital punishment by lethal injection:
1. Article 6 shall be amended and supplemented as follows:
"Article 6. Drugs for the enforcement of capital punishment. 1. Drugs for injection in the enforcement of capital punishment include:
a) Drugs causing loss of consciousness;
b) Drugs causing paralysis of the motor system;
c) Drugs causing cessation of heart function.
2. A dose consists of three types of drugs specified in Clause 1 of this Article and is used for one person.
3. The handover of drugs must be recorded in a handover receipt; sealed and strictly managed in accordance with the provisions of the law."
2. Point c Clause 4 Article 8 shall be amended and supplemented as follows:
"c) Insert the needle already connected to the drug infusion tube into the vein that has been identified according to the following sequence: - Step 1: Inject the drug causing loss of consciousness.
After the injection is complete, the specialized staff implementing the enforcement of capital punishment must conduct a check; if the person being executed has not lost consciousness, they must continue to inject the drug until they lose consciousness.
- Step 2: Inject the drug causing paralysis of the motor system.
- Step 3: Inject the drug causing cessation of heart function."
3. Clause 1 Article 19 shall be amended and supplemented as follows
"1. Ensuring the supply of drugs for the enforcement of capital punishment according to the annual drug supply plan of the Ministry of Public Security and the Ministry of Defense; guiding the storage and use of drugs for the enforcement of capital punishment; taking the lead and coordinating with the Ministry of Public Security and the Ministry of Defense to issue a list and dosage of drugs for the enforcement of capital punishment."
Article 2. Implementation Provisions
1. This Decree takes effect from June 27, 2013.
2. The Minister of Public Security, the Minister of Defense, and the Minister of Health within their respective functions, tasks, and authorities shall be responsible for organizing the implementation and guiding and supervising the enforcement of this Decree.
3. The Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of provincial and municipal People's Committees directly under the central government shall be responsible for enforcing this Decree./.
