PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
MEASURES FOR ENSURING FIRE SAFETY FOR BUSINESS PREMISES OPERATING NIGHTCLUBS AND KARAOKE
Article 2. Applicability
This Circular applies to:

1. Design for fire prevention and fighting for business premises operating nightclubs and karaoke listed in the category of premises with fire and explosion hazards as specified in Appendix II attached to Decree No. 79/2014-NĐ-CP shall be carried out in accordance with technical standards and regulations on fire prevention and fighting, specifically as follows:
a) The fire resistance rating of the building must be appropriate to the scale and nature of the building's operation. Traffic routes and safe distances for fire prevention and fighting between business premises operating nightclubs and karaoke and other buildings shall comply with the provisions of QCVN 06: /BXD - National Technical Standards on Fire Safety for Buildings and Structures (hereinafter referred to as QCVN 06: /BXD). In cases where business premises operating nightclubs and karaoke are adjacent to other buildings, the exterior wall adjacent to such buildings must be a fire-resistant partition wall with a fire resistance limit of not less than 150 minutes.
b) The construction structure of the building must have a fire resistance limit suitable to the nature of use and height of the building according to QCVN 06: /BXD.
c) Regarding fire prevention and fire spread control measures
- The maximum allowable floor area of a single storey within a fire compartment of business premises operating nightclubs and karaoke shall be determined as per the group of public buildings as specified in QCVN 06: /BXD;
Chapter II
- The permissible height of the building depends on the fire resistance rating of the building according to QCVN 06: /BXD, but shall not exceed 50 meters;
- Walls, partitions, and suspended ceilings of escape routes, exit routes, fire escape rooms, and rooms with concentrated crowds shall be constructed from non-combustible or difficult-to-burn materials such as interior decoration materials and soundproofing materials;
- The arrangement of functional areas and the installation of technical systems, equipment, and materials in the building must ensure the ability to prevent the spread of fire hazards when a fire occurs in a room, between rooms, between different groups of rooms with varying fire risks based on their functions, between floors, fire compartments, and between buildings;
- Fire-resistant parts of the building such as fire-resistant walls, fire-resistant partitions, fire-resistant floors, fire compartments, fire doors, and fire openings must be made of non-combustible materials and have fire resistance limits as specified in QCVN 06: /BXD.
d) The sound system, electrical system, lightning protection, static electricity protection, and the placement of these systems in the building must meet the requirements for fire safety and firefighting.
đ) Escape routes in the building must comply with the provisions of QCVN 06: /BXD; in which, business premises operating nightclubs and karaoke belong to Group F2.1.
e) When designing and installing advertising signs for the building, technical, structural, material, and lighting requirements as specified in QCVN 17: /BXD - Standards for Construction and Installation of Outdoor Advertising Facilities must be met. The location of advertising signs must not completely cover the building or obstruct escape routes and balconies.
g) Emergency lighting and evacuation route guidance systems must comply with the provisions of TCVN 3890: Firefighting Equipment for Buildings and Structures - Provision, Arrangement, Inspection, and Maintenance (hereinafter referred to as TCVN 3890:).
h) Smoke exhaust, pressure regulation, and ventilation systems must comply with the provisions of QCVN 06: /BXD and TCVN 5687: Ventilation and Air Conditioning - Design Standards.
i) Firefighting equipment must meet the quantity and quality standards as specified in technical standards and regulations on fire prevention and fighting, as detailed in Article 8 of this Circular.
k) Implement the provisions of technical standards and regulations on fire prevention and fighting that are relevant and appropriate to the scale and nature of each business premise operating nightclubs and karaoke.
- Fire-resistant parts of the construction such as fire-resistant walls, fire-resistant partitions, fire-resistant floors, fire-resistant zones, fire-resistant compartments, door openings, and fire-resistant doors shall be made of non-combustible materials and have fire resistance limits as prescribed in QCVN 06: /BXD.
d) The sound system, electrical system, lightning protection, static electricity prevention, and the arrangement of these facilities in the construction shall comply with fire safety requirements.
đ) Evacuation routes of the construction shall comply with the provisions set out in QCVN 06: /BXD; particularly for discotheques and karaoke establishments classified under group F2.1 buildings.
e) When designing and installing advertising signs on the construction, technical requirements, structural requirements, material requirements, and lighting requirements as stipulated in QCVN 17: /BXD - Technical standards for the construction and installation of outdoor advertising facilities shall be ensured. The location of advertising signs shall not completely cover the building or construction, nor obstruct evacuation routes or balconies.
g) Emergency lighting and evacuation route guidance systems shall comply with the provisions set out in TCVN 3890: Firefighting and rescue equipment for buildings and constructions - Equipment, layout, inspection, maintenance (hereinafter referred to as TCVN 3890:).
h) Smoke exhaust systems, pressure control systems, ventilation systems shall comply with the provisions set out in QCVN 06: /BXD and TCVN 5687: Ventilation and air conditioning - Design standards.
i) Firefighting and rescue equipment shall ensure quantity and quality according to fire safety technical standards and regulations as specified in Article 8 of this Circular.
k) Implement fire safety technical standards and regulations relevant and appropriate to the scale and nature of operation of each discotheque and karaoke establishment.
2. Fire prevention and firefighting design for discotheque and karaoke business establishments located in high-rise buildings shall be carried out in accordance with fire prevention and firefighting technical standards and regulations suitable to the functions of such buildings and ensuring fire safety in compliance with Clause 1 of Article 23 of the Law Amending and Supplementing Certain Provisions of the Law on Fire Prevention and Fighting and Clause 1 of Article 11 of Decree No. 79/2014/ND-CP.
3. Fire prevention and firefighting design for discotheque and karaoke business establishments not included in the list of establishments with fire and explosion hazards shall be implemented in accordance with Clause 6 of Article 15 of Decree No. 79/2014/ND-CP.
Article 5. Review of fire prevention and firefighting design and inspection of fire prevention and firefighting acceptance
Discotheque and karaoke business establishments subject to review of fire prevention and firefighting design and inspection of fire prevention and firefighting acceptance shall be implemented in accordance with Articles 15 and 17 of Decree No. 79/2014/ND-CP.
Article 6. Measures for fire prevention
The owners of discotheque and karaoke business establishments shall implement fire prevention measures for their establishments under their management throughout the operation period, specifically:
1. Strictly manage and safely use flammable and explosive materials, sources of fire, heat sources, ignition devices, heating devices, igniting materials, and heating materials.
2. Ensure fire safety in accordance with the guidance provided in Article 7 of this Circular.
3. Regularly and periodically inspect to identify any gaps or deficiencies in fire prevention and promptly take corrective measures.
Article 7. Ensuring fire safety
1. The owners of discotheque and karaoke business establishments shall ensure fire safety appropriate to the scale and nature of their operations under their management in accordance with Clause 1 of Article 7 of Decree No. 79/2014/ND-CP.
2. The fire safety measures guided in Clause 1 of this Article shall be organized and maintained throughout the operation period.
Article 8. Provision of fire prevention and firefighting equipment
The owners of discotheque and karaoke business establishments shall provide fire prevention and firefighting equipment for their establishments under their management, specifically as follows:
1. Provision of firefighting equipment
Discotheque and karaoke business establishments shall provide portable dry powder extinguishers with a weight of dry powder extinguishing agent equal to or greater than 4 kg, or portable carbon dioxide extinguishers with a weight of extinguishing agent equal to or greater than 5 kg, ensuring one extinguisher per 50 m2 and the protection radius of one extinguisher is less than or equal to 15 m.2 2. Provision of automatic fire alarm systems, automatic fire suppression systems, and indoor fire hose systems for discotheque and karaoke business establishments, specifically:
a) Provide automatic fire alarm systems for establishments with a usable area of 200 m
or a volume of 1000 m2 b) Provide automatic fire suppression systems for:3 or more.
- Steel-framed roofed establishments with a usable area of 1200 m
- Establishments with one or two floors having a usable area of 3500 m2 /second or more;
- Establishments with three or more floors.2 /second or more;
c) Provide indoor fire hose systems for establishments with a volume of 5,000 m
or more or establishments required to install automatic fire suppression systems.3 3. Fire prevention and firefighting equipment specified in Clause 1 of this Article shall be placed near entrances and exits, on landing areas of staircases, in lobbies, corridors, or other easily visible and accessible locations. Specifically, fire alarm bell systems or fire alarm broadcasting systems shall be installed in each room of discotheque and karaoke business establishments. Fire prevention and firefighting equipment shall be inspected for quality according to periodic schedules for each type.
4. Standards and quality of fire prevention and firefighting equipment shall be implemented in accordance with current fire prevention and firefighting technical standards and regulations (TCVN 7062: (ISO 7165), Firefighting - Portable extinguishers - Characteristics and construction; TCVN 7027: (ISO 11601), Firefighting - Wheeled extinguishers - Characteristics and construction; TCVN 5738: Automatic fire alarm system - Technical requirements; TCVN 7336: Fire prevention and firefighting - Automatic sprinkler system - Design and installation requirements; TCVN 3890: ).
4. The standards and quality of firefighting and rescue equipment shall be implemented in accordance with current fire safety technical standards and regulations (TCVN 7062: (ISO 7165), firefighting - Portable fire extinguishers - Characteristics and structure; TCVN 7027: (ISO 11601), firefighting - Wheeled fire extinguishers - Characteristics and structure; TCVN 5738: Automatic fire alarm system - Technical requirements; TCVN 7336: Fire prevention and firefighting - Automatic sprinkler system - Design and installation requirements; TCVN 3890: ).
Article 9. Fire Prevention and Fighting Safety Inspection
1. The owner of business premises for nightclubs and karaoke shall organize fire prevention and fighting safety inspection for their managed premises based on actual conditions and circumstances, in accordance with the content stipulated in Clause 1 of Article 18 of Decree No. 79/2014/NĐ-CP.
2. The owner of business premises for nightclubs and karaoke shall comply with fire prevention and fighting safety inspections conducted by competent authorities; specifically:
a) Present files and documents required for fire prevention and fighting safety inspection as requested by competent authorities.
b) Participate in fire prevention and fighting safety inspection teams at their managed premises when required.
c) Implement guidance documents and fire prevention and fighting safety inspections issued by competent authorities.
d) Fulfill other tasks as prescribed by laws on fire prevention and fighting.
Article 10. Organization of Activities of Fire Prevention and Fighting Forces at Business Premises for Nightclubs and Karaoke
The organization of activities of fire prevention and fighting forces at business premises for nightclubs and karaoke shall be carried out in accordance with the provisions of Clause 2 of Article 32 of Decree No. 79/2014/NĐ-CP.
Article 11. Ensuring Firefighting and Rescue Operations When a Fire Occurs
1. Upon discovering a fire, individuals must immediately report it to surrounding people and one or all units specified in Clause 1 of Article 22 of Decree No. 79/2014/NĐ-CP.
2. The owner of the premises or the person responsible for managing the business premises for nightclubs and karaoke shall mobilize the fastest available resources within their management scope to extinguish the fire and implement the following regulations:
a) Concentrate on rescuing people, salvaging property, and preventing the spread of fire.
b) Organize the protection of assets and goods in the fire area.
c) Comply with orders from firefighting commanders (if present).
d) Participate in protecting the fire scene and provide relevant information about the fire to state agencies with authority.
Article 12. Ensuring Fire Prevention and Fighting Safety at Places Organizing Cultural Activities and Public Cultural Services Including Nightclub and Karaoke Businesses
Places organizing cultural activities and public cultural services as specified in Point b, Clause 1 of Article 2 of Decree No. 103/2009/NĐ-CP, which have nightclub and karaoke businesses operating, shall ensure fire prevention and fighting safety according to the guidelines set forth in this Circular.
Chapter III
RESPONSIBILITIES FOR SAFETY FIRE PREVENTION AND FIGHTING
Article 13. Responsibilities of the Owner of Business Premises for Nightclubs and Karaoke
1. Ensure fire prevention and fighting safety for premises under their management in accordance with the guidelines set forth in this Circular, technical standards and norms on fire prevention and fighting, and other relevant legal provisions.
2. Participate in training and professional development on fire prevention and fighting.
3. Conduct propaganda and dissemination of knowledge on fire prevention and fighting for workers at the premises; organize training for workers at the premises to know how to use firefighting equipment and facilities that have been provided.
4. Equip and maintain the operation of firefighting equipment and facilities; prepare conditions to serve firefighting operations.
5. Develop and conduct drills of the premises' firefighting plan as prescribed.
6. Comply with guidance and fire prevention and fighting safety inspections conducted by competent authorities.
7. Report on fire prevention and fighting work as prescribed.
8. Fulfill other tasks as prescribed by laws on fire prevention and fighting.
Article 14. Responsibilities of Public Security Units and Localities
1. Organize propaganda and dissemination of legal regulations on fire prevention and fighting, measures to ensure fire safety for discotheques and karaoke establishments.
2. Guide, inspect, and handle violations related to ensuring fire safety for discotheques and karaoke establishments in accordance with the provisions of the law.
3. Develop plans to coordinate with relevant units in the work of inspecting fire safety for discotheques and karaoke establishments.
4. Statistic and report to the People's Committee at the same level and the superior public security agency about the management of fire prevention and fighting for discotheques and karaoke establishments under their jurisdiction.
5. Perform other tasks in accordance with the law on fire prevention and fighting.
Chapter IV
IMPLEMENTATION
Article 15. Effective Date
1. This Circular takes effect from December 4, 2015.
2. Within 24 months from the date this Circular takes effect, operating discotheques and karaoke establishments shall implement fire safety in accordance with the guidance provided in this Circular.
Article 16. Responsibility for Implementation
1. The Director of the Fire Prevention, Firefighting, and Rescue Police Department is responsible for guiding, inspecting, and urging the implementation of this Circular;
2. The heads of the General Departments, heads of units directly subordinate to the Ministry of Public Security, provincial-level Public Security Directors, Fire Prevention and Fighting Police, and organizations and individuals concerned are responsible for implementing this Circular.
3. Request the heads of Ministries, agencies equivalent to Ministries, agencies under the Government, Provincial People's Committees within their functions, duties, and authorities to cooperate with the Ministry of Public Security in managing and inspecting the implementation of guidelines on ensuring fire safety for discotheques and karaoke establishments under their jurisdiction.
During the implementation of this Circular, if there are difficulties or obstacles, Public Security Units and Localities, and related organizations and individuals shall report to the Ministry of Public Security (through the Fire Prevention and Fighting Police Department) for timely guidance.
