The Minister of Industry and Trade issues the National Technical Regulations on design requirements for floating petroleum filling stations.

Article 1. Accompanying this Circular is the "National Technical Regulations on design requirements for floating petroleum filling stations."

This Circular takes effect from July 1, 2016.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

a) This regulation sets out basic technical requirements for designing, constructing new, building new, upgrading, and expanding floating petroleum filling stations.

b) The design, construction, upgrading, and expansion of fixed petroleum filling stations on shore that operate to sell petroleum products to both waterway and road transport vehicles shall comply with the provisions of QCVN 01 : 2013/BCT - National Technical Regulations on design requirements for petroleum filling stations.

Article 2. Applicability

This Regulation applies to:

1. Organizations and individuals engaged in designing, constructing new, building new, upgrading, and expanding floating petroleum filling stations.

2. Business operators engaged in petroleum product trading.

3. Other organizations and individuals related thereto.

Article 3. Explanation of Terms

1. Floating petroleum filling station

A floating petroleum filling station includes fixed petroleum filling stations, steel-hulled vessels, barges that have been converted, or other floating means that engage in retail sales of petroleum products through pumps to waterway transport vehicles.

2. Process piping

a) It refers to piping (including pipes and connections) and equipment installed on the piping used to convey petroleum products and petroleum vapor.

b) Process piping consists of: inlet piping (used to convey petroleum products from petroleum product transport vessels into storage tanks), sealed inlet coupling (a device permanently attached at the end of the inlet piping used to seal with the petroleum product transport vessel's piping leading into the storage tank), outlet piping (used to convey petroleum products from storage tanks to pumps), and vapor conveying piping (used to convey petroleum vapor from storage tanks to vent valves or from storage tanks to petroleum product transport vessels).

3. Vent valve

It is a device to control excess pressure and vacuum pressure in petroleum storage tanks with the aim of ensuring safety for the storage tanks and preventing loss of petroleum due to evaporation during operation.

4. Sealed loading

It is a method of loading petroleum products from petroleum product transport vessels into storage tanks through a sealed inlet coupling in a closed loop process.

5. Wastewater from petroleum filling stations

It refers to wastewater generated during the operation of petroleum filling stations including: petroleum-contaminated wastewater and non-petroleum-contaminated domestic wastewater.

6. Vapor recovery system

It is a system of equipment designed to recover and limit the escape of petroleum vapor into the atmosphere when loading petroleum products into storage tanks.

Chapter II

TECHNICAL REGULATIONS

Article 5. Classification of Floating Gasoline Retail Stations

Floating gasoline retail stations are classified according to their total capacity as specified in Table 1.

Article 6. General Requirements

1. The location and anchorage of floating gasoline retail stations must comply with regulations and be consistent with the planning of the competent authority and adhere to the routes recorded on the operating permit, ensuring traffic safety, fire prevention and fighting requirements, and environmental hygiene.

2. Floating gasoline retail stations must have fire prevention and fighting plans, flood and typhoon prevention plans, oil spill prevention plans, and environmental protection commitments approved by the competent authority.

a) The fire prevention and fighting plan of the gasoline retail station must include measures to handle spilled gasoline and methods to extinguish fires or control fires on water.

b) The flood and typhoon prevention plan must determine anchorage positions to avoid typhoons as prescribed. For fixed gasoline retail stations, there must be measures to secure, anchor, and evacuate to avoid typhoons as prescribed.

c) The oil spill prevention plan shall be implemented in accordance with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister on the issuance of the Oil Spill Response Regulations and Decision No. 63/2014/QĐ-TTg dated November 11, 2014 of the Prime Minister on amending and supplementing certain provisions of the Oil Spill Response Regulations issued together with Decision No. 02/2013/QĐ-TTg dated January 14, 2013 of the Prime Minister.

3. The minimum distance from floating gasoline retail stations to surrounding structures is as follows:

a) For fixed gasoline retail stations, the minimum distance is detailed in Table 2.

Note:

1) Fire resistance rating of structures according to QCVN 06:2010/BXD.

2) Distance from tanks measured from the edge of the tank.

4) Distance from public buildings measured to the boundary of the building. Public buildings include: schools, hospitals, national exhibitions, and shopping centers.

5) Distance from civilian buildings measured to the base of the building.

- The safe distances in Table 2 may be reduced by 30% if the station has a vapor recovery system.

- The safe distance from storage tanks and pumps to public buildings can be reduced to 25 m (17 m if equipped with a vapor recovery system) if the gasoline retail station is equipped with a fixed or semi-fixed firefighting system.

b) For barges, steel hull ships, and other floating vessels, the minimum safe distance is detailed in Table 3.

Note: If civilian buildings and other structures in the table have fire resistance ratings of I, II, III, and the wall facing the gasoline retail station is a fire-resistant wall, then no distance requirement is set.

Article 7. Fuel Storage Tanks

1. Materials for fuel storage tanks must be resistant to fuel and non-flammable.

2. For fuel storage tanks made from non-conductive materials, measures must be taken to eliminate static electricity when fuel is loaded or unloaded.

3. The area around fuel storage tanks must be regularly cleaned and warning signs stating "No unauthorized entry" must be posted.

Article 8. Fuel Dispensing Pumps

The installation location of fuel dispensing pumps in fuel retail outlets must meet the following requirements:

1. Fuel dispensing pumps must be placed in well-ventilated and convenient locations.

2. Ensure that vehicles can park easily alongside the fuel dispensing pumps without obstructing other traffic entering and exiting the outlet.

Article 9. Process Pipelines

1. Process pipelines within fuel retail outlets must be made from materials resistant to fuel and non-flammable. The internal diameter of the pipes must be at least 32 mm. For steel pipelines, anti-corrosion measures must be implemented. For pipelines made from non-conductive materials, measures must be taken to eliminate static electricity during loading and unloading of fuel.

2. Connections on process pipelines must ensure tightness and mechanical and chemical durability.

3. Process pipelines within the outlet must be placed in areas not affected by people or passing vehicles.

4. When process pipelines run parallel to each other, they must be spaced apart by at least one pipe diameter. For pipelines connected with flanges running parallel, the distance between them must be at least the flange diameter plus 3 cm.

5. The distance from the suction end of the fuel delivery pipeline to the bottom of the fuel storage tank must be at least 15 cm.

6. For pumping technology, if a single fuel storage tank supplies fuel to multiple dispensing pumps, each pump must have its own separate delivery pipeline, and the pipeline inside the tank must have a check valve.

7. Fuel must be loaded into storage tanks using closed loading methods. The fuel loading pipeline for each tank must extend to the bottom of the tank and be no more than 20 cm from the bottom.

8. All fuel storage tanks must be equipped with vent valves. It is permissible to install a shared vent valve for storage tanks containing the same type of fuel.

9. Vent valves must meet the following technical requirements:

a) Technical specifications must match the structure, capacity, and operating conditions of the storage tank. The discharge opening of the vent valve must face horizontally or upwards;

b) The internal diameter of the connecting pipe from the tank to the vent valve must not be less than 50 mm;

c) The discharge opening of the vent valve must be at least 1 meter higher than the roof or canopy of the outlet;

d) The vent valve of the fuel retail outlet must have its own direct lightning protection system or must be within the protected area of the common direct lightning protection system of the outlet.

Article 10. Electrical Systems

1. Safety requirements for the design, installation, and use of electrical equipment in fuel retail outlets must comply with TCVN 5334 : 2007.

2. If a generator is used within the fuel retail outlet area, it must be located outside the hazardous fire and explosion zone. The exhaust pipe of the generator must have a flame arrestor and be insulated.

3. Wires and cables installed in fuel retail outlets must meet the following requirements:

a) Wires and cables must be copper-core, with synthetic insulation, and run through conduit;

b) In a single conduit for wires and cables, power cables and lighting cables must not be run together with control cables, information cables, and signal cables;

c) Conduits for cables must be connected using threads. When connecting or branching wires and cables, explosion-proof junction boxes and branch boxes must be used.

4. For cables used in automation equipment and signaling systems, the provisions of Clause 3 of this Article must be followed.

5. Lightning protection systems must be installed for all construction elements in the outlet.

The height of the lightning rod must ensure that the vent valve is completely within the protected area of the lightning rod. If vent valves are installed at a high position but are not within the lightning protection range of surrounding tall structures, direct lightning protection must be provided for the vent valves using equal potential grounding rods. The lightning protection system must be inspected annually according to current regulations.

Article 11. Firefighting Equipment

1. At gasoline and oil stores, fire safety regulations must be posted in visible locations, with signs prohibiting fire, smoking, mobile phone use, and fire alarm signals.

2. Gasoline and oil stores must be equipped with sufficient firefighting equipment as prescribed in this Standard.

3. The type of firefighting equipment to be arranged shall be based on the flammability characteristics of substances and materials within each section of the store.

4. Initial firefighting equipment must be provided and arranged at the following locations in the store:

a) Fuel pump columns;

b) Locations for fuel intake into tanks;

c) Generator sets.

5. The quantity of initial firefighting equipment and tools is specified in Tables 4 and 5 as follows.

a) For fixed gasoline and oil stores, the quantity of initial firefighting equipment and tools is detailed in Table 4.

- Depending on specific conditions of the store, dry powder extinguishers can be replaced with foam extinguishers or CO2 extinguishers having equivalent firefighting capabilities;

- The number of extinguishers in parentheses ( ) represents the reserve extinguishers. Reserve extinguishers should be arranged in a separate cluster inside the store;2 - Suitable water containment facilities must be arranged at the store to wet the firefighting blankets when in use.

b) For barges, steel-hulled vessels, and other floating vessels, the quantity of initial firefighting equipment and tools is detailed in Table 5.

Depending on specific conditions of the store, dry powder extinguishers can be replaced with foam extinguishers or CO2 extinguishers having equivalent firefighting capabilities. Additionally, floating vessels should be equipped with spreading fire-fighting buoys or a fixed firefighting system using powder or foam to ensure sufficient quantities for self-extinguishing in case of emergencies.

7. Arrangement of firefighting equipment and tools must ensure:

a) Visibility;2 b) Ease of access for use;

c) Non-obstruction of escape routes, walkways, and other activities;

d) Protection from rain, sun, and environmental destruction.

8. Only firefighting equipment and tools that meet quality standards and are within their service life may be arranged.

9. Within the store premises, firefighting equipment and tools may be scattered according to individual positions or grouped depending on the level of fire and explosion risk and the area requiring protection. If grouped, at least two clusters must be arranged.

Article 12. Water Supply and Drainage System and Environmental Sanitation

1. Oil-contaminated wastewater from the store must be collected through a dedicated drainage system with secure covers, vent holes, or steel mesh screens to prevent accumulation of gasoline vapor.

2. Oil-contaminated wastewater from the store must be treated to comply with the provisions of QCVN 29 : 2010/BTNMT before being discharged into the external environment.

3. When pumping or transferring fuel, absorbent cloths must be used to catch excess fuel from the pump nozzle, and fuel must not fall onto the surface water. Absorbent cloths contaminated with fuel must be placed in sealed containers and disposed of according to Circular No. 36/2015/TT-BTNMT dated June 30, 2015, issued by the Ministry of Natural Resources and Environment regarding hazardous waste management.

1. The oil-contaminated wastewater from the fuel service station must be collected through a separate drainage system with securely covered channels, equipped with vent holes or steel mesh screens to prevent the accumulation of gasoline vapors.

2. The oil-contaminated wastewater from the fuel service station must be treated in accordance with the provisions of QCVN 29 : 2010/BTNMT before being discharged into the external environment.

3. When pumping fuel, there must be cloth towels to catch excess gasoline from the pump nozzle; gasoline must not be allowed to fall onto the water surface. Oil-soaked cloths must be placed in sealed containers and disposed of according to Circular No. 36/2015/TT-BTNMT dated June 30, 2015, issued by the Ministry of Natural Resources and Environment regarding the management of hazardous waste.

Article 13. Gasoline Vapor Recovery System

1. The vapor recovery system must ensure that all gasoline vapors generated during the loading process are returned to the storage tank.

2. Equipment used in the vapor recovery system must be made of materials resistant to gasoline and non-flammable.

3. General requirements for the vapor recovery system:

a) The venting valve systems of storage tanks must comply with the provisions set out in Clause 9, Article 9 of this Standard.

b) The vapor recovery nozzle at the service station must be installed independently corresponding to the venting valve system of the storage tank.

c) Quick couplings must meet quality and sealing requirements: rubber seals must be oil-resistant types, and the male and female ends of quick couplings at the service station and on motor vehicles must be compatible.

d) After installation, the system must undergo a leak test and quality check of all components including vent valves, shut-off valves, and quick couplings.

Chapter III

MANAGEMENT PROVISIONS

Article 14. Provisions on Declaration of Conformity and Inspection

1. Organizations and individuals operating new, rebuilt, upgraded, or expanded waterborne fuel service stations must implement the declaration of conformity according to the provisions of Chapter III of Circular No. 28/2012/TT-BKHCN dated December 12, 2012, issued by the Ministry of Science and Technology regarding the declaration of conformity to standards and technical regulations.

2. Inspections of waterborne fuel service stations shall be carried out in accordance with the provisions of this Standard and the laws governing the business of gasoline.

Article 15. Responsibilities of Fuel Dealers

1. Fuel dealers operating waterborne fuel service stations are responsible for implementing the declaration of conformity and declaration of conformity as prescribed.

2. When discovering non-compliance with technical standards during the operation of fuel services, they must:

a) Timely notify the management agency receiving the declaration of conformity about the non-compliance.

b) Take corrective measures for the non-compliance. If necessary, temporarily suspend product sales.

3. Maintain records of declarations of conformity as a basis for inspection and supervision by state management agencies.

4. Re-declare when there are any changes to the content of the previously registered declaration of conformity or any changes in the features, functions, characteristics of newly constructed, rebuilt, upgraded, or expanded waterborne fuel service stations that have been declared conforming.

Chapter IV

IMPLEMENTATION

Article 16. Organizationitselfc hiFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.

1. The Department of Science and Technology, Ministry of Industry and Trade shall take the lead and coordinate with relevant agencies and units to guide and inspect the implementation of this Standard. Based on management requirements, the Department of Science and Technology, Ministry of Industry and Trade has the responsibility to propose amendments and supplements to this Standard to the Minister of Industry and Trade to align it with practical needs.

2. Provincial Departments of Industry and Trade under central cities are responsible for guiding and inspecting the implementation of this Standard in their localities, reporting to the Ministry of Industry and Trade on the implementation situation, difficulties, and issues periodically before January 31 of the following year or at any time.

3. In cases where regulatory legal documents, materials, or standards cited in this Standard are amended, supplemented, or replaced, they shall be implemented according to the new provisions.
