BASED ON THE DECREE NO. 199/2013/NĐ-CP OF NOVEMBER 26, 2013 OF THE GOVERNMENT PROVIDING FOR THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT;

Pursuant to the Law on Competition and Rewards dated November 26, 2003, the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated June 14, 2005, and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards dated November 16, 2013;

Pursuant to Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP of the Government, and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards in 2013;

The phrase "or examination" is abolished pursuant to Clause 6, Article 8 of Circular No. 15/2025/TT-BVHTTDL dated November 25, 2025, of the Minister of Culture, Sports and Tourism amending and supplementing certain articles of Circulars prescribing job codes, qualification standards, and salary grades for civil servants in the heritage culture, library, grassroots cultural activities, sports, fine arts, art performance, film, and cultural propaganda sectors, which takes effect from January 15, 2026.

Clause 2. Agencies and units under the Ministry are administrative state agencies and public service units directly managed by agencies and units under the Ministry.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. These Circulars guide competition and reward work in the Agriculture and Rural Development sector (hereinafter referred to as the Agriculture sector).

2. These Circulars do not apply to the awarding of the Commendation Medal "For the Cause of Agriculture and Rural Development", the Golden Rice Ear Award of Vietnam, and the Title "Enterprise for Farmers".

Article 2. Applicability

These Circulars apply to collectives, individuals, agencies, units, enterprises under the Ministry of Agriculture and Rural Development, Associations, and Trade Unions operating in the Agriculture and Rural Development sector; organizations and individuals inside and outside the country with outstanding achievements contributing to the development of agriculture and rural areas in Vietnam.

A collective eligible for the awarding of commendation titles and rewards is an organization established by the competent authority in accordance with the law.

Article 3. Principles of Competition and Reward

The principles of competition and reward are implemented in accordance with the provisions of Article 1 of Circular No. 07/2014/TT-BNV dated August 29, 2014 of the Ministry of Home Affairs guiding the implementation of certain provisions of Decree No. 42/2010/ND-CP detailing the implementation of certain provisions of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards, Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/ND-CP of the Government, and Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competition and Rewards in 2013 (hereinafter referred to as Circular No. 07/2014/TT-BNV) and the following provisions:

1. The level that initiates the competition campaign shall be responsible for rewarding or submitting to a higher level for consideration of rewarding. The main form of rewarding is self-rewarding at the same level, in cases of particularly outstanding achievements with significant impact, it is proposed to the Minister to present a Commendation Certificate or to the Prime Minister to present a Commendation Certificate for competition campaigns lasting three years or more, and to propose the President to award the Labor Medal, Third Class, for competition campaigns lasting five years or more.

2. In one year, no two forms of rewards from the Ministry level or above shall be submitted for the same recipient, except in cases of rewarding outstanding achievements or according to campaigns or special topics.

Chapter II

INNOVATIONS

Article 4. Innovations

1. An innovation is a new technical solution, management solution, or operational solution (collectively referred to as solutions) created or improved from previous solutions, applied or tested to increase labor productivity, work efficiency, and bring about tangible benefits, specifically:

a) Technical solution: a new method or technological means applied to solve a task.

b) Management solution: a way of organizing and managing work by the management subject over the managed object to achieve specific goals in work.

c) Operational solution: advice or proposals on methods to implement tasks helping the management subject resolve work issues effectively.

2. National-level innovations are innovations with nationwide influence (across the entire sector).

3. Ministry-level innovations are innovations with influence within the Ministry.

4. Grassroots-level innovations are innovations with influence at the grassroots level.

Article 5. Scientific and technological topics and projects equivalent to inventions

1. Basic-level scientific and technological topics and projects that have been accepted and evaluated at least as good and effectively implemented in practice may be proposed for recognition as basic-level inventions.

2. Ministry-level and national scientific and technological topics and projects that have been accepted and evaluated at least as good and effectively applied throughout the industry or nationwide may be proposed for recognition as ministry-level or national inventions.

3. Scientific and technological topics and projects that win the Vifotec, Kovalevskaia, Creative Science awards; scientific and technological advancements at the ministry or national level that have been recognized by decision; and the Creative Labor Certificate (recognized by the Vietnam General Confederation of Labor) shall be considered equivalent to ministry-level or national inventions.

Article 6. Basic-level Invention Council

1. The basic-level Invention Council is established and its operational regulations are issued by the head of the agency or unit under the Ministry.

2. Responsibilities of the Board:

a) Recognizing basic-level inventions for individuals within the agency or unit.

b) Reviewing and submitting proposals to the Ministry-level Invention Council for recognition of ministry-level or national inventions for individuals within the agency or unit.

3. Composition of the Council:

a) Chair: Head of the agency or unit.

b) Members are those with management, professional, and technical qualifications capable of evaluating and appraising inventions and topics in the management and implementation of tasks within the agency or unit.

4. The Director-General of the General Administration, the Director of Special Institutes, the General Director of Groups, and the General Director of Corporations may delegate authority to the heads of subordinate units to establish Invention Councils to recognize inventions for individuals within those units.

Article 7. Ministry-level Invention Council

1. The Ministry-level Invention Council is established and its operational regulations are issued by the Minister.

2. Tasks of the Council: Recognizing ministry-level and national inventions.

3. Composition of the Ministry-level Invention Council includes:

a) Chair: Deputy Minister responsible for competition and commendation or Deputy Minister responsible for science and technology.

b) Vice-Chair: Heads of the Cadre and Civil Servant Organization Department and the Science and Technology and Environment Department.

c) Members: Leaders of some agencies and units under the Ministry.

d) Permanent Member: Deputy Head of the Cadre and Civil Servant Organization Department responsible for competition and commendation work.

e) Secretary Member: Head of the Competition and Commendation Section, Cadre and Civil Servant Organization Department.

Article 8. Process for Reviewing and Recognizing Inventions

1. Individuals submit reports proposing recognition of their inventions.

2. Basic-level Invention Council:

a) Reviews and evaluates the impact and effectiveness of the invention.

b) Decides on the recognition of basic-level inventions (including those proposed for recognition as ministry-level or national inventions).

c) Reviews and submits proposals to the Ministry-level Invention Council for individuals proposing recognition as ministry-level or national inventions.

3. Ministry-level Invention Council:

a) Reviews and evaluates the impact of the invention.

b) Decides on the recognition of ministry-level and national inventions based on the degree and scope of the invention's impact.

4. Decisions of the various levels of Invention Councils are adopted through voting or secret ballot with at least two-thirds agreement from members (written opinions must be obtained from absent members).

Chapter III

COMPETITION WORK

Article 9. Forms of competition and emulation

1. Regular competition and emulation: This form aims to fulfill the political tasks of the agency or unit and is implemented daily.

2. Periodic competition and emulation: This form takes place within a specific period of time to accomplish key tasks of the ministry, sector, or specialized field of the agency or unit.

3. Specialized topic competition and emulation: This form focuses on implementing a specific specialized field or profession during a defined phase.

Article 10. Steps for organizing a competition and emulation movement

1. Developing a plan to organize the competition and emulation movement:

The content of the plan must clearly define: objectives and requirements; scope, target audience, name of the movement, and implementation timeframe; competition content, competition targets, and methods of organization and implementation.

Competition targets and organizational methods must be feasible and suitable to the practical conditions of the agency or unit; set targets should exceed normal levels to encourage individuals and collectives to strive to achieve them.

2. Launching the competition and emulation movement:

Organize a solemn, practical, and effective launch ceremony; at the ceremony, representatives of individuals and collectives express their support for the competition and emulation movement; sign agreements to implement the movement.

3. Implementation:

a) Conduct propaganda to motivate, encourage, and attract a large number of individuals and collectives to participate in the competition and emulation movement;

b) Organize pilot activities of the competition and emulation movement to draw lessons for broader implementation;

c) Inspect, guide, and evaluate the implementation process of the competition and emulation movement, promptly identifying and adjusting elements that do not align with the practical conditions of the agency or unit;

d) Identify, nurture, and promote exemplary models.

4. Organize interim and final reviews: assess results of implementation, select and commend outstanding collectives and individuals in the competition movement.

Article 11. Organization and Activities of the Competition and Emulation Group

1. Organization of the Competition and Emulation Group:

The Ministry organizes Competition and Emulation Groups according to Appendix 1 of this Circular.

The Group Leader and Deputy Leaders of the Competition and Emulation Group operate under a rotation system or are elected by the Group according to its operational regulations.

2. Tasks of the Group Leader, Deputy Leaders, and Members of the Group:

a) Squad leader:

Develop programs, plans, contents, and targets for signing competition and emulation agreements, operational regulations of the Group; criteria and scoring scales appropriate to the characteristics of the Group.

Organize the signing of competition and emulation agreements, launch the competition and emulation movement within the Group; coordinate to organize common activities of the Group such as exchanges, learning experiences, and cross-checks among members of the Group.

Organize mid-year reviews and annual summaries to assess the Group's activities.

Chair the scoring of competitions, selection, and promotion of outstanding units to recommend for awards of the Government Flag of Merit and the Flag of Merit of the Ministry of Agriculture and Rural Development.

b) Deputy Leaders:

Collaborate with the Group Leader to develop plans, programs, and manage the Group's activities.

Handle matters when authorized by the Group Leader.

c) Member Units of the Group:

Register annual competition contents and targets to send to the Group Leader during the Group's annual summary.

Participate in developing competition contents, criteria, and scoring scales; implement signed competition and emulation agreements; organize the launch of the competition and emulation movement within the unit.

Promote and introduce new and effective models, exemplary cases for other members of the Group to learn from.

Fully participate in Group activities with the required components and responsibilities; report on the implementation results of the competition and emulation movement every six months and annually; self-score according to registered competition contents and criteria and submit reports to the Group Leader within the specified timeframe.

3. Activities of the Competition and Emulation Group:

a) Organize interlinking activities such as seminars, exchanges, social welfare activities, professional inspections, experience sharing of exemplary models... suitable to the practical conditions of each Group.

b) Organize mid-year reviews and annual summaries of Group activities.

c) Implement information and reporting systems for mid-year reviews and annual summaries to the Ministry of Agriculture and Rural Development's Competition and Reward Council.

4. Time for mid-year reviews, annual summaries, and signing competition and emulation agreements within the Group:

a) For Competition and Emulation Groups:

Hold mid-year reviews in June and annual summaries before November 30th each year.

Sign competition and emulation agreements combined with the Group's annual summary meeting or separately in the first quarter of each year.

b) For School Groups:

Hold mid-year reviews during the first semester summary of the academic year.

Summarize and sign competition and emulation agreements before July 30th each year.

Article 12. Merit Flag

1. Recipients for awarding:

a) Agencies and units within the Competition Groups of the Ministry as specified in Clause 1, Article 11 of this Circular.

b) Agencies and units that have not yet met the conditions to establish a competition group such as regional bureaus, regional agencies, centers under the Bureau; branch institutes, centers under the Institute; farms, factories, enterprises under companies but with outstanding achievements shall be selected by their direct superior units and recommended to the Ministry.

2. Annual Merit Flag:

a) The Merit Flag of the Ministry of Agriculture and Rural Development shall be awarded to collectives meeting the standards prescribed in Article 26 of the Law on Encouragement and Reward 2003 (hereinafter referred to as the 2003 Law on Encouragement and Reward).

With the following criteria:

Award one flag for a group with five units;

Award two flags for a group with six to nine units;

Award three flags for a group with ten to twelve units;

Award four flags for a group with thirteen or more units.

b) The Merit Flag of the Government shall be awarded to collectives meeting the standards prescribed in Article 25 of the 2003 Law on Encouragement and Reward and Clause 7, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Encouragement and Reward 2013 (hereinafter referred to as the 2013 Amended Law on Encouragement and Reward).

The number of Merit Flags of the Government to be awarded shall not exceed 20% of the total number of collectives meeting the criteria for receiving the Merit Flag of the Ministry.

3. Merit Flag by campaign or special topic:

The Ministry shall award the Merit Flag of the Ministry to campaigns lasting three years or longer; the Ministry shall recommend to the Prime Minister for the Government to award the Merit Flag of the Government to campaigns lasting five years or longer for outstanding collectives participating in campaigns or special topics initiated by the President, the Prime Minister, or the Minister of Agriculture and Rural Development.

Collectives must have outstanding achievements surpassing the set targets, contributing significantly to the development of agriculture and rural areas, and the overall development of the country.

Article 13. Banner of the Ministry of Agriculture and Rural Development

The Minister shall award the Banner to agencies, units, and enterprises under the Ministry; Provincial Departments of Agriculture and Rural Development; Associations and Trade Unions on the occasion of celebrating anniversaries of even or odd years, congresses of terms, and other special cases.

Chapter IV

REWARD WORK

Article 14. Types of Rewards

Types of rewards shall be implemented according to Clauses 1, 2, 3, 4, and 6 of Article 10 of Circular No. 07/2014/TT-BNV, specifically:

1. Reward based on achievements and merits.

2. Reward by campaign (or by special topic).

3. Immediate reward.

4. Reward for dedication over time.

5. Foreign reward.

Article 15. Regulations on the Time for Submitting Applications for Rewards Based on Achievements and Merits

1. Title of "Heroic Laborer": once every five years during the preparation period for the Typical Model Conference, National Patriotic Competition Congress at all levels, except in cases of particularly outstanding and immediate achievements.

2. Golden Star Order: twenty-five years after being awarded the Ho Chi Minh Order.

3. Ho Chi Minh Order: ten years after being awarded the First-Class Independence Order.

A collective that has been awarded the Ho Chi Minh Order for the first time and continues to excel for fifteen consecutive years, maintaining internal unity and strong Party and mass organizations, may be considered for the second Ho Chi Minh Order.

4. Independence Order: ten years after being awarded a lower-level Order.

5. Labor Medal: five years after being awarded a lower-level form of recognition.

6. The time for considering the title of "National Model Worker" is the year immediately following the second time the title of "Ministry Model Worker" is achieved.

7. The time for considering the title of "Ministry of Agriculture and Rural Development Model Worker" is the same year the title of "Basic Level Model Worker" is received for the third time.

Article 16. Title "Outstanding Labor Collective"

The title "Outstanding Labor Collective" shall be implemented according to Article 27 of the Labor Ordinance Law in 2003.

The title "Outstanding Labor Collective" shall not be awarded to General Departments, Institutes ranked exceptionally, Groups, and State Corporations.

Article 17. Title "Model Worker"

1. Title "Model Worker":

Individuals proposed for the award of the title "Model Worker" at the grassroots level, provincial level, and national level must have initiatives or research topics recognized by the respective levels' Initiative Councils.

2. Proportion of Model Workers at the grassroots level:

The annual proportion of individuals recognized with the title "Model Worker" at the grassroots level shall not exceed 15% of the total number of individuals recognized with the title "Advanced Worker" in the agency or unit, among which leaders (those receiving responsibility allowances) shall not exceed 50%.

Article 18. Criteria for Awarding Medals, Orders, National Honorary Titles, and Certificates of Merit from the Prime Minister

1. "Golden Star Order" to be awarded or posthumously awarded to individuals and presented to collectives meeting the criteria specified in Article 34 of the Labor Ordinance Law in 2003, Clause 10 of Article 1 of the Amended Labor Ordinance Law in 2013, and Article 7 of Decree No. 65/2014/ND-CP.

2. "Ho Chi Minh Order" to be awarded or posthumously awarded to individuals and presented to collectives meeting the criteria specified in Article 35 of the Labor Ordinance Law in 2003, Clause 11 of Article 1 of the Amended Labor Ordinance Law in 2013, and Article 8 of Decree No. 65/2014/ND-CP.

3. "Independence Order" first class, second class, third class to be awarded or posthumously awarded to individuals and presented to collectives meeting the criteria specified in Clauses 12, 13, 14 of Article 1 of the Amended Labor Ordinance Law in 2013 and Articles 9, 10, 11 of Decree No. 65/2014/ND-CP.

4. "Labor Order" first class, second class, third class to be awarded or posthumously awarded to individuals and presented to collectives meeting the criteria specified in Clauses 18, 19, 20 of Article 1 of the Amended Labor Ordinance Law in 2013 and Articles 15, 16, 17 of Decree No. 65/2014/ND-CP.

5. "National Defense Order" first class, second class, third class to be awarded or posthumously awarded to individuals and presented to collectives meeting the criteria specified in Clauses 21, 22, 23 of Article 1 of the Amended Labor Ordinance Law in 2013 and Articles 18, 19, 20 of Decree No. 65/2014/ND-CP.

6. "National Security Medal", "Heroic Soldier Medal" to be awarded or posthumously awarded to individuals meeting the criteria specified in Clauses 27, 28 of Article 1 of the Amended Labor Ordinance Law in 2013 and Article 21 of Decree No. 65/2014/ND-CP.

7. Title "People's Hero Armed Forces", "People's Hero Labor" to be awarded or posthumously awarded to individuals and presented to collectives achieving outstanding achievements meeting the criteria specified in Clauses 30, 31 of Article 1 of the Amended Labor Ordinance Law in 2013.

8. Recipients and criteria for awarding the title "People's Teacher", "Outstanding Teacher" shall be implemented according to the provisions of Clause 32 of Article 1 of the Amended Labor Ordinance Law in 2013, Article 45 of Decree No. 42/2010/ND-CP, and Decree No. 27/2015/ND-CP dated March 10, 2015 of the Government on the awarding of the titles "People's Teacher", "Outstanding Teacher".

9. Recipients and criteria for awarding the title "People's Doctor", "Outstanding Doctor" shall be implemented according to the provisions of Clause 33, Article 1 of the Amended Labor Ordinance Law in 2013, Article 45 of Decree No. 42/2010/ND-CP, and Decree No. 41/2015/ND-CP dated May 5, 2015 of the Government on the awarding of the titles "People's Doctor", "Outstanding Doctor".

10. Recipients and criteria for awarding the title "People's Artist", "Outstanding Artist" shall be implemented according to the provisions of Clause 35, Article 1 of the Amended Labor Ordinance Law in 2013, Article 45 of Decree No. 42/2010/ND-CP, and Decree No. 123/2014/ND-CP dated December 25, 2014 of the Government on the awarding of the titles "People's Artist", "Outstanding Artist" in the field of traditional craft.

11. "Ho Chi Minh Prize" to be awarded to individuals meeting the criteria specified in Articles 66 and 67 of the Labor Ordinance Law in 2003 and Article 46 of Decree No. 42/2010/ND-CP.

12. "State Prize" to be awarded to individuals meeting the criteria specified in Articles 66 and 68 of the Labor Ordinance Law in 2003; Clause 36, Article 1 of the Amended Labor Ordinance Law in 2013; and Article 47 of Decree No. 42/2010/ND-CP.

13. "Certificate of Merit from the Prime Minister" to be awarded to individuals and collectives meeting the criteria specified in Clause 38 of Article 1 of the Amended Labor Ordinance Law in 2013 and Article 23 of Decree No. 65/2014/ND-CP.

Article 19. Certificate of Merit by the Minister of Agriculture and Rural Development

1. Commendation based on achievements and merits:

a) Recipients: collectives and individuals under the Ministry.

b) Criteria:

Individuals: exemplary in complying with the Party's guidelines and policies, and State laws, having excelled in their duties for two consecutive years, during which time they have proposed at least two grassroots-level initiatives that have been recognized.

Collectives: exemplary in complying with the Party's guidelines and policies, and State laws, maintaining internal unity, achieving the title of "Excellent Labor Collective" for two consecutive years, effectively implementing democratic regulations at the grassroots level, organizing good competition movements; caring for the material and spiritual lives of members within the collective; practicing thrift; fully implementing all systems and policies for every member of the collective.

For collectives not eligible for the title of "Excellent Labor Collective" when considering commendations, the achievements of directly subordinate units will be taken into account for commendation purposes; each year, at least two-thirds of these subordinate units must achieve the title of "Advanced Labor Collective", and they must meet the specified criteria.

2. Commendation based on specific topics:

a) Recipients: collectives and individuals within and outside the sector.

b) Criteria:

Individuals and collectives who are exemplary in complying with the Party's guidelines and policies, and State laws, and have outstanding achievements recognized in annual competitive movements initiated by the Minister of Agriculture and Rural Development, heads of agencies and units under the Ministry, or Chairpersons of Provincial People's Committees or subordinate agencies and units.

Chapter V

PROCEDURES FOR COMMENDATION AND ORGANIZATION OF AWARDING

Article 21. Nomination Process

1. The nomination process for commendation shall be conducted according to the principle that a higher-level authority only organizes commendation or proposes commendation to a competent authority upon receiving the commendation proposal from the immediate lower-level authority; it does not accept or consider proposals submitted beyond the immediate level.

2. The level responsible for managing organizational structure, cadres, civil servants, public officials, employees, and salary funds shall be responsible for commendation and submitting to a higher-level authority for commendation review.

3. For associations and industry associations operating in the Agriculture and Rural Development sector, commendation by the Ministry or submission to a higher-level authority for commendation review shall be conducted.

4. For joint-stock companies, including those where state-owned shares have been transferred to the State Capital Investment Corporation for management, and limited liability companies: the principle of commendation review and submission shall be that the level which decides on shareholding reform or establishment of organizations shall review and decide on commendation.

For joint-stock companies and wholly-owned subsidiaries under Groups and Corporations: the review and commendation of collectives and individuals within units shall be conducted by the Chairman of the Board of Directors (Board of Members) or General Director of the Group or Corporation, who then submit to the Ministry for commendation.

5. For collectives and individuals outside the sector, if there has been a cooperative operation process, the heads of agencies and units, directors of provincial Departments of Agriculture and Rural Development, or chairpersons of associations and industry associations operating in the Agriculture and Rural Development sector may submit to the Ministry for commendation.

The Department of International Cooperation is the lead unit in compiling files for the Ministry to review commendation for collectives and individuals who are foreigners.

Article 22. The authority to examine and award commendations of the Minister:

1. Examine and submit to the Prime Minister for presenting the Flag of Excellence Competition of the Government, the Certificate of Merit of the Prime Minister, the title of National Labor Model, various types of Orders, the title of Hero of Labor, and other forms of commendation as prescribed.

2. Decide:

To present the title of Outstanding Labor Collective to agencies and units under the Ministry;

To present the Flag of Excellence of the Ministry, the title of Ministry-level Labor Model, the Certificate of Merit of the Minister, and the Banner.

3. Agree on commendations proposed by the Central Steering Committee for Competitions and Commendations for collectives and individuals within the sector managed by the Ministry.

4. Delegate the heads of agencies and units under the Ministry to decide on awarding the title of "Outstanding Labor Collective" to member units and to propose commendations according to the authority stipulated in the Law on Competitions and Commendations.

Article 23. The Competition and Commendation Council of the Ministry

1. The Competition and Commendation Council of the Ministry of Agriculture and Rural Development (hereinafter referred to as the Competition and Commendation Council of the Ministry) shall be established and have its operational regulations issued by the Minister.

2. The composition of the Award and Recognition Council of the Ministry includes:

a) Chairman: The Minister of Agriculture and Rural Development;

b) Vice Chairmen: Deputy Ministers responsible for competition and commendation work; Director of the Cadre and Civil Servant Organization Department, President of the Vietnam Agricultural Workers' Union;

c) Members: Deputy Secretary of the Party Committee of the Ministry, Director of the Ministry's Office, Inspector General of the Ministry, and leaders of related agencies and units.

d) Standing Member: Deputy Director of the Cadre and Civil Servant Organization Department responsible for competition and commendation work.

e) Secretary: Head of the Competition and Commendation Department, Cadre and Civil Servant Organization Department.

3. The Standing Body of the Council: The Cadre and Civil Servant Organization Department.

Article 24. Competition - Award Council at the grassroots level

1. The Competition and Commendation Council at the grassroots level shall be established by the head of the agency or unit, consisting of:

a) Chairman: The head of the agency or unit.

b) Vice Chairman: The President of the Trade Union and Deputy Head of the agency or unit.

c) Members: Based on specific conditions, the composition includes representatives from the Party Committee, Trade Union, Ho Chi Minh Communist Youth Union, head of the unit (section) responsible for competition and commendation work, and heads of some specialized sections decided by the head of the agency or unit.

2. The tasks and powers of the Competition and Commendation Council at the grassroots level:

3. The head of the agency or unit decides to issue the operational regulations of the Council.

Article 25. The Appraisal Board for Achievements and Inventions of the Ministry

1. The Appraisal Board for Achievements and Inventions of the Ministry (hereinafter referred to as the Appraisal Board) shall be established by the Chairman of the Ministry's Competition and Reward Council.

The Appraisal Board operates in accordance with the operational regulations of the Ministry's Competition and Reward Council and the Departmental Invention Council.

2. Members of the Appraisal Board include:

a) Chairperson: Deputy Director of the Organization and Cadre Affairs Department responsible for competition and reward work.

b) Members: Leaders of some specialized Departments and Agencies related to the matter.

c) Secretary: Head of the Competition and Reward Office, Organization and Cadre Affairs Department.

3. The Appraisal Board has the duty to advise and provide consultation to the Ministry's Competition and Reward Council and the Departmental Invention Council:

a) To appraise the achievements of collectives and individuals proposed for rewards.

b) To assess the extent, scope of influence, and effectiveness of inventions, research topics, and scientific and technological projects of individuals proposed by agencies and units.

Article 26. File for Proposing Rewards at the Ministry Level

1. The file for proposing rewards at the Ministry level includes one set (original), consisting of:

a) A proposal for rewarding from the head of the unit (or the Head of the Competition Group) according to Model No. 2, Appendix 2 of this Circular;

b) Minutes of the meeting of the unit's Competition and Reward Council according to Model No. 3, Appendix 2 of this Circular (applicable for rewards based on achievements and merits, periodic rewards, and thematic rewards);

c) Report on achievements (summary report on achievements) of the collective or individual proposed for reward:

Flag of Competition of the Ministry, Outstanding Labor Collective according to Model No. 7, Appendix 2 of this Circular.

Title "Outstanding Competitor of the Ministry" according to Model No. 8, Appendix 2 of this Circular.

Certificate of Merit from the Minister of Agriculture and Rural Development according to Model No. 7, Model No. 8 (for rewards based on merits), Model No. 12 (for sudden rewards), Model No. 13 (for periodic and thematic rewards), Model No. 14 (for foreign rewards), Appendix 2 of this Circular.

d) Decision recognizing grassroots-level inventions (photocopy);

Article 27. Documents for Proposing National-Level Recognition and Awards

File for proposing state-level rewards: three sets (original) for the Government Flag of Competition, Prime Minister's Certificate of Merit; four sets (original) for various Orders; five sets (original) and twenty sets (photocopy) for the title "Heroic Laborer", including:

1. A proposal for rewarding from the head of the unit (or the Head of the Competition Group) according to Model No. 2, Appendix 2 of this Circular.

2. Minutes of the meeting of the unit's Competition and Reward Council (or the Competition Group) according to Model No. 3, Appendix 2 of this Circular.

3. Report on achievements (summary report on achievements) of the collective or individual proposed for reward:

a) Flag of Competition of the Government according to Model No. 7, Appendix 2 of this Circular;

b) Title "National Outstanding Competitor" according to Model No. 8, Appendix 2 of this Circular;

Article 28. Time for receiving files, place for receiving files, and notification of results

1. Time for receiving files (calculated from the postmark or processing receipt of the Ministry):

a) Banner of Excellence before November 30 each year;

b) Other commendation titles and awards based on achievements and merits before January 30 each year;

c) Other forms of awards: no specified time;

d) For school clusters' awards before July 30 each year;

e) For files requesting recognition of initiatives at the ministry level and nationwide level, received in two rounds:

The first round before January 30 each year.

The second round before July 30 each year.

2. Place for receiving files:

Ministry of Agriculture and Rural Development (Department of Organization and Cadres), simultaneously send electronic files (in .doc format) to the email address: [email protected].

3. Notification of results:

a) Within ten working days from the date of issuance of the Decision, the Permanent Office shall notify the result to the unit proposing the award.

b) In cases where the conditions and criteria for awards are not met, the Permanent Office shall notify the proposing unit in writing within ten working days from the date of conclusion by the competent authority.

Article 29. Organization of Awarding

The ceremony for presenting and receiving awards and commendation titles shall be carried out in accordance with Decree No. 145/2013/ND-CP dated October 29, 2013 of the Government on the organization of commemorative days; ceremonies for presenting and receiving awards and commendation titles; diplomatic rituals and welcoming foreign guests; and guidelines of the Ministry of Agriculture and Rural Development.

Chapter VI

FUND FOR COMPETITION AND REWARD

Article 30. Sources and levels of contributions to the competition and reward fund

1. Fund for competition and awards of the Ministry and subordinate agencies and units:

a) From the state budget;

b) Contributions from domestic and foreign organizations and individuals for the purpose of competition and awards;

c) Other lawful sources (if any).

2. Level of fund establishment for competition and awards:

a) Agencies and units under the Ministry and within the scope of the Ministry's awards:

Units with separate accounts and seals shall establish their own competition and awards fund up to a maximum of 19.4% of the total salary fund according to rank and grade of officers, civil servants, and public officials within the establishment, approved annual wages (as stipulated in Clause 1, Article 67 of Decree No. 42/2010/ND-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011 of the Ministry of Finance guiding the establishment, management, and use of the competition and awards fund).

b) Fund for competition and awards of the Ministry:

Establishing level at 0.6% of the salary and wage fund according to rank and grade of civil servants and public officials of budgetary units under the Ministry;

Contributions from units for producing Commemorative Medals, printing Commendation Certificate papers, and purchasing frames for Certificates of Merit (for provincial Departments of Agriculture and Rural Development, enterprises, Associations, and Chambers).

Article 31. Management and Use of Competition and Awards Fund

1. Competition and awards fund of the Ministry:

a) Management of the fund:

The competition and awards fund of the Ministry of Agriculture and Rural Development shall be managed by the Ministry's Office in accordance with regulations.

b) Use of the fund:

To purchase award items for the Ministry.

To pay cash prizes, make award items, or give commemorative gifts along with commendation titles and awards for outstanding, special, and Commemorative Medals for overseas Vietnamese and foreigners decided by the Minister of Agriculture and Rural Development.

To cover expenses for organizing and directing competition movements.

2. Competition and awards fund of agencies and units under the Ministry and within the scope of the Ministry's awards:

a) Management of the fund:

The Standing Committee of the Competition and Awards Council of agencies and units shall advise the heads of units on using the competition and awards fund in accordance with regulations. Any surplus at the end of the year that has not been used can be transferred to the next year for continued use in competition and awards activities.

b) Use of the fund:

To pay cash prizes, make award items, or give commemorative gifts along with commendation titles and awards for collectives and individuals within the head of unit's awarding authority or proposed by the unit and awarded by a higher competent authority.

To cover expenses for organizing and directing competition movements.

Article 32. Principles for Award Distribution

1. Responsibility for Award Distribution:

a) After receiving the award decision, the unit proposing the award shall be responsible for allocating funds from its own competition and commendation fund to pay awards to the units' collectives and individuals who have been commended by superiors;

b) The competition and commendation fund must be used for its intended purpose, transparently, and publicly, and an annual report on the use of the fund must be submitted according to current regulations.

2. Amount of Awards:

The amount of awards accompanying competition titles and commendation forms shall be implemented in accordance with the provisions from Article 70 to Article 77 of Decree No. 42/2010/NĐ-CP and related legal documents.

Chapter VII

IMPLEMENTATION

Article 33. Responsibility for Implementation

1. The Cadre and Civil Servant Department serves as the Standing Office of the Ministry's Competition and Commendation Council, responsible for organizing, guiding, and implementing this Circular to agencies and units within the sector.

2. Agencies and units under the Ministry, Provincial Departments of Agriculture and Rural Development, cities, associations, and unions shall be responsible for implementing the provisions of this Circular.

Article 34. Effective Date

1. This Circular takes effect from February 1, 2016.

2. This Circular replaces Circular No. 07/2014/TT-BNNPTNT dated February 10, 2014, issued by the Minister of Agriculture and Rural Development regarding guidelines for competition and commendation work in the Agriculture and Rural Development sector.

3. During implementation, if there are any difficulties, it is requested that agencies, organizations, and individuals promptly reflect these issues to the Ministry of Agriculture and Rural Development (through the Cadre and Civil Servant Department) for consolidation and reporting to the Minister for consideration and decision.
