II. TECHNICAL REQUIREMENTS, TESTING METHODS, SAMPLING, AND LABELLING

Technical requirements and testing methods

Technical requirements and testing methods for solvents are specified in the appendices attached to this regulation as follows:

2. Labelling of solvents must comply with the provisions of Decree No. 89/2006/NĐ-CP dated August 30, 2006 of the Government on product labelling, Joint Circular No. 34/2014/TTLT-BYT-BNNPTNT-BCT dated October 27, 2014 of the Ministers of Health, Agriculture and Rural Development, and Industry and Trade guiding the labelling of products for food, food additives, and prepackaged food processing aids, and other relevant laws.

III. MANAGEMENT REQUIREMENTS

3. 1.1. Solvents must be announced in compliance with the provisions of this regulation.

1.2. The manner, procedure, and process for announcing conformity assessment are implemented in accordance with Article 6, Article 7 of Decree No. 38/2012/NĐ-CP dated April 25, 2012 of the Government detailing the implementation of certain provisions of the Food Safety Law and Article 4, Article 5, Article 7, Article 9 of Circular No. 19/2012/TT-BYT dated November 9, 2012 of the Minister of Health guiding the announcement of conformity assessment and compliance with food safety regulations and other relevant laws.

III. MANAGEMENT REQUIREMENTS

1. Declaration of compliance with technical regulations

1.1. The solvents must be declared in accordance with the provisions of this Standard.

1.2. The methods, procedures, and processes for declaring conformity shall be carried out in accordance with Article 6 and Article 7 of Decree No. 38/2012/NĐ-CP dated April 25, 2012, of the Government detailing certain articles of the Food Safety Law, and Article 4, Article 5, Article 7, and Article 9 of Circular No. 19/2012/TT-BYT dated November 9, 2012, of the Minister of Health guiding the declaration of conformity and the declaration in compliance with food safety regulations and other relevant laws.

2. Inspection, supervision, and handling of violations of the law

The competent state agency shall carry out inspection, supervision, and handling of violations of the law against organizations and individuals importing, producing, and trading solvents that violate technical regulations and management provisions set forth in this Standard and other relevant laws.

IV. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

1. Organizations and individuals importing, producing, and trading solvents must declare conformity in accordance with the requirements of this Standard.

2. Organizations and individuals are only permitted to import, produce, and trade solvents after receiving from the Food Safety Agency the Certificate of Receipt of Declaration of Conformity and complying with other current legal provisions.

V. IMPLEMENTATION

1. Entrust the Food Safety Agency to take the lead and coordinate with relevant functional agencies to guide implementation and organize the enforcement of this Standard.

2. Based on management requirements, the Food Safety Agency has the responsibility to propose the Minister of Health to amend and supplement this Standard.

3. In case international guidance on testing methods and legal provisions cited in this Standard are amended, supplemented, or replaced, the new document shall be applied.
