REGULATIONS ON PRIORITY INVESTMENT AND PROCUREMENT OF DOMESTICLY PRODUCED INFORMATION TECHNOLOGY PRODUCTS AND SERVICES FUNDED BY THE STATE BUDGET

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to the Law on Bidding dated November 26, 2013;

Pursuant to Decree No. 63/2014/NĐ-CP dated June 26, 2014 of the Government detailing implementation of certain provisions of the Law on Bidding regarding selection of contractors;

Pursuant to Decree No. 64/2007/ND-CP dated April 10, 2007 of the Government on the application of information technology in the activities of state agencies;Pursuant to Decision No. 169/2006/QĐ-TTg dated July 17, 2006 of the Prime Minister on investment and procurement of information technology products for agencies and organizations funded by the state budget and Decision No. 223/2006/QĐ-TTg dated October 4, 2006 of the Prime Minister amending certain provisions of Decision No. 169/2006/QĐ-TTg; The Minister of Information and Communications promulgates this Circular detailing regulations on priority investment and procurement of domestically produced information technology products and services funded by the state budget.

The Minister of Information and Communications promulgates this Circular amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products.

1. Criteria for determination and List of domestically produced information technology products and services eligible for priority investment and procurement in state agencies and organizations.

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Article 1. Amending and supplementing Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications on the List of software and hardware, electronic products as follows:

2. Priority shall be applied in cases of investment and procurement of information technology products and services funded by the state budget or funds derived from the state budget and where such investment and procurement is not for commercial purposes, specifically including:

Article 1. Scope of Regulation

This Circular stipulates on:

a) Procurement of assets and other procurements aimed at maintaining regular operations;

b) Investment and procurement in investment projects;

c) Other activities involving investment and procurement of information technology products and services.

1. This Circular applies to state agencies, state-run units, political organizations, political-social organizations, and units under armed forces (hereinafter collectively referred to as agencies and organizations).

2. Encouragement is given to organizations and businesses not falling within the scope specified in Clause 1 of this Article to apply the provisions of this Circular when investing in and procuring information technology products and services.

Article 2. Applicability

Article 3. Information Technology Products and Services Produced Domestically Eligible for Priority When Invested In and Purchased

Information technology products and services produced domestically eligible for priority when invested in and purchased using state budget funds or funds derived from the state budget (hereinafter referred to as prioritized products and services) when:

1. They belong to the List of domestically produced information technology products and services eligible for priority when invested in and purchased as stipulated in Article 4 of this Circular;

2. They meet the criteria set forth in Articles 5 and 6 of this Circular;

3. They have been announced in accordance with Clause 1 of Article 7 of this Circular.

Article 4. List of Domestically Produced Information Technology Products and Services Eligible for Priority When Invested In and Purchased

1. The List of domestically produced information technology products and services eligible for priority when invested in and purchased (hereinafter referred to as the List) is detailed in Appendix I attached to this Circular.

2. The List will be updated and supplemented to align with practical developments.

1. Registered trademark and protected according to Vietnamese law, or registered and completed all requirements and conditions for providing products and services (if applicable) according to Vietnamese law;

2. Technical documentation and user guides in Vietnamese;

Article 5. General criteria for prioritized products and services

Prioritized products and services must meet the following general criteria:

3. Clear statements of warranty commitments, supplier responsibilities, and after-sales policies.

2. Have technical documentation and user guide in Vietnamese;

3. Clearly notify the terms of commitment regarding warranty, supplier's liability, and after-sales policy.

Article 6. Specific criteria for prioritized products and services

Prioritized products and services must meet the following specific criteria:

1. For hardware and electronic products:

a) The domestic production cost of the product accounts for at least 25% of the product's price, or there are at least 50 Vietnamese workers with expertise in hardware and electronics who have labor contracts of one year or more, including R&D staff, quality control personnel, engineers, and direct production workers;

b) The product has been published as conforming to National Standards (if applicable). The product is certified and published as compliant with the conformity assessment requirements for information technology and telecommunications products listed in the mandatory conformity assessment directory, or the product has been published as compliant with the conformity assessment requirements for information technology and telecommunications products listed in the mandatory publication directory;

c) The product is produced by organizations or enterprises that have achieved at least one of the following quality management standards for hardware and electronic manufacturing activities: TCVN ISO 9001:2008; TCVN ISO 17025:2005; TCVN ISO 14001:2004, or equivalent.

2. For software products:

a) The functions and technical features of the product comply with business requirements or state agency regulations and guidelines (if applicable);

b) The domestic production cost of the product accounts for at least 25% of the product's price, or there are at least 20 Vietnamese workers with expertise in software who have labor contracts of one year or more, including R&D staff, quality assurance personnel, engineers, and programmers directly involved in producing the product;

c) The product must be produced by organizations or enterprises that have obtained certification for software production activities according to the CMMI level 3 or higher standard, or TCVN ISO 9001:2008, or equivalent, or the product has an Open Source Maturity Model (OSMM) score of 60 points or higher, or a Point of Failure (PoF) score of 50 points or lower;

d) For network security products, they shall be implemented in accordance with laws on network security.

3. For digital content products:

a) The product must comply with laws on the provision and use of content and information;

b) The domestic production cost of the product accounts for at least 25% of the product's price, or there are at least 20 Vietnamese workers with labor contracts of one year or more, directly involved in developing the product.

4. For information technology services:

a) The service is provided by a service provider that meets the quality management standard TCVN ISO 9001:2008, or equivalent. The server system providing the service (if any) is located in Vietnam. Priority is given to service providers with a service quality management system according to the TCVN ISO 20000 or ISO 27001 standard;

b) For services related to customer data, the service provider must have measures to ensure the safety and confidentiality of customer information and data;

c) For network security services, they shall be implemented in accordance with laws on network security.

Article 7. Announcing information about prioritized products and services

1. To ensure that information technology products and services meeting the criteria set out in Articles 5 and 6 of this Circular are given priority when investing, purchasing, organizing, and providing services, enterprises must:

a) Announce information technology products and services meeting the investment and procurement priority criteria according to the model attached as Appendix II to this Circular on mass media and their own websites (if available) throughout the provision of such products and services, and bear full responsibility for the accuracy of the announced information related to these products and services;

b) Submit a written notification to the Ministry of Information and Communications (Department of Information Technology - 18 Nguyen Du Street, Hai Ba Trung District, Hanoi) regarding the information related to the announced products and services according to the model attached as Appendix III to this Circular;

c) Supplement or change information about products and services when there are changes to the previously announced information technology products and services on mass media and their own websites, and notify the Ministry of Information and Communications (Department of Information Technology) according to the model attached as Appendix IV to this Circular;

d) In case of ceasing to provide or support prioritized products and services that have been announced, organizations and enterprises must announce this on mass media and their own websites, and notify the Ministry of Information and Communications (Department of Information Technology) according to the model attached as Appendix V to this Circular;

đ) Ensure the quality of prioritized products and services as announced.

2. Within ten working days from the date of receipt of the notification from organizations and enterprises (sent according to the model attached as Appendix III, Appendix IV, or Appendix V to this Circular), the Ministry of Information and Communications shall be responsible for:

a) Reviewing and posting information about prioritized products and services of organizations and enterprises on its electronic portal at www.mic.gov.vn for agencies and organizations to refer to when investing in and purchasing information technology products and services;

b) In cases where necessary, organize inspections to verify compliance with the criteria of prioritized products and services announced by organizations and enterprises, and post the inspection results on the electronic portal at www.mic.gov.vn. If it is found that the information technology products and services announced by organizations and enterprises do not meet the announced information, the Ministry of Information and Communications will request relevant authorities to investigate and handle according to the law.

3. Encourage specialized units of the Ministries, ministerial-level agencies, government-affiliated agencies, and provincial Departments of Information and Communications to survey, evaluate, and announce information technology products and services meeting the investment and procurement priority criteria within their respective fields and jurisdictions.

Article 8. Investment and Procurement of Prioritized Products and Services in Cases of Special Technical Requirements

In cases where information technology products and services need to be invested in or purchased but due to special technical requirements of the project cannot select prioritized products and services, the investor must follow the following approval process:

1. Approval Process:

a) The investor prepares a submission explaining the matter and sends it to the specialized unit under the Ministry or sector or the provincial Department of Information and Communications (hereinafter referred to as the specialized unit) for professional opinion. In cases where the investor is also the specialized unit, the competent authority deciding on investment and procurement must establish an independent advisory team to review and provide opinions on investment and procurement. The independent advisory team must satisfy the following conditions simultaneously: At least three members; the members of the independent advisory team must not belong to the investor's organization; they must have appropriate qualifications and experience;

b) Within five working days from the date of receipt of a valid submission, the specialized unit or the independent advisory team must submit a professional opinion letter to the competent authority deciding on investment and procurement and the investor;

c) Content of the professional opinion letter: Analyze the purpose of use to determine the requirements for the products and services to be invested in or purchased; assess the ability of prioritized products and services to meet the requirements of the products and services to be invested in or purchased; determine the validity of not investing in or purchasing prioritized products and services and clearly state the conclusion on the investor's proposal;

d) Based on the professional opinion letter, the investor submits the explanation to the competent authority deciding on investment and procurement to request approval for not investing in or purchasing prioritized products and services. The investor bears responsibility for the authenticity of the documents and analyses and arguments in the explanation;

đ) Within ten working days from the date of receipt of the investor's explanation, the head of the competent authority deciding on investment and procurement assigns the competent agency to conduct an examination to approve the decision not to invest in or purchase domestic products and services and directly bear responsibility for the decision.

2. The explanation includes:

a) Explanation of the purpose of investment in products and services and the special requirements that prioritized products and services cannot meet;

b) Documentation describing the functional and technical specifications of the products and services to be invested in or purchased to meet the project's requirements;

c) Explanation of the reasons why prioritized products and services cannot meet the functional and technical specifications of the products and services to be invested in or purchased;

d) Professional opinion letter from the specialized unit or the independent advisory team and other related documents (if any).

Article 9. Responsibilities of Related Units

1. The Department of Information Technology (Ministry of Information and Communications) shall be responsible for:

a) Taking the lead and coordinating with relevant agencies to organize guidance on the implementation of this Circular;

b) Organizing the evaluation of information technology products and services, submitting to the Minister for consideration, updating, and supplementing the List;

c) Summarizing the implementation situation of the provisions of this Circular to submit to the Minister for reporting to the Prime Minister.

2. Specialized units for information technology of Ministries, ministerial-level agencies, government agencies, and Provincial Departments of Information and Communications under central cities shall be responsible for:

a) Organizing guidance, dissemination, and urging subordinate agencies and units within their ministries, sectors, or localities to implement the contents of this Circular;

b) Proposing and being responsible for their professional opinions on contents related to prioritized investment and procurement of information technology products and services in projects and plans for investment and procurement using state budget funds of agencies and units within their ministries, sectors, or localities;

c) Requesting project sponsors within their ministries, sectors, or localities to report on the implementation of the provisions of this Circular. Summarizing and sending reports according to the form attached as Appendix VI of this Circular to the Ministry of Information and Communications (Department of Information Technology) before March 31 each year for reporting to the Prime Minister.

Article 10. Transitional Provisions

1. In cases where investment and procurement have been appraised, approved, and implemented before the effective date of this Circular, the investment and procurement of domestically produced information technology products and services shall continue to be carried out in accordance with the provisions of Circular No. 01/2014/TT-BTTTT dated February 20, 2014, issued by the Minister of Information and Communications detailing the priority for investment and procurement of domestically produced information technology products and services funded by the state budget.

2. In cases where investment and procurement have been appraised and approved but not yet commenced before the effective date of this Circular, the investment and procurement of domestically produced information technology products and services shall be carried out in accordance with laws on investment management, laws on bidding, and this Circular.

Article 11. Effective Date

1. This Circular takes effect from March 1, 2017.

2. This Circular replaces Circular No. 01/2014/TT-BTTTT dated February 20, 2014, issued by the Minister of Information and Communications detailing the priority for investment and procurement of domestically produced information technology products and services funded by the state budget.

3. During the implementation process, if there are difficulties, they should be reported to the Ministry of Information and Communications (Department of Information Technology) for prompt resolution.

4. The Heads of the Office, the Heads of the Department of Information Technology, the Directors of Provincial Departments of Information and Communications under central cities, and related agencies, organizations, enterprises, and individuals are responsible for implementing this Circular./.
