CIRCULAR

Amending and supplementing the economic and technical standards for managing and maintaining inland waterways issued together with Decision No.

39/2004/QĐ-BGTVT dated December 31, 2004, by the Minister of Transport.

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004;

Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008, promulgated by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport hereby promulgates:

Article 1. Amending and supplementing the economic and technical standards for managing and maintaining inland waterways issued together with Decision No. 39/2004/QĐ-BGTVT dated December 31, 2004, by the Minister of Transport.

1. Amending the names of inland waterway management agencies as follows:

The River Management Station, River Section Management Unit, River Branch Office, and Vietnam Inland Waterway Administration shall be renamed to Inland Waterway Management Station, Inland Waterway Management Unit, Regional Inland Waterway Branch Office, and Vietnam Inland Waterway Administration.

2. Amending Clause 4, Chapter I as follows:

"4. The work of managing and maintaining inland waterways is specifically regulated in Joint Circular No. 09/2008/TTLT/BTC-BGTVT dated January 30, 2008, and any subsequent amendments or replacements thereof."

3. Amending and supplementing Clause 1, 2, and 3, Item I, Part A, Chapter II as follows:

"1. The Inland Waterway Management Station has the following responsibilities:

a) Regularly inspect the managed and maintained waterway route according to the following tasks: travel along the route, check navigation aids, obstructions, shoals, handle sudden situations causing safety issues on the route, and combine with other field operations;

b) Develop and propose traffic assurance plans for inland waterways.

2. The Inland Waterway Management Unit conducts monthly inspections of the routes managed by the Inland Waterway Management Stations, covering the following aspects:

a) Inspect the condition of channels, navigation aids, obstructions, transport, and inland waterway traffic safety to develop technical management and maintenance plans for inland waterways;

b) Direct follow-up tasks for the Inland Waterway Management Stations;

c) Accept completed regular management and maintenance works of the Inland Waterway Management Stations.

3. The Vietnam Inland Waterway Administration (Regional Inland Waterway Branch Office) conducts quarterly inspections of the routes managed by the Inland Waterway Management Units, covering the following tasks:

a) Evaluate the completion level of management and maintenance tasks by the Inland Waterway Management Units;

b) Collect information on channel conditions, navigation aids, obstructions, transport, traffic order, and safety, and direct the Inland Waterway Management Units to perform their management and maintenance duties along the route;

c) Accept completed regular management and maintenance works of inland waterways by the Inland Waterway Management Units."

4. Supplementing Point 2.6, Clause 2, Item II, Part A, Chapter II as follows:

"2.6. Battery replacement journey, light replacement journey.

Using waterborne vessels to transport personnel and equipment to locations for battery replacement and light replacement."

5. Adjusting and supplementing some items of work in Part B, Chapter II as follows:

"1. Adjusting the number of emergency inspections after floods and typhoons for inland waterways categories 2 and 3, and the number of signal maintenance cycles according to Appendix I attached to this Circular;

2. Supplementing the number of battery replacement journeys and light replacement journeys, and the number of battery replacements to maintain LED light brightness according to Appendix I attached to this Circular."

6. Supplementing Clause 23, Item II, and Clause 3, Item III, Part B, Chapter III as follows:

Supplementing labor norms and machine operation norms for battery replacement and light replacement journeys according to Appendix II attached to this Circular;

7. Supplementing Item I, the national inland waterway management classification directory appendix as follows:

Supplementing the classification of national inland waterway routes announced in Decision No. 970/QĐ-BGTVT dated April 15, 2009, by the Minister of Transport according to Appendix III attached to this Circular.

Article 2. Implementation clause

1. This Circular takes effect 45 days from the date of signature;

2. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, the Director of the Vietnam Inland Waterway Administration, Directors of Provincial and Municipal Transport Departments under the Central Government, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
