Circular No. 48/2021/TT-BGDĐT Abolishes Certain Legal Normative Documents Issued by the Minister of Education and Training Regarding Student Policies and Benefits

CIRCULAR

Repeals certain regulatory legal documents issued by the Minister of Education and Training regarding student benefits and policies

and joint issuance regarding systems,

policies for students and trainees

Pursuant toLaw on Legislative Issuance of Legal Normative Documents dated June 22, 2015; Law Amending and Supplementing Certain Articles of the Law on Legislative Issuance of Legal Normative Documents dated June 18, 2020;

On the basis of Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing some provisions and measures to implement the Law on Enacting Regulatory Legal Documents; Decree No. 154/2020/NĐ-CP dated December 31, 2020 of the Government amending and supplementing certain articles of Decree No.Decision No. 34/2016/NĐ-CPDecember 31, 2020 Government Decree amending and supplementing some articles of the Government Decree No.

Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of the Legal Department;

The Minister of Education and Training issues this Circular to repeal certain regulatory legal documents issued by the Minister of Education and Training and jointly issued regarding student benefits and policies

Article 1. Repeals certain regulatory legal documents issued by the Minister of Education and Training and jointly issued regarding student benefits and policies

Repeals the following regulatory legal documents in their entirety:

1. Joint Circular No. 09/2000/TTLT-BGDĐT-BTC-BLĐTBXH dated April 11, 2000 of the Ministry of Education and Training, Ministry of Finance, and Ministry of Labor, Invalids and Social Affairs guiding the implementation of Decision No. 239/1999/QĐ-TTg dated December 28, 1999 of the Prime Minister supplementing and amending Clause a of Article 1 of Decision No.1121/1997/QĐ-TTgdated December 23, 1997 of the Prime Minister on scholarships and social allowances for students and trainees at public training institutions.

2. Decision No. 44/2007/QĐ-BGDĐT dated August 15, 2007 of the Minister of Education and Training on scholarships to encourage study for students and trainees in specialized schools, talent schools, higher education institutions, and vocational colleges under the national education system.

3. Joint Circular No. 03/2012/TTLT-BGDĐT-BTC-BLĐTBXH dated January 19, 2012 of the Ministry of Education and Training, Ministry of Finance, and Ministry of Labor, Invalids and Social Affairs guiding the implementation of policies to support education for children, students, and trainees from ethnic minorities with very small populations pursuant to Decision No. 2123/QĐ-TTg dated November 22, 2010 of the Prime Minister approving the Project on Developing Education for Ethnic Minorities with Very Small Populations for the period 2010-2015.

4. Circular No. 31/2013/TT-BGDĐT dated August 1, 2013 of the Minister of Education and Training Amending and Supplementing Clause 3 of Article 2 of Decision No. 44/2007/QĐ-BGDĐT dated August 15, 2007 of the Minister of Education and Training on scholarships to encourage study for students and trainees in specialized schools, talent schools, higher education institutions, and vocational colleges under the national education system.

5. Joint Circular No. 09/2016/TTLT-BGDĐT-BTC-BLĐTBXH dated March 30, 2016 of the Minister of Education and Training, Minister of Finance, and Minister of Labor, Invalids and Social Affairs Guiding the Implementation of Certain Provisions of Decree No. 86/2015/NĐ-CP dated October 2, 2015 of the Government on the mechanism for collecting and managing tuition fees for educational institutions under the national education system and policies on exemption, reduction of tuition fees, and support for learning expenses from the 2015-2016 academic year to the 2020-2021 academic year.

Article 2. Effective Date

1. This Circular takes effect from February 15, 2022.

2. The Director of the Office, Heads of the Department of Legal Affairs, heads of relevant units under the Ministry of Education and Training; directors of provincial education and training departments; directors of universities and academies; principals of university schools; principals of teacher training colleges and organizations and individuals related to this Circular shall be responsible for its implementation./.
