CIRCULAR
REGULATIONS ON THE DELEGATION OF IMPLEMENTATION OF CERTAIN TASKS AND ADMINISTRATIVE PROCEDURES IN THE FIELD OF FOOD SAFETY WITHIN THE AUTHORITY OF THE MINISTRY OF HEALTH
Pursuant to the Law on the Organization of the Government dated February 18, 2025;
Pursuant to the Law on Enacting Legal Normative Documents dated February 19, 2025;
Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on Enacting Legal Normative Documents dated June 25, 2025;
Pursuant to Decree No. 78/2025/NĐ-CP dated April 1, 2025 of the Government detailing certain provisions and organizational measures for implementing the Law on Enacting Legal Normative Documents amended and supplemented by Decree No. 187/2025/NĐ-CP dated July 1, 2025 of the Government;
Pursuant to Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing certain provisions of the Food Safety Law;
Pursuant to Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Food Safety Administration;
The Minister of Health issues this Circular regulating the delegation of implementation of certain tasks and administrative procedures in the field of food safety within the authority of the Ministry of Health.
Article 1. Scope of Regulation
This Circular regulates the delegation of implementation of certain tasks and administrative procedures in the field of food safety within the authority of the Ministry of Health.
Article 2. Delegation of Implementation of Certain Tasks and Administrative Procedures in the Field of Food Safety Within the Authority of the Ministry of Health to the Food Safety Administration
1. Implementing certain tasks assigned to the Ministry of Health under Decree No. 15/2018/NĐ-CP dated February 2, 2018 of the Government detailing certain provisions of the Food Safety Law (hereinafter referred to as Decree No. 15/2018/NĐ-CP) and Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health (hereinafter referred to as Decree No. 42/2025/NĐ-CP), including:
a) Directing, inspecting, and guiding the organization and business operations of state inspection agencies for imported food products as provided for in Point e Clause 2 Article 15 of Decree No. 15/2018/NĐ-CP;
b) Warning state inspection agencies for imported food products as provided for in Point i Clause 2 Article 15 of Decree No. 15/2018/NĐ-CP;
c) Conducting strict inspections on batches and types of imported goods as provided for in Point c Clause 3 Article 17 of Decree No. 15/2018/NĐ-CP;
d) Notifying the cessation of strict inspections in cases where warnings have been issued as provided for in Point b Clause 4 Article 17 of Decree No. 15/2018/NĐ-CP;
e) Receiving reports from establishments and units submitted to the Ministry of Health as provided for in Point i Clause 2 Article 15; Clause 4 Article 19 of Decree No. 15/2018/NĐ-CP and Clause 13 Article 2 of Decree No. 42/2025/NĐ-CP;
f) Taking the lead in organizing the implementation of information dissemination, education, and knowledge dissemination on food safety as provided for in Clause 13 Article 2 of Decree No. 42/2025/NĐ-CP;
g) Directing and guiding the implementation of legal normative documents, national standards, and technical regulations on food safety within the scope of management of the Ministry of Health as provided for in Clause 13 Article 2 of Decree No. 42/2025/NĐ-CP.
2. Issuing certificates of receipt for registration declarations of imported health food products, mixed food additives with new functions, or food additives not included in the list of permitted food additives or not suitable for their intended use as specified by the Ministry of Health (Administrative Procedure Code 1.001411) as provided for in Clause 1 Article 7; Article 8 of Decree No. 15/2018/NĐ-CP.
3. Issuing certificates of receipt for registration declarations of domestically produced health food products, mixed food additives with new functions, or food additives not included in the list of permitted food additives or not suitable for their intended use as specified by the Ministry of Health (Administrative Procedure Code 1.001422) as provided for in Clause 2 Article 7; Article 8 of Decree No. 15/2018/NĐ-CP.
4. Issuing certificates of confirmation of advertising content for health food products (Administrative Procedure Code 1.006424) as provided for in Article 27 of Decree No. 15/2018/NĐ-CP.
5. Issuing and reissuing certificates of compliance with Good Manufacturing Practices (GMP) for health food products (Administrative Procedure Code 1.008435) as provided for in Article 29 of Decree No. 15/2018/NĐ-CP.
Article 3. Effectiveness
This Circular takes effect from December 30, 2025.
Article 4. Organization of Implementation
The officials: Director of the Ministry's Office; Head of the Cadre and Civil Servant Department; Director of the Food Safety Administration and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
In the course of implementation, if there are difficulties or obstacles, please report to the Ministry of Health (Food Safety Administration) for timely guidance and resolution.
