Ordinance No. 48/LCT stipulates the service conditions for officers of the People's Armed Police Force.

ORDINANCE

REGULATIONS ON THE SERVICE SYSTEM

OF MILITARY POLICE OFFICERS

To promote the construction of the Military Police force, to strengthen domestic security protection, and border and coastal defense;

To define the tasks, rights, honors for Military Police officers, to enhance their sense of responsibility, organizational awareness, and discipline;

The Standing Committee of the National Assembly hereby stipulates the service system for Military Police officers as follows:

Article 1

Military Police officers serve according to the regulations prescribed in the Law dated April 29, 1958 on the service system of People's Army officers, except for points that are unsuitable, which shall be regulated as follows:

Article 2

The following persons may be supplemented into the Military Police officer corps:

a) Officers of the People's Army and military personnel who have graduated from officer training schools of the Ministry of Defense and transferred to the Military Police;

b) Police officials and officials from other sectors who have been transferred to the Military Police;

c) Persons who have graduated from training schools for officials of the Ministry of Public Security;

d) Reserve Military Police officers called up individually or mobilized en masse;

đ) Non-commissioned officers and soldiers of the Military Police who have shown bravery, flexibility, and achieved significant accomplishments during combat or demonstrated outstanding performance in their work.

Article 3

The granting of officer ranks to police officials is based on political qualities, capabilities, current rank and position, service achievements, and contributions to the revolution.

Those who have graduated from officer training schools of the Ministry of Defense, training schools for officials of the Ministry of Public Security, non-commissioned officers and soldiers who have shown bravery, flexibility, and achieved significant accomplishments during combat or demonstrated outstanding performance in their work may be granted the rank of second lieutenant.

Police officials and officials from other sectors who have been transferred to the Military Police, depending on their merit and ability, may be granted the rank of second lieutenant or a higher rank.

Article 4

Regarding the granting of ranks, promotion, or demotion of Military Police officers, it is now stipulated as follows:

a) Granting of ranks from senior colonel upwards is regulated as for corresponding ranks in the People's Army; granting of ranks from major downwards is decided by the Minister of Public Security;

b) Promotion to ranks from senior colonel upwards is regulated as for corresponding ranks in the People's Army; promotion to ranks of major, lieutenant colonel, and colonel is decided by the Minister of Public Security; promotion to ranks of captain and senior lieutenant is decided by the Commander and Political Commissar of the Military Police Command;

c) The authority that grants promotion to a certain rank also has the authority to demote from that rank.

Article 5

Each time an officer is promoted or demoted, generally only one rank is affected.

In special cases requiring promotion beyond one rank to ranks from senior colonel upwards, it is regulated as for corresponding ranks in the People's Army; from second lieutenant to colonel, it is decided by the Minister of Public Security.

In cases where multiple ranks need to be demoted, from senior colonel upwards, it is regulated as for corresponding ranks in the People's Army; from colonel downwards, it is decided by the Minister of Public Security.

Article 6

The standards and minimum years of service for Military Police officers in active duty to consider for promotion are regulated as for corresponding ranks in the People's Army.

The period of study at military, political, and vocational schools is counted towards the years of service for promotion of Military Police officers.

Each rank of Military Police officer corresponds to a corresponding position in the Military Police establishment, as prescribed by the Council of Ministers.

Article 8

Regarding the appointment, demotion, and dismissal of Military Police officers, it is now stipulated as follows:

a) For positions equivalent to ranks from senior colonel upwards, it is regulated as for corresponding ranks in the People's Army;

b) For positions equivalent to ranks from colonel downwards, it is decided by the Minister of Public Security.

The Minister of Public Security may delegate authority to the Commander and Political Commissar of the Military Police Command to decide on positions equivalent to ranks from major downwards.

Article 9

In emergency situations, unit commanders from major upwards have the authority to decide to suspend the duties of officers under their command two ranks below and appoint replacements, while immediately reporting to superiors for review.

Article 10

The conditions for armed People's Police officers on active duty to be discharged from service, transferred to reserve rank, or removed from reserve rank shall be in accordance with the conditions stipulated for armed People's Army officers; specifically, the age condition shall be as provided in Article 13 of this Ordinance.

Article 11

Regarding the approval for armed People's Police officers to be discharged from service, transferred to reserve rank, or removed from reserve rank, the following provisions are hereby established:

a) For officers at the rank of Senior Colonel and above, the provisions applicable to officers of equivalent rank in the People's Army shall apply;

b) For officers at the ranks of Major, Lieutenant Colonel, and Colonel, the decision shall be made by the Minister of Public Security;

c) For officers at the ranks of Second Lieutenant, Lieutenant, and Captain, the decision shall be made by the Commander and Political Commissar of the Armed People's Police Command.

Article 12

Reserve armed People's Police officers will register in the common reserve system of the Ministry of National Defence. The Ministry of National Defence shall be responsible for their military training and education. The Ministry of Public Security shall be responsible for their professional training and education, and shall decide on their employment, promotion, and disciplinary matters.

Reserve armed People's Police officers have the duty to participate in military and professional training courses as prescribed by the Ministry of National Defence and the Ministry of Public Security.

Depending on work requirements, during peacetime, reserve armed People's Police officers may be called up for active duty upon orders of the Minister of Public Security or by commanders authorized by the Minister of Public Security.

Article 13

The maximum age limit for service for armed People's Police officers on active duty, first reserve category, and second reserve category is specified as follows:

Depending on the needs of the Armed People's Police, the Minister of Public Security has the authority to extend the service period of each armed People's Police officer at the rank of Major General and below; for Lieutenant Generals, the extension of service period shall be decided by the Prime Minister based on the proposal of the Minister of Public Security.

This Ordinance was adopted by the Standing Committee of the National Assembly of the Democratic Republic of Vietnam on August 9, 1961.
