Pursuant to Decree No. 90/2002/NĐ-CP dated November 11, 2002 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Posts and Telecommunications;

Pursuant to Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and postal and telecommunications tariff management;

Pursuant to Circular No. 03/1999/TT-TCBĐ dated May 11, 1999 of the General Post Office guiding the implementation of Decree No. 109/1997/NĐ-CP dated November 12, 1997 of the Government on Postal Services and Telecommunications and Decision No. 99/1998/QĐ-TTg dated May 26, 1998 of the Prime Minister on price and postal and telecommunications service charges;

At the proposal of the Director of the Department of Planning and Finance.

DECISION:

Clause 4 of Article 6Issuing the GSM Postpaid Mobile Service Charge Table (attached charge table).

Article 2This Decision shall take effect from April 1, 2003. All previous regulations contrary to this Decision are hereby abolished.

Article 3.The Director of the Office, Heads of the Planning and Finance Department, Heads of units under the Ministry of Posts and Telecommunications; telecommunications service providers and related units are responsible for implementing this Decision.

POST-PAY GSM MOBILE INFORMATION RATES

I- CHARGE TABLE

II- SPECIFIC PROVISIONS

1- Network connection fee

- One-time fee including SIM card.

2- Monthly subscription charges

2.1- Charged monthly

2.2- For new customers signing up for service or terminating their contracts before the end of the month, the monthly subscription fee for that month shall be calculated as follows:

Monthly subscription charge = X Number of days used in the month

- Number of days used in the month:

+ For new customers signing up for service: the number of days used in the month is counted from the date the customer signs the usage contract until the end of the month.

+ For customers terminating their contracts: the number of days used in the month is counted from the first day of the month to the last day the termination contract becomes effective.

2.3- For one-way mobile phone subscribers, the monthly subscription charge is 72,727 VND/unit-month.

3- Information charges

3.1- Charges specified in items 3.1 and 3.2 of the charge table apply to:

- Postpaid mobile phone subscribers calling postpaid mobile phone subscribers, fixed-line subscribers, CDMA technology mobile phone subscribers, Calling, Mobilenet network mobile phone subscribers, and vice versa.

- Postpaid mobile phone subscribers calling prepaid mobile phone subscribers, daily prepaid mobile phone subscribers.

3.2- Tariff zones are defined as follows:

- Zone 1: includes provinces from the northern region to Quang Binh province

- Zone 3: includes provinces and cities: Quang Tri, Thua Thien-Hue, Da Nang, Quang Nam, Quang Ngai, Binh Dinh, Phu Yen, Khanh Hoa, Gia Lai, Kon Tum, and Dak Lak.

- Zone 2: includes provinces and cities outside Zones 1 and 3.

- Intra-zone charges are calculated for calls within each zone.

- Inter-zone charges are calculated for calls between zones:

+ From Zone 1 to Zone 2, Zone 3 and vice versa.

+ From Zone 2 to Zone 3 and vice versa.

3.3- The unit of charge is minutes, any fraction of the last minute of the call is rounded up to one minute. Calls less than one minute are charged as one minute.

3.4- International calls from mobile phone subscribers: are charged at the intra-zone mobile service charge plus international telephone charges according to the current international telephone charge table (1,636 VND/min + IDD charge).

3.5- Charges for calls made from public points (post offices, agents, commune post and culture centers, payphone stations) to mobile phones are calculated and charged based on the tariff zone registered by the mobile phone subscriber.

3.6- At public points, in addition to the communication charges specified in point 3.5 of this article, service providers may charge additional service fees. The level of additional service fees is determined by the service provider.

4- Reduced charges based on time of day usage:

4.1- A 30% reduction in mobile service charges for calls:

- From 11 PM the previous day to 1 AM the next day and from 5 AM to 7 AM every day of the week.

- From after 7 AM to before 11 PM on holidays and Sundays.

4.2- A 50% reduction in mobile service charges for calls from after 1 AM to before 5 AM every day of the week.

4.3- International calls from mobile phone subscribers, in addition to the mobile service charge reductions as specified in items 4.1 and 4.2 above, the reduction in international telephone charges is applied according to current regulations.

4.4- The reduction in charges for calls to mobile phones at public points (post offices, agents, commune post and culture centers, payphone stations) from 11 PM the previous day to 7 AM the next day, during holidays and Sundays, is determined by the service provider. The reduction rate does not exceed 30% of the charge specified in Item 3 of the Postpaid GSM Mobile Service Charge Table of this Decision.

5- The charges specified in the above charge table do not include value-added tax.

6- This mobile service charge table applies uniformly to all postpaid GSM mobile subscribers nationwide.

7- Mobile service charges are collected from the calling party.
