Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the State Enterprise Law dated November 26, 2003;

Pursuant to the Enterprise Law dated June 26, 1999;

Pursuant to the Government Decree No. 170/2004/NĐ-CP dated September 22, 2004 on the restructuring, renovation, and development of state-owned farms;

Pursuant to the Decision No. 155/2004/QĐ-TTg dated August 24, 2004 of the Prime Minister on issuing criteria and classification lists for state-owned companies and independent accounting subsidiaries under state-owned corporations;

Considering the proposal of the Board of Directors of the Vietnam Coffee Corporation

Pursuant to …;

Article 1. Approves the overall restructuring and renovation plan for the Vietnam Coffee Corporation for the period 2006-2010 as attached in the appendix.

Article 2

1. The Board of Directors of the Vietnam Coffee Corporation shall be responsible for directing the implementation of the restructuring and renovation of subordinate state-owned enterprises according to the approved content and schedule. Any adjustment or supplementation to the plan must be approved by The Prime Minister.

Developing the plan for the shareholding transformation of Farm 716 to submit to the Prime Minister.

2. The Ministry of Finance shall propose a supplementary capital increase plan for the Vietnam Coffee Corporation Office, handle debts of farms undergoing restructuring and conversion according to current regulations; report report to the Prime Minister any issues arising during the implementation process.

3. The Ministry of Agriculture and Rural Development shall issue decisions to dissolve farms in accordance with current regulations.

4. The Ministries of Finance, Planning and Investment, Home Affairs, Labor - Invalids and Social Affairs, Agriculture and Rural Development, and related agencies shall be responsible for coordinating with the Vietnam Coffee Corporation in implementing the above plan.

The Steering Committee for Enterprise Renovation and Development shall be responsible for urging, guiding, and monitoring the implementation of this plan, and at the same time recommending solutions to the Prime Minister to address difficulties encountered during implementation.

Article 3. This Decision shall take effect 15 days from the date of publication in the Official Gazette.

The Board of Directors of the Vietnam Coffee Corporation and the heads of related agencies are responsible for enforcing this Decision./.
