Regarding the issuance of the "Supplementary List of Crop Varieties and Fertilizers Permitted for Production, Business, and Use in Vietnam"

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Product Quality and Goods dated November 21, 2007;
Pursuant to Ordinance No. 15/2004/PL-UBTVQH dated March 24, 2004 on Crop Varieties;
Pursuant to Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing the implementation of certain provisions of the Law on Product Quality and Goods;
Pursuant to Circular No. 36/2010/TT-BNNPTNT dated June 24, 2010 of the Minister of Agriculture and Rural Development on the issuance of regulations on fertilizer production, business, and use;
The Ministry of Agriculture and Rural Development hereby issues the Supplementary List of Crop Varieties and Fertilizers Permitted for Production, Business, and Use in Vietnam,
Article 1. Issued together with this Circular
1. The Supplementary List of Crop Varieties Permitted for Production and Business in Vietnam includes: 01 hybrid rice variety, 01 soybean variety (Annex 01 attached).
2. The Supplementary List of Fertilizers Permitted for Production, Business, and Use in Vietnam includes:
a) The Supplementary List of Fertilizer Types Permitted for Production, Business, and Use in Vietnam (including fertilizers recognized according to Decision No. 57/QĐ-TT-ĐPB dated March 24, 2010 and Decision No. 61a/QĐ-TT-ĐPB dated March 26, 2010 of the Director of the Crop Cultivation Department; Fertilizers re-registered from the Fertilizer List issued with Decision No. 40/2004/QĐ-BNN dated August 19, 2009 of the Minister of Agriculture and Rural Development) (Annex 02 attached) including 460 types, divided into:
Organic Fertilizers: 12 types;
Microbial Fertilizers: 02 types;
Organic-Microbial Fertilizers: 53 types;
Bioorganic Fertilizers: 70 types;
Mineral-Organic Fertilizers: 71 types;
Foliar Fertilizers: 246 types;
Growing Media: 06 types.
b) The List of Fertilizer Types Replacing Fertilizer Types Already Named in the Fertilizer List Permitted for Production, Business, and Use in Vietnam but with Adjustments in Fertilizer Name, Composition, Content of Registered Substances, and Registration Units (Annex 03 attached) including 93 types, divided into:
Organic-Microbial Fertilizers: 09 types;
Bioorganic Fertilizers: 11 types;
Mineral-Organic Fertilizers: 10 types;
Foliar Fertilizers: 63 types;
Article 2. Attached to this Circular is the List of Fertilizer Types Removed from the Fertilizer List Permitted for Production, Business, and Use in Vietnam (Annex 04 attached) including 02 mineral fertilizer types.
Article 3. Organizations and individuals are permitted to produce, trade, and use the fertilizer types specified in Clause 2, Article 1 when they meet the conditions stipulated in Article 5 of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use; stipulated in Clause 4, Article 1 of Decree No. 191/2007/NĐ-CP dated December 31, 2007 of the Government amending and supplementing certain articles of Decree No. 113/2003/NĐ-CP dated October 7, 2003 of the Government on the management of fertilizer production, business, and use.
Article 4. This Circular shall take effect 45 days from the date of issuance.
Article 5. The Head of the Ministry's Office, the Director of the Crop Cultivation Department, the Director of the Science and Technology and Environment Department, the Directors of the Departments of Agriculture and Rural Development of provinces and centrally-administered cities, the Heads of units, organizations, and individuals related to the production, business, and use of crop varieties and fertilizers in Vietnam are responsible for implementing this Circular./.
