Decree No. 49/2011/NĐ-CP amends Article 11 of Decree No. 173/2007/NĐ-CP on the organization and operation of marine pilots

DECREE

Amending and supplementing Article 11 of Decree No. 173/2007/NĐ-CP

dated November 28, 2007 of the Government on the organization

and operation of marine pilots

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to the Enterprise Law dated November 29, 2005;

Upon the proposal of the Minister of Transport,

DECREE

Article 1. Amending and supplementing Article 11 of Decree No. 173/2007/NĐ-CP dated November 28, 2007 of the Government on the organization and operation of marine pilots as follows:

"Article 11. Financial mechanism for the activities of marine pilots.
1. Pilotage fees are revenue belonging to the State budget. Pilot companies directly collect pilotage fees.
2. The funds for paying pilotage services are derived from pilotage fee revenues and supplemented from the State budget.
3. The Ministry of Transport shall be responsible for establishing and promulgating economic and technical norms for pilotage services and organizing the implementation of orders for supplying pilotage services throughout the country.
4. The Ministry of Finance shall take the lead and coordinate with the Ministry of Transport to guide the ordering mechanism for supplying pilotage services, management regulations for collection, payment, and use of pilotage fees in accordance with laws on fees and charges, and in line with the actual situation regarding the organization and operation of marine pilots."

Article 2. Effective Date

This Decree takes effect from September 1, 2011.

Article 3. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees under central cities, Directors of the Vietnam Maritime Administration, and related agencies, organizations, and individuals are responsible for implementing this Decree.
