CIRCULAR

DETAILING AND GUIDING THE DOCUMENTS AND PROCEDURES FOR ISSUING, RENEWING, REPLACING, AND REVOKING JOURNALIST CARDS

 

Pursuant to the Social Insurance LawJune 2024;o ch"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation." The Minister of Information and Communications issues this Circular detailing and guiding the documents and procedures for issuing, renewing, replacing, and revoking journalist cards.ướThis Circular details and guides the documents and procedures for issuing, renewing, replacing, and revoking journalist cards as prescribed in Article 28 of the Press Law. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. Time for Issuing Journalist Cards

Annually, the Ministry of Information and Communications will issue journalist cards in two (02) rounds, with the issuance dates being January 1 and June 21.

The validity period of a journalist card is five (05) years. The Ministry of Information and Communications will review and issue new cards on January 1 of the year marking the start of a new validity period. The current validity period of journalist cards runs from January 1, 2016.

Article 3. Issuance of press cards with new terms

Chapter II

Dossier, Procedures for Issuing, Renewing, Reissuing, and Revoking Press Cards

The application documents include:

1. A registration form for issuing a journalist card filled out by the applicant according to the model; approved and stamped by the head of the applying agency (Model No. 1);

2. A certified copy of the bachelor's or associate degree (for cases as stipulated in point b, Clause 1, Article 27 of the Press Law) certified by the competent state authority (for first-time issuance);

3. A certified copy of the employment decision, labor contract, and other related documents proving at least two (02) consecutive years of work at the applying news agency or at county-level radio and television stations and equivalent (for first-time issuance), confirmed by the news agency or certified by the competent state authority;

4. A list of press works for cases as stipulated in Clause 5 and Clause 6, Article 26 of the Press Law (Model No. 2);

5. An aggregated list of applications for issuing journalist cards signed and stamped for confirmation by the head of the applying agency (Model No. 3).

Article 5. Procedures for Reviewing Applications for Issuing Journalist Cards

1. The head of the applying agency reviews the applications for issuing journalist cards for those meeting the criteria and conditions within their agency and is responsible for the entire application package.

2. The applying agency submits the application package for issuing journalist cards (including both electronic forms Model No. 1 and Model No. 3) before November 1 and April 21 each year, and 120 days prior to the expiration date indicated on the card to the following agencies:

a) The Press Agency (Ministry of Information and Communications) for applicants from print media, online media, state management agencies for press, press associations at all levels, and journalism faculty members;

3. The Ministry of Information and Communications only considers valid applications and lists for issuing journalist cards.

b) The Radio, Television, and Electronic Information Department (Ministry of Information and Communications) for entities operating in the radio and television sector.

4. The Ministry of Information and Communications directly presents the cards to central news agencies and transfers journalist cards to provincial Departments of Information and Communications for distribution to provincial and centrally-administered city news agencies. News agencies organize the presentation of journalist cards to those who have been issued them, simultaneously disseminating regulations on the rights and obligations of journalists, regulations on using journalist cards, and ethical guidelines for journalism to enhance the professional responsibility of those issued journalist cards.

4. The Ministry of Information and Communications shall directly issue press cards to representatives of central news agencies and transfer journalist cards to Provincial Departments of Information and Communications for issuance to news agencies in provinces and centrally-administered cities. News agencies shall organize the issuance of journalist cards to those who have been issued such cards, and at the same time disseminate regulations on the rights and obligations of journalists, regulations on the use of journalist cards, and ethical guidelines for journalism to enhance the professional responsibility of those holding journalist cards.

Article 6. Replacement of Journalist Card

1. A person who has been issued a journalist card and transfers to work at another agency or unit that still falls within the category eligible for issuance of a journalist card under Article 26 of the Press Law shall be required to process the replacement of the journalist card with the new agency.

2. The application dossier for replacing the journalist card includes:

a) A letter requesting replacement from the agency or unit where the applicant will transfer to work;

b) A certified copy of the decision on employment acceptance or labor contract issued by the competent state agency;

c) A certified copy of the journalist card previously issued by the agency or unit before the job transfer;

d) A document from the agency or unit before the job transfer confirming that the applicant for the replacement of the journalist card does not fall under one or more of the cases stipulated in points a, b, c, d, and đ of Clause 3, Article 27 of the Press Law;

đ) A list of published press works (Model No. 2).

3. The application dossier for replacing the journalist card shall be submitted to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular).

4. Within thirty (30) days from the date of receipt of a valid dossier, the Ministry of Information and Communications shall examine and replace the journalist card.

5. The person whose journalist card is replaced and belongs to a central agency or unit shall be responsible for returning the journalist card previously issued by the agency or unit before the job transfer to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular). The person whose journalist card is replaced and belongs to an agency or unit in provinces or centrally-administered cities shall be responsible for returning the journalist card previously issued by the agency or unit before the job transfer to the Department of Information and Communications for submission to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular).

Article 7. Reissue of Journalist Card

1. A person who has been issued a journalist card but lost or damaged it and wishes to have it reissued must submit an application to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular).

2. The application for reissuing a journalist card must include confirmation from the press agency or working agency and a report of loss confirmed by the police station, commune, ward where the card was lost regarding the case of loss; in the case of damage, the old card must be attached.

3. Within thirty (30) days from the date of receipt of a valid dossier, the Ministry of Information and Communications shall examine and reissue the journalist card.

Article 8. Revocation of Journalist Card

1. For cases of revocation of the journalist card as prescribed in Clause 6, Article 28 of the Press Law, the Minister of Information and Communications shall issue a decision to revoke the journalist card.

2. Within fifteen (15) days from the date of the decision to revoke the journalist card, the head of the press agency or the head of the agency or unit of the person whose journalist card is revoked shall be responsible for collecting the journalist card of the person whose card is revoked and submitting it to the Ministry of Information and Communications. Central press agencies shall submit directly to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular). Provincial and centrally-administered city press agencies shall submit to the Department of Information and Communications for submission to the Ministry of Information and Communications (agencies specified in Clause 2, Article 5 of this Circular).

3. For the case prescribed in point b, Clause 6, Article 28 of the Press Law, the Ministry of Information and Communications shall return the revoked journalist card upon receipt of:

a) A request for return of the journalist card from the press agency or agency of the person whose journalist card is revoked as stipulated in Clause 2, Article 8 of this Circular;

b) Documentation proving that the journalist whose card was revoked has been suspended from investigation or prosecution by the competent authority; judgment or decision of the court with legal effect declaring that journalist innocent or exempt from criminal responsibility.

Chapter III

IMPLEMENTATION

Article 9. Effective Date

1. This Circular takes effect from February 15, 2017.

2. Circular No. 07/2007/TT-BVHTT dated March 20, 2007 of the Ministry of Culture, Sports and Tourism guiding the issuance, replacement, and revocation of journalist cards becomes invalid from the date this Circular takes effect.
