Pursuant to the Road Traffic Law dated June 13,January 1,1, 2008;

Article 1. Scope of Regulation
This Circular stipulates on:
Article 1. Emergency activities for traffic accidents on expressways include: initial first aid, emergency care, patient care, and transportation of individuals involved in traffic accidents on expressways.
Article 2. Organization of networks of facilities serving emergency activities for traffic accidents on expressways in localities where expressways pass through.
Article 2. Principles of emergency activities for traffic accidents
1. Ensuring prompt, timely, and effective emergency activities for traffic accidents to promptly transport victims to the nearest medical examination and treatment facility.
2. Adhering strictly to medical and technical procedures in emergency care for traffic accident victims.
3. Ensuring close coordination among agencies, organizations, units, and individuals responsible for emergency care of traffic accident victims.
Article 3. Network of medical examination and treatment facilities implementing emergency activities for traffic accidents on expressways
The network of facilities serving rescue operations on expressways includes emergency stations on expressways organized as follows:
1. Emergency stations are integrated with existing medical examination and treatment facilities along the expressway route, including: commune/ward health stations, district/hospital centers with medical examination and treatment functions, 115 emergency centers, state hospitals, and private hospitals.
2. Location: At least one emergency station must be located every 50 kilometers of expressway.
Article 4. Content of emergency activities
1. The provincial/municipal Department of Health where the expressway passes through shall compile a list of medical examination and treatment facilities that meet the conditions for providing emergency care for traffic accidents and submit it to the Traffic Management Center and medical examination and treatment facilities for coordination and implementation of emergency care for traffic accidents.
2. In case of a traffic accident, the Traffic Management Center shall immediately notify the name, age, address (if available), and a brief description of the condition of the traffic accident victim to the medical examination and treatment facility selected by the Center from the list of medical examination and treatment facilities to provide emergency care.
3. The Traffic Management Center shall immediately hand over the traffic accident victim at the accident scene on the expressway to the medical examination and treatment facility.
4. The medical examination and treatment facility shall provide initial care and emergency care for traffic accident victims according to the Emergency Care, Intensive Care, and Antidote Regulation issued together with Decision No. 01/2008/QĐ-BYT dated January 21, 2008 of the Minister of Health.
5. The medical examination and treatment facility shall immediately transfer the patient to another suitable healthcare facility if the current facility exceeds its capacity after providing initial care and emergency care.
Article 5. Duties of emergency stations on expressways
1. Medical examination and treatment facilities shall provide initial care and emergency services to traffic accident victims in accordance with the Emergency Care, Intensive Care, and Antidote Regulations issued together with Decision No. 01/2008/QĐ-BYT dated January 21, 2008, of the Minister of Health.
2. Medical examination and treatment facilities with emergency stations shall report periodically every six months or report promptly on the operation of traffic accident emergency services on expressways to the Provincial Department of Health under the Central Government.
Article 6. Responsibilities of medical examination and treatment facilities receiving traffic accident victims
1. Medical examination and treatment facilities, depending on the scope of specialized technical activities approved by the competent authority, shall be responsible for organizing timely initial care, emergency services, medical examinations, and treatments for traffic accident victims.
2. In cases where the scope of specialized technical activities exceeds their capacity, the facility must transfer patients to another medical examination and treatment facility with appropriate expertise for treatment. In such cases, the medical examination and treatment facility still has to perform initial care, emergency services, monitoring, care, and treatment of traffic accident victims until they are transferred to another medical examination and treatment facility.
Article 7. Costs for traffic accident emergency services
1. For traffic accident victims with health insurance cards, transportation costs, initial care, and emergency services shall be implemented according to the provisions stipulated in Circular No. 40/2015/TT-BYT dated November 16, 2015, of the Minister of Health regarding registration for medical examination and treatment under health insurance.
2. For traffic accident victims without health insurance cards, healthcare facilities must still perform initial care, emergency services, and treatment for traffic accident victims. After providing initial care and emergency services to traffic accident victims, the facility will charge transportation fees, initial care, and emergency service fees according to the service prices for medical examination and treatment approved by the competent state authorities for public medical examination and treatment facilities or the listed prices for private hospitals.
Article 8. Responsibilities of the Department of Medical Examination and Treatment - Ministry of Health
1. Serve as the coordinating body to work with related units to organize, guide, inspect, audit, and evaluate the implementation of this Circular.
2. Aggregate and report according to the provisions of this Circular.
3. Publicly post data on the network of emergency stations on expressways on the Ministry of Health's official website or the Department of Medical Examination and Treatment's website.
Article 9. Responsibilities of the Provincial Department of Health under the Central Government
1. Take the lead and coordinate with the Provincial Department of Transport under the Central Government:
a) Survey and compile a list of medical examination and treatment facilities that meet the conditions to implement traffic accident emergency services as stipulated in Clause 1, Article 4 of this Circular.
b) Unify and specify the transfer procedures for some emergency stations in border areas within the province and between provinces to ensure compatibility with the specialized technical routes, the capacity of medical examination and treatment facilities, and convenience for traffic accident victims.
2. Direct and provide technical support to medical examination and treatment facilities to carry out medical examinations and treatments in accordance with current regulations and stipulate the transfer procedures for specialized technical routes among medical examination and treatment facilities within the province, city for traffic accident victims.
3. Based on the actual conditions of the locality and the capacity of medical examination and treatment facilities, the Provincial Department of Health shall take the lead and coordinate with neighboring provincial health departments and relevant agencies to advise the People's Committee of the province where the expressway passes through to ensure at least one emergency station every 50 kilometers of expressway.
Article 10. Responsibilities of medical examination and treatment facilities
1. Implement this Circular at medical examination and treatment facilities.
2. Organize emergency stations according to the requirements of the Provincial Department of Health, complete physical infrastructure, equipment, and personnel to meet the professional requirements of emergency transfer activities.
3. Summarize and report traffic accident emergency work in accordance with the provisions of this Circular.
Article 11. Effective Date
This Circular takes effect from March 1, 2017.
Article 12. Cross-referencing Provisions
In cases where the referenced documents in this document are replaced or amended, implementation shall be in accordance with the replacement or amended document.
Article 13. Responsibility for Implementation
The Director of the Medical Examination and Treatment Management Department, the Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, Directors of Bureaus, and General Directors of the relevant Departments, Bureaus, and General Departments under the Ministry of Health, the Directors of Provincial Health Departments, the Heads of Health Services of sectors, and the Heads of related agencies and organizations are responsible for implementing this Circular. In the course of implementation, if there are difficulties or obstacles, it is recommended that agencies, organizations, and individuals promptly reflect these issues to the Ministry of Health (Medical Examination and Treatment Management Department) for consideration and resolution.
