Establishing and Approving the Charter on Organization and Operation of the Tourism Development Support Fund

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Tourism Law dated June 19, 2017;

Pursuant to the State Budget Law dated June 25, 2015;

Pursuant to the Enterprise Law dated November 26, 2014;

Pursuant to Decree No. 168/2017/NĐ-CP dated December 31, 2017 of the Government detailing certain provisions of the Tourism Law;

At the proposal of the Minister of Culture, Sports and Tourism;

The Prime Minister issues this Decision to establish and approve the Charter on organization and operation of the Tourism Development Support Fund.

Article 1. Establishment of the Tourism Development Support Fund

The Tourism Development Support Fund (hereinafter referred to as the Fund) shall be established under the Ministry of Culture, Sports and Tourism.

Article 2. Charter on Organization and Operation of the Fund

Approve and promulgate along with this Decision the Charter on organization and operation of the Fund.

Article 3. Transitional Provisions

1. The National Tourism Promotion Program approved by Decision No. 2151/QĐ-TTg dated November 11, 2013 and the National Action Program on Tourism approved by Decision No. 321/QĐ-TTg dated February 18, 2013 of the Prime Minister shall continue to be implemented until the legal documents stipulating the organizational structure, administrative apparatus, financial mechanism, and accounting system of the Fund are issued by competent authorities, and the initial registered capital and operating budget of the Fund are provided by the state budget.

2. The tasks under the National Tourism Promotion Program and the National Action Program on Tourism that have been approved by competent authorities and are currently being implemented shall be funded by the Fund to continue their implementation after the completion of these two Programs.

3. In case there is surplus funding from the National Tourism Promotion Program and the National Action Program on Tourism, such surplus shall be transferred to the Fund to implement the contents and tasks of the Fund as prescribed and counted towards the first-year operating budget of the Fund provided by the state budget.

Article 4. Implementation provisions

1. This Decision takes effect from February 1, 2019.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and municipal People's Committees directly under the central government, and related organizations and individuals are responsible for implementing this Decision./.
