CIRCULAR
Amending and supplementing certain Articles of Circular No. 35/2012/TT-BGTVTdated September 6, 2012 issued by the Minister of Transport on the installation of kilometer markers - place names and the method of recording symbols and serial numberson inland waterway signs
Pursuant to the Law on Inland Waterway Traffic Management dated June 15, 2004; the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic Management Pursuant to Decree No. 45/2018/ND-CP dated March 13, 2018 of the Government on management, use, and exploitation of infrastructure assets of inland waterway transport;

The Minister of Transport hereby issues this Circular. amends and supplements certain provisions of Circular Circular No. 35/2012/TT-BGTVT dated September 6, 2012 issued by the Minister of Transport on the installation of kilometer markers - place names and the method of recording symbols and serial numbers on inland waterway signs.
Article 1. Amend and supplement some articles of Circular No. 35/2012/TT-BGTVT dated September 6, 2012 issued by the Minister of Transport on the installation of kilometer markers - place names and the method of recording symbols and serial numbers on inland waterway signs (hereinafter referred to as Circular No. 35/2012/TT-BGTVT dated September 6, 2012).
1. Market management agencies at all levels include: the Department of Domestic Market Management and Development under the Ministry of Industry and Trade; the Market Management Business Unit under the Department of Domestic Market Management and Development; the Market Management Sub-department under the Department of Industry and Trade of provinces and centrally-administered cities; and the Market Management Team under the Market Management Sub-department.
"Article 2. Applicability
This Circular applies to agencies, organizations, and individuals related to the management, maintenance, and exploitation of inland waterway signs.
2. Add Points e, g, h of Clause 2, Article 4 as follows:
"e) Determine the starting point, end point, and intersection points between inland waterway routes using place names and simultaneously two coordinate systems, including the national coordinate system VN2000 and the global geodetic coordinate system WGS84;
g) The Vietnam Inland Waterways Administration and the Provincial Department of Transport shall determine and adjust the coordinates specified in Point e of Clause 2 of this Article for inland waterway routes that have been announced and adjusted within their jurisdiction;
h) The determination of coordinates specified in Point e of Clause 2 of this Article shall be carried out during surveys of channels serving the management and operation of inland waterway routes in accordance with Circular No. 19/2016/TT-BGTVT dated June 30, 2016 issued by the Minister of Transport on channel surveys for management and announcement."
3. Amend and supplement Clause 4 of Article 5 as follows:
"4. Symbols of national inland waterway routes prescribed in Section 1 of Appendix I of this Circular. In case of adding a route, the symbol of such route shall be the next consecutive number corresponding to each region in Appendix I and specifically in the decision announcing the inland waterway channel made by the competent authority."
4. Amend and supplement Clause 2, Article 8 as follows:
"a) The background color of the sign is blue;
b) The characters on the sign, which include the name of the inland waterway, place names, and kilometers, are painted white, with specific dimensions prescribed in Appendix II of Circular No. 35/2012/TT-BGTVT dated September 6, 2012 or established electronically according to the National Technical Regulations on inland waterway signs of Vietnam;
c) The Vietnam Inland Waterways Administration and the Provincial Department of Transport are responsible for organizing the establishment of a database of kilometer markers - place names into the information management system for inland waterway infrastructure under their jurisdiction."
5. Replace Appendix I "Symbols of inland waterway routes recorded on inland waterway signs" issued together with Circular No. 35/2012/TT-BGTVT dated September 6, 2012 with Appendix I of this Circular.
6. Replace Appendix III "Sample of symbols and serial numbers recorded on inland waterway signs" issued together with Circular No. 35/2012/TT-BGTVT dated September 6, 2012 with Appendix III of this Circular.
Article 2. Effective Date
This Circular takes effect from January 1, 2019.
Article 3. Implementation Organization
The Head of the Office of the Ministry, the Inspector General, the Heads of Departments, the Director General of the Vietnam Inland Waterways Administration, the Directors of Provincial Departments of Transport of centrally governed cities and provinces, and relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
