Announcing the maritime area of the seaport and the maritime zone within the administrative boundaries of the city of Hai Phong and the management area of the Hai Phong Maritime Port Authority

Haiphong and the area under the management of the Haiphong Port Maritime Administration

On the basis of The Maritime Code of Vietnam dated November 25, 2015;

Decree No. Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of The Vietnam Maritime Code on maritime activity management and amendments to other decrees;

Decree No. Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Vietnam Maritime and Inland Waterway Administration;

The Minister of Construction issues this Circular to announce the maritime area of the seaport and the maritime zone within the administrative boundaries of the city of Hai Phong and the management area of the Hai Phong Maritime Port Authority.

Article 1. Announcing the maritime area of the seaport within the administrative boundaries of the city of Hai Phong

The maritime area of the seaport within the administrative boundaries of the city of Hai Phong, measured from the highest tidal level, includes the water areas at the Van Uoc River, Nam Do Son, Northeast of the Thai Binh River mouth, Hon Dau, Lan Ha Bay, Lac Huyen, Ha Nam Canal, Cai Trap Canal, Bach Dang River, Cam River, Gia River with the following scope:

1. The boundary towards the sea: Limited by straight lines connecting successively points HP1, HP2, HP3, and HP4 with the following coordinates:

HP1: 20°46’40,7”N, 106°48’40,2”E;

HP2: 20°37’53,4”N, 106°48’40,2”E;

HP3: 20°41’39,8”N, 106°44’34,8”E;

HP4: 20°40’33,5”N, 106°43’24,8”E;

From point HP4 running along the bank of the Van Uoc River to point HP5 with the coordinate: 20°44’43,3”N, 106°34’33,9”E (200 meters downstream from the foot of Khue Bridge);

From point HP5 running across the Van Uoc River to point HP6 with the coordinate: 20°44’29,9”N, 106°34’23,1”E (200 meters downstream from the foot of Khue Bridge);

From point HP6 running along the bank of the Van Uoc River, along the outer edge of the mangrove forest to point HP7 with the coordinate: 20°37’04,5”N, 106°40’43,8”E;

From point HP7 connecting successively points HP8, HP9, HP10, HP11, HP12, HP13, HP14, HP15, HP16, HP17, HP18 with the following coordinates:

HP8: 20°31’03,6”N, 106°45’53,2”E;

HP9: 20°31’03,6”N, 107°07’06,2”E;

HP10: 20°46’24,6”N, 107°07’06,2”E;

HP11: 20°47’00,6”N, 107°06’51,2”E (western edge of Hang Trai Island);

HP12: 20°47’00,6”N, 107°06’11,2”E (southwestern edge of Hon Ro Island);

HP13: 20°46’02,6”N, 107°06’11,2”E (southern edge of Tra Nu Islet);

HP14: 20°42’43,6”N, 107°05’19,2”E (Co Be);

HP15: 20°41’47,6”N, 107°04’06,2”E;

HP16: 20°41’32,6”N, 107°02’43,2”E (eastern edge of Hon Ga);

HP17: 20°42’26,6”N, 107°01’11,2”E (southwestern edge of Cat Ong Islet);

HP18: 20°45’33,6”N, 106°57’53,2”E (western edge of Goi Thap Cape).

2. The boundary towards the mainland:

From point HP18 continuing along the zero-meter contour line west-southwest of Cat Ba Island to point HP19 with the coordinate: 20°50’00,6”N, 106°54’17,2”E;

From point HP19 connecting successively points HP20 with the coordinate: 20°50’11,6”N, 106°52’20,2”E (western edge of Cai Trap Channel near Lac Huyen) and HP21 with the coordinate: 20°49’10,6”N, 106°50’16,2”E (end of the Cai Trap Channel bordering the Bach Dang River);

From point HP21 running along the bank of the Bach Dang River to point HP22 with the coordinate: 20°56’45,6”N, 106°46’17,2”E;

From point HP22 running across the Bach Dang River to point HP23 with the coordinate: 20°56’45,6”N, 106°45’50,2”E;

From point HP23 running along the bank of the Gia River to point HP24 with the coordinate: 20°57’07,6”N, 106°44’33,2”E;

From point HP24 running along a straight line cutting across the Gia River 200 meters downstream from the center of Minh Duc Dam to point HP25 on the bank of the Gia River with the coordinate: 20°56’53,6”N, 106°44’33,2”E;

From point HP25 running along the banks of the Gia River, Bach Dang River, and Cam River to point HP26 with the coordinate: 20°54’46,1”N, 106°37’21,3”E (200 meters downstream from the foot of Kien Bridge);

From point HP26 running across the Cam River to point HP27 with the coordinate: 20°54’45,0”N, 106°37’15,5”E (200 meters downstream from the foot of Kien Bridge);

From point HP27 running along the banks of the Cam River, Bach Dang River, the southern border of Nam Dinh Vu Industrial Zone, and the southeastern border of Dong Hai Ward to point HP1.

3. The maritime area of the seaport within the administrative boundaries of the city of Hai Phong specified in this Circular is determined on nautical charts issued by Vietnam Marine Safety Assurance Corporation, including: VN50062 and VN50063 updated in 2023; VN30001 updated in 2024; VN40001, VN30002, VN50004, VN50007, VN50008 updated in 2025. The coordinates of the points specified in this Circular are applied according to the VN-2000 Coordinate System and converted to the WGS-84 Coordinate System as detailed in the Appendix attached to this Circular.

Article 2. Maritime area within the jurisdiction of Haiphong City

The port maritime waters within the jurisdiction of Haiphong City include one maritime area: Haiphong Maritime Area.

Article 3. Management area of Haiphong Port Maritime Service

1. Haiphong Port Maritime Service manages the specialized maritime affairs at ports within the jurisdiction of Haiphong City and the maritime area specified in Article 2 of this Circular.

2. Based on actual conditions, vessels entering or leaving ports within the jurisdiction of Haiphong City but must anchor to transfer cargo before berthing at wharves within the port maritime waters of Haiphong City or after partially loading at wharves within the port maritime waters of Haiphong City in the maritime waters of Quang Ninh Province shall be arranged at the following positions:

a) For vessels carrying non-polluting and non-hazardous goods, anchoring and transferring cargo at positions with coordinates:

HL3-1: 20°50’28,1”N, 107°07’55,2”E;

HL3-5: 20°51’51,6”N, 107°06’41,7”E;

HL3-6: 20°51’59,1”N, 107°06’15,9”E.

Vessels are not permitted to load or unload bulk cargoes such as cement, clinker, wood chips, and limestone with dimensions up to 4x6 cm at points HL3-1, HL3-5, and HL3-6 mentioned above.

b) For vessels carrying polluting and hazardous goods, anchoring and transferring cargo at position HN2-21 with coordinates: 20°55’59,1”N, 107°16’38,2”E.

The arrangement of vessels entering or leaving ports within the jurisdiction of Haiphong City but must anchor to transfer cargo according to the provisions of this clause shall cease upon issuance of a decision by the competent authority.

3. Haiphong Port Maritime Service shall take the lead and coordinate with Quang Ninh Port Maritime Service to develop a cooperation regulation to implement the provisions of Clause 2 of this Article.

The Vietnam Maritime and Inland Waterway Administration shall approve the cooperation regulation for implementation based on the proposal of the Director of the Port Maritime Service and the opinions of relevant agencies and organizations.

Article 4. Implementation provisions

1. This Circular takes effect from February 1, 2026.

2. Repeal Circular No. 23/2019/TT-BGTVT dated June 21, 2019 of the Minister of Transport on announcing the port maritime waters within the jurisdiction of Haiphong City and the management area of Haiphong Port Maritime Service.

3. Repeal item number 03 in the Appendix List of Maritime Areas under the jurisdiction of the Port Maritime Service issued together with Circular No. 32/2019/TT-BGTVT dated September 4, 2019 of the Minister of Transport announcing the List of Maritime Areas under the jurisdiction of the Port Maritime Service.
