CIRCULAR

Amending and supplementing certain articles of Circular No. 02/2024/TT-BYT dated March 12, 2024 of the Minister of Health on issuing certificates for traditional medical practitioners, certificates for individuals with traditional herbal prescriptions, certificates for individuals with traditional treatment methods, and combining traditional medicine with modern medicine at healthcare facilities

Pursuant to the Law on Medical Examination and Treatment No. 15/2023/QH15;

Pursuant to the Government's Decree No. 96/2023/NĐ-CP dated December 30, 2023 detailing certain provisions of the Law on Medical Examination and Treatment;

Pursuant to the Government's Decree No. 42/2025/NĐ-CP dated February 27, 2025 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Upon the proposal of the Director of the Department of Traditional Medicine and Pharmaceutical Management;

The Minister of Health promulgates this Circular amending and supplementing certain articles of Circular No. 02/2024/TT-BYT dated March 12, 2024 of the Minister of Health on issuing certificates for traditional medical practitioners, certificates for individuals with traditional herbal prescriptions, certificates for individuals with traditional treatment methods, and combining traditional medicine with modern medicine at healthcare facilities.

Article 1. Amending and supplementing certain articles of Circular No. 02/2024/TT-BYT dated March 12, 2024 of the Minister of Health on issuing certificates for traditional medical practitioners, certificates for individuals with traditional herbal prescriptions, certificates for individuals with traditional treatment methods, and combining traditional medicine with modern medicine at healthcare facilities

1. Amending and supplementing Clause 2 of Article 11 as follows:

"2. Procedures for handling:

a) After receiving the dossier, the department responsible for receiving dossiers shall issue a receipt according to Model No. 02 of Appendix I attached hereto.

In case the dossier is not valid, within five working days from the date recorded on the receipt, the competent authority must notify the person submitting the dossier to request supplements.

b) Within seven working days from the date of receiving a valid dossier, the Secretariat of the Examination Board must review the dossier:

- If the conditions are met, the Secretariat will prepare a list to be submitted to the Board.

- If the conditions are not met, it will report to the competent authority to notify the person submitting the dossier in writing and specify the reasons.

c) Within five working days from the date of receiving the list from the Secretariat, the Examination Board must convene a meeting to handle:

- If the conditions for examination and assessment are met, the competent authority specified in Article 3 of this Circular must develop a plan, organize the examination, and score.

- If the conditions for issuing a certificate for a traditional medical practitioner are not met or if the conditions for examination and assessment are not met, it will report to the competent authority to notify the person submitting the dossier in writing and specify the reasons.

d) Within three working days from the date of the examination and assessment:

- If the examination and assessment results are satisfactory, the Secretariat will submit to the competent authority as stipulated in Article 3 of this Circular to issue a certificate for a traditional medical practitioner.

- If the examination and assessment results are unsatisfactory, there must be a written notification of the examination and assessment results to each individual.".

2. Amending and supplementing Point b of Clause 2 of Article 12 as follows:

"b) Within five working days from the date of receiving a valid dossier, the competent authority shall issue a certificate for a traditional medical practitioner to the person submitting the dossier as prescribed.".

3. Amending and supplementing Clause 3 of Article 13 as follows:

"3. Within five working days from the date of receiving a valid dossier, the department responsible for receiving dossiers must issue a new certificate for a traditional medical practitioner to the person submitting the dossier as prescribed.".

4. Amending and supplementing Clause 4 of Article 23 as follows:

"4. Within five working days from the date of the minutes of the Appraisal Board meeting, the competent authority shall issue a certificate according to Model No. 04 of Appendix II attached hereto or issue a document refusing to issue a certificate and specify the reasons for refusal.".

5. Amending and supplementing Clause 3 of Article 24 as follows:

"3. Within five working days from the date of receiving a valid dossier requesting a new certificate for an individual with a traditional herbal prescription or a traditional treatment method, the department responsible for receiving dossiers must issue a new certificate for an individual with a traditional herbal prescription or a traditional treatment method to the person requesting it.".

Article 2. Effectiveness

1. This Circular takes effect from the date of issuance.

2. For dossiers submitted before the effective date of this Circular, the departments responsible for receiving dossiers shall continue to process them according to current regulations until the administrative procedures are completed.

During implementation, if there are difficulties or obstacles, please reflect them to the Ministry of Health (Department of Traditional Medicine and Pharmaceutical Management) for consideration and resolution./.
