Regulations on Detailed Implementation of Certain Provisions of the Law on the Vietnam Fatherland Front

Based on the Government Organization Law dated September 30, 1992;
Based on the Law on the Vietnam Fatherland Front dated June 12, 1999;
At the proposal of the Minister of Justice, after reaching consensus with the Standing Board of the Central Committee of the Vietnam Fatherland Front,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. Scope and Objects Regulated by this Decree
This Decree stipulates detailed implementation of certain provisions of the Law on the Vietnam Fatherland Front regarding the responsibilities of the Government, Ministries, ministerial-level agencies, agencies under the Government, People's Councils, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).People's Committees at all levels (hereinafter referred to collectively as state agencies) in coordinating with the Vietnam Fatherland Front to enable the Vietnam Fatherland Front to exercise its rights and responsibilities, to play its role as the political foundation of people's administration; and to specify conditions for ensuring the activities of the Vietnam Fatherland Front.
Article 2. Relationship between State Agencies and the Vietnam Fatherland Front
1. 2. State agencies closely cooperate and rely on the Vietnam Fatherland Front when performing their duties and powers.

Article 3. Rules for Cooperation
1. 2. Ministries, ministerial-level agencies, agencies under the Government cooperate with the Standing Board of the Central Committee Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Central Committee of the Vietnam Fatherland Front to promulgate rules for cooperation.

Article 4. Responsibilities of State Agencies in Ensuring the Activities of the Vietnam Fatherland Front
Within the scope of their tasks and powers, state agencies are responsible for ensuring financial resources, material infrastructure, and other necessary conditions for the activities of the Vietnam Fatherland Front at all levels.
Chapter II
COOPERATION BETWEEN STATE AGENCIES
AND THE VIETNAM FATHERLAND FRONT IN THE IMPLEMENTATION
OF THE RIGHTS AND RESPONSIBILITIES OF THE VIETNAM FATHERLAND FRONT
Article 5. On Gathering the Great Unity Solidarity of the Entire People
1. State agencies, based on their functions, tasks, and powers, participate with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front at the same level in formulating plans and programs to develop diverse forms of gathering various strata of the people to join patriotic movements, uniting all Vietnamese both inside and outside the country to mobilize all resources for building and defending the Socialist Republic of Vietnam.
2. State agencies propose plans to participate with the Standing Board Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of the Vietnam Fatherland Front at all levels so that the Vietnam Fatherland Front can gather and promote the roles of outstanding individuals from various classes, social strata, ethnic groups, and religions in mobilizing the people to fulfill national political, economic, social, security, defense, and foreign affairs tasks.
3. The Ministry of Foreign Affairs, the Ministry of Public Security, the Ministry of Culture, Sports and Tourism, the Ministry of Education and Training, and related ministries and sectors, People's Councils, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).People's Committees at all levels coordinate and create conditions for Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front, member organizations of the Front at all levels to participate in propaganda and mobilization of overseas Vietnamese through appropriate methods and forms to build the great unity solidarity of the entire people, help each other in life, preserve cultural identity, fine traditions of the nation, respect the laws of the host countries, maintain close ties with families and hometowns, contribute to building the homeland and the country.
Article 6. On Propaganda and Mobilization Activities
1. State agencies within their functions, tasks, and powers shall be responsible for coordinating with the Vietnam Fatherland Front Committee at the same level and its member organizations to develop programs for propaganda, education, and mobilization of the people to implement the Party's guidelines and policies and the State's laws; organize campaigns and patriotic movements, mobilize the people to unite and support each other in economic development, build new lives in residential areas, construct cultural lifestyles, address social issues, build a whole-of-the-people national defense, maintain political security, public order, and social safety. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. State agencies shall provide opinions on the objectives and contents of the campaigns with the Vietnam Fatherland Front Committee at the same level and its member organizations, and create conditions for the Vietnam Fatherland Front Committee and its member organizations at the same level to organize and implement these campaigns among the people.
3. In cases where state agencies organize and direct mass movements, they shall request the Vietnam Fatherland Front Committee at the same level and relevant member organizations of the Front to send representatives to join the Steering Committee. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).4. The People's Councils, People's Committees at the commune level shall coordinate with the Vietnam Fatherland Front Committee at the same level to guide the coordination of activities between village chiefs, community leaders, and heads of self-management organizations in residential areas with the heads of the Front's propaganda and mobilization teams to implement grassroots democratic regulations and other campaigns in the residential area. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).5. The Vietnam Fatherland Front Committee at the same level shall direct and guide the activities of self-management organizations established according to the provisions of the law in the community.
Article 7. On Election Work Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Based on the Law on Elections of National Assembly Deputies, the Law on Elections of People's Council Deputies, joint resolutions between the Government and the Central Committee of the Vietnam Fatherland Front, and other related legal documents concerning election work, state agencies shall ensure necessary conditions for the Vietnam Fatherland Front Committees at all levels to exercise their rights and responsibilities in election work:
1. The Government's Organization and Cadre Department shall cooperate with the National Assembly Office and the Standing Board of the Central Committee of the Vietnam Fatherland Front to guide the structure and composition of the Front's member organizations participating in election management; organize meetings to deploy and train election staff; hold regional and provincial coordination meetings; direct and inspect election work; and summarize election work. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. The Ministry of Finance shall lead and coordinate with the Government's Organization and Cadre Department, the National Assembly Office, and the Standing Board of the Central Committee of the Vietnam Fatherland Front to guide the use of election funds. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Article 8. Organization of Meetings Between Voters and Deputies of All Levels of People's Councils
Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. The Ministry of Finance shall lead and coordinate with the Government's Organization and Cadre Department, the National Assembly Office, and the Standing Board of the Central Committee of the Vietnam Fatherland Front to guide the use of election funds. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Standing Body of the Provincial People's Council, the Standing Body of the District People's Council, and the Chairman or Vice-Chairman of the Commune People's Council shall host and coordinate with the Standing Board of the Vietnam Fatherland Front Committee at the same level to develop plans for organizing meetings between voters and deputies of all levels of People's Councils, ensuring material conditions, and compiling voter opinions and suggestions at the meeting.
The Vietnam Fatherland Front Committee at the same level shall host the meeting in accordance with the law.
BASED ON THE ELECTION LAW FOR NATIONAL ASSEMBLY DELEGATES, THE ELECTION LAW FOR PEOPLE'S COUNCIL DELEGATES, AND THE JOINT RESOLUTION BETWEEN THE GOVERNMENT AND THE VIETNAMESE FRONT FOR FATHERLAND UNION CENTRAL COMMITTEE, AS WELL AS OTHER RELATED LEGAL DOCUMENTS CONCERNING ELECTION WORK, STATE ORGANIZATIONS SHALL ENSURE NECESSARY CONDITIONS TO ENABLE THE VIETNAMESE FRONT FOR FATHERLAND UNION AT ALL LEVELS TO EXERCISE THEIR RIGHTS AND RESPONSIBILITIES IN ELECTION WORK: Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).1. THE ORGANIZATION AND CIVIL SERVICE COMMITTEE OF THE GOVERNMENT SHALL COORDINATE WITH THE NATIONAL ASSEMBLY SECRETARIAT AND THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY PRESIDENTIAL BOARD TO PROVIDE GUIDANCE ON THE STRUCTURE AND COMPOSITION OF THE ORGANIZATIONS PARTICIPATING IN THE ELECTION ORGANIZING COMMITTEES; TO ORGANIZE MEETINGS TO IMPLEMENT AND TRAIN ELECTION STAFF; TO ORGANIZE REGIONAL AND ZONAL MEETINGS; TO DIRECT AND INSPECT ELECTION WORK; AND TO SUMMARIZE ELECTION WORK. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. THE MINISTRY OF FINANCE SHALL LEAD AND COORDINATE WITH THE ORGANIZATION AND CIVIL SERVICE COMMITTEE OF THE GOVERNMENT, THE NATIONAL ASSEMBLY SECRETARIAT, AND THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY PRESIDENTIAL BOARD TO PROVIDE GUIDANCE ON THE USE OF ELECTION FUNDS.
ARTICLE 8. ORGANIZING MEETINGS BETWEEN ELECTORS AND DELEGATES OF PEOPLE'S COUNCILS AT ALL LEVELS Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE STANDING COMMITTEES OF PROVINCE, DISTRICT PEOPLE'S COUNCILS, AND THE CHAIRMAN OR VICE CHAIRMAN OF THE COMMUNE PEOPLE'S COUNCIL SHALL BE RESPONSIBLE FOR AND COORDINATE WITH THE STANDING COMMITTEE OF THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE SAME LEVEL TO DEVELOP PLANS FOR MEETINGS BETWEEN ELECTORS AND DELEGATES OF PEOPLE'S COUNCILS AT ALL LEVELS, TO ENSURE MATERIAL RESOURCES, AND TO COLLECT AND SUMMARIZE ELECTOR OPINIONS AND PETITIONS AT SUCH MEETINGS.
THE STANDING COMMITTEE OF THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE SAME LEVEL SHALL HOST THE MEETING IN ACCORDANCE WITH THE LAW. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).IF THE VIETNAMESE FRONT FOR FATHERLAND UNION CENTRAL COMMITTEE OR THE VIETNAMESE ASSOCIATION OF LAWYERS CENTRAL COMMITTEE PARTICIPATES IN THE COURT JUDGE SELECTION COMMITTEE OF THE PROVINCE PEOPLE'S COURT, MILITARY REGION PEOPLE'S COURT, AND EQUIVALENT COURTS, OR MILITARY ZONE PEOPLE'S COURT, THEN BASED ON THE PROPOSAL OF THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY PRESIDENTIAL BOARD,
THE VIETNAMESE FRONT FOR FATHERLAND UNION CENTRAL COMMITTEE OR THE VIETNAMESE ASSOCIATION OF LAWYERS CENTRAL COMMITTEE, THE MINISTRY OF JUSTICE SHALL SUBMIT
THE NATIONAL ASSEMBLY STANDING COMMITTEE TO DECIDE ON THE CHANGE OF THAT MEMBER. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).IF THE VIETNAMESE FRONT FOR FATHERLAND UNION OR THE VIETNAMESE ASSOCIATION OF LAWYERS PARTICIPATES IN THE COURT JUDGE SELECTION COMMITTEE OF THE DISTRICT PEOPLE'S COURT, THEN BASED ON THE PROPOSAL OF THE STANDING COMMITTEE OF THE VIETNAMESE FRONT FOR FATHERLAND UNION,
Standing Committee Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION PROVINCIAL COMMITTEE OR THE VIETNAMESE ASSOCIATION OF LAWYERS PROVINCIAL COMMITTEE, THE PROVINCE DEPARTMENT OF JUSTICE SHALL SUBMIT THE MINISTER OF JUSTICE TO DECIDE ON THE CHANGE OF THAT MEMBER.
Article 9. On the drafting of legal normative documents by the National Assembly, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Standing Committee of the National Assembly, Government, Prime Minister, Ministries, ministerial-level agencies, and government agencies
1. The Office of the Government and the Ministry of Justice shall be responsible for compiling the recommendations of Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Central Committee of the Vietnam Fatherland Front and its member organizations regarding the proposed legislative program for laws and ordinances, the program for resolutions and decrees of the Government, decisions and directives of the Prime Minister to submit to competent state authorities.
2. The Government shall provide comments in writing on draft laws and ordinances submitted by Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Central Committee of the Vietnam Fatherland Front.
3. When drafting draft laws and ordinances that relate to fundamental rights and obligations of citizens, functions, tasks, powers of the Vietnam Fatherland Front and its member organizations, and state administrative bodies, the drafting agency shall be responsible for sending the draft to Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front and relevant member organizations for their comments.
As for draft resolutions, decrees of the Government, decisions and directives of the Prime Minister, decisions and directives, circulars of ministers, heads of ministerial-level agencies, and government agencies related to the rights and responsibilities of the Vietnam Fatherland Front, cadres' systems and policies, the drafting agency shall send the draft to the Permanent Standing Board of the Council of Chairpersons Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).of the Central Committee of the Vietnam Fatherland Front and relevant member organizations for their comments.
Article 10. Article 12. On the selection of judges and the recommendation of associate judges of the People's Court
1. In cases where there is a change in the members of the Central Committee of the Vietnam Fatherland Front or the Vietnam Bar Association participating in the Selection Council for judges of provincial People's Courts, military regional courts and equivalent courts, and military area courts, on the basis of the proposal of the Standing Board of the Central Committee of the Vietnam Fatherland Front or the Central Vietnam Bar Association, the Ministry of Justice shall submit to the Standing Committee of the National Assembly for a decision on the change of such member. In cases where there is a change in the members of the Vietnam Fatherland Front Committee or the Vietnam Bar Association participating in the Selection Council for judges of district-level People's Courts, on the basis of the proposal of the Standing Board of the Provincial Vietnam Fatherland Front Committee or the Provincial Vietnam Bar Association, the Director of the Department of Justice shall submit to the Minister of Justice for a decision on the change of such member. Article 13. On supervisory activities
1. State agencies when performing supervisory, inspection, and audit tasks at the local level shall have the responsibility to study, consider, and adopt recommendations of the Vietnam Fatherland Front Committee at the same level, the People's Supervision Board, and opinions of various social strata reflected through the Vietnam Fatherland Front Committee. 2. When necessary, state agencies shall have the responsibility to invite representatives of the People's Supervision Board to participate in supervision, audits, and inspections at communes, wards, and towns. The People's Supervision Board shall have the responsibility to provide information and dispatch personnel to participate when requested to join supervision, inspections, and audits by state agencies.
When the People's Supervision Board exercises its right to supervise and inspect in accordance with the law, the Chairman of the People's Committee of the commune under supervision and inspection shall have the responsibility to provide information and respond to recommendations in accordance with Article 15 of this Decree. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The provincial and district People's Committees shall cooperate with the Vietnam Fatherland Front Committee at the same level to create conditions for the Vietnam Fatherland Front Committee at the commune level to direct the organization and operation of the People's Supervision Board.

State agencies shall have the responsibility to cooperate with the Vietnam Fatherland Front Committee at the same level to guide, support, encourage, and protect citizens when they exercise their right to supervise. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION SHALL REQUEST.
3. At all levels, the People's Councils when performing supervisory tasks shall have the responsibility to:
a) Invite representatives of the Standing Board of the Vietnam Fatherland Front Committee at the same level to participate in building the People's Council's supervision plan; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION HAS SUBMITTED PETITIONS PURSUANT TO CLAUSE 2, ARTICLE 15 OF THIS DECREE.
b) Invite representatives of the Standing Board of the Vietnam Fatherland Front Committee at the same level to participate in supervision activities; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. IN CASE A STATE ORGANIZATION RECEIVES PETITIONS FROM THE VIETNAMESE FRONT FOR FATHERLAND UNION AND ITS AFFILIATED ORGANIZATIONS THAT DO NOT FALL UNDER THE PROVISIONS OF CLAUSE 1, ARTICLE 15 OF THIS DECREE, THEN SUCH ORGANIZATION SHALL HAVE THE RESPONSIBILITY TO RESPOND WITHIN NO MORE THAN THIRTY DAYS FROM THE DATE OF RECEIVING THE PETITION. IN CASE THE VIETNAMESE FRONT FOR FATHERLAND UNION AND ITS AFFILIATED ORGANIZATIONS DO NOT AGREE WITH THE RESPONSE, THEN BOTH PARTIES SHALL DISCUSS TO REACH AN AGREEMENT ON A SOLUTION. IF NO AGREEMENT IS REACHED, THEN REPORT TO THE SUPERIOR STATE ORGANIZATION. THE SUPERIOR STATE ORGANIZATION SHALL CONSIDER AND SOLVE THE ISSUE WITHIN NO MORE THAN FORTY-FIVE DAYS FROM THE DATE OF RECEIVING THE REPORT.
c) Provide information related to the People's Council's supervision work to the Vietnam Fatherland Front Committee at the same level; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).3. THE AUTHORIZED STATE ORGANIZATION SHALL HAVE THE RESPONSIBILITY TO STUDY AND CONSIDER PETITIONS FROM ORGANIZATIONS AND INDIVIDUALS REGARDING SUSPENSION, AMENDMENT, SUPPLEMENTATION, REPLACEMENT, OR ABOLITION OF THE IMPLEMENTATION OF LEGAL REGULATIONS REPORTED THROUGH THE VIETNAMESE FRONT FOR FATHERLAND UNION AT ALL LEVELS.
d) Create conditions for representatives of the Standing Board of the Vietnam Fatherland Front Committee to raise recommendations related to the content of supervision; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).ARTICLE 16. JOINT WORK BETWEEN STATE ORGANIZATIONS AND THE VIETNAMESE FRONT FOR FATHERLAND UNION
e) Receive relevant information about the People's Council's supervision activities provided by the Standing Board of the Vietnam Fatherland Front Committee at the same level. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE SAME LEVEL SHALL ORGANIZE REGULAR SIX-MONTH JOINT WORK MEETINGS OR AS NEEDED BY ONE PARTY TO DISCUSS ISSUES THAT NEED TO BE RESOLVED. THE CONTENT, PROGRAM, AND TIME SHALL BE AGREED UPON BY BOTH PARTIES AND IMPLEMENTED ACCORDING TO THE COOPERATIVE WORK REGULATION.
4. The head of state agencies shall have the responsibility to:
a) Meet, provide information, and explain issues related to the requirements of the Vietnam Fatherland Front Committee when conducting supervisory activities; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).ARTICLE 17. ATTENDING SESSIONS OF
b) Dispatch representatives to participate in the supervision activities of the Vietnam Fatherland Front when the Vietnam Fatherland Front Committee requests; Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE PEOPLE'S COUNCILS AT ALL LEVELS SHALL APPOINT REPRESENTATIVES TO ATTEND MEETINGS OF THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE SAME LEVEL WHEN INVITED BY THE VIETNAMESE FRONT FOR FATHERLAND UNION.
c) Consider and resolve recommendations of the Vietnam Fatherland Front regarding commendation and reward for good people and good deeds; promptly consider, resolve, and handle violations of the law and report the results of handling to the Vietnam Fatherland Front Committee which has made recommendations in accordance with Clause 2, Article 15 of this Decree. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE CHAIRMAN OR VICE CHAIRMAN OF THE PEOPLE'S COUNCIL,
Article 14. Regarding People's External Activities
1. State agencies within their functions, tasks, and authorities shall be responsible for participating in building plans and programs for people's external activities of the Vietnam Fatherland Front and creating conditions for the Vietnam Fatherland Front to implement effectively. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front shall implement effectively.
2. State agencies shall cooperate when requested by the Vietnam Fatherland Front and member organizations of the Front to participate in implementing programs and plans for people's external activities. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).3. When state agencies conduct external activities related to the people's external activities of the Vietnam Fatherland Front, they shall invite representatives of the Standing Committee of the Vietnam Fatherland Front to participate.
State agencies and the Vietnam Fatherland Front at all levels, along with member organizations of the Front, shall be responsible for coordinating people's external activities and state external activities to implement and expand external activities in the region and globally according to the foreign policy of the Party and the State. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Article 15. Responding to Petitions from the Vietnam Fatherland Front
1. At sessions and meetings of the Government, People's Councils, People's Committees, where representatives of the Vietnam Fatherland Front and political-social organizations that are members of the Front directly raise petitions, the Government, People's Councils, and People's Committees shall be responsible for responding immediately at the session or meeting; in cases requiring further study, they shall respond in writing within no more than thirty days from the date of receiving the petition or at the next session or meeting. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).2. In cases where state agencies receive petitions from the Vietnam Fatherland Front and its member organizations not covered by Clause 1 of this Article, such agencies shall be responsible for responding within no more than thirty days from the date of receiving the petition. If the Vietnam Fatherland Front and its member organizations do not agree with the response, both parties shall discuss to reach a consensus on a solution. If no agreement can be reached, it shall be reported to the higher-level state agency with authority. The higher-level state agency shall examine and resolve within no more than forty-five days from the date of receiving the report.
3. State agencies with authority shall be responsible for studying and examining petitions from organizations and individuals regarding the suspension, amendment, supplementation, replacement, or abolition of the implementation of normative legal documents reflected through the Vietnam Fatherland Front at all levels.
Article 16. Joint Working Sessions between State Agencies and the Vietnam Fatherland Front Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front at the same level shall organize joint working sessions every six months or as needed upon request of one party to exchange on issues that need to be resolved. The content, program, and time shall be agreed upon and implemented according to the Coordinating Work Regulations. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Article 17. Participation in Meetings of People's Councils at All Levels Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).People's Councils at all levels shall send representatives to attend meetings of the Vietnam Fatherland Front at the same level when invited by the Vietnam Fatherland Front. The Chairman or Vice-Chairman of the People's Council shall attend meetings of the Vietnam Fatherland Front at the same level to report on economic, social, security, defense situations, and other relevant issues in the locality, and to receive and consider opinions and petitions of the Front for resolution.
THE PEOPLE'S COUNCIL SHALL ATTEND SESSIONS OF THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE SAME LEVEL TO REPORT ON THE ECONOMIC, SOCIAL, SECURITY, AND DEFENSE SITUATION, AND OTHER RELATED ISSUES IN THE LOCALITY, AND TO CONSIDER AND RESOLVE THE OPINIONS AND PETITIONS OF THE VIETNAMESE FRONT FOR FATHERLAND UNION. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).OF THE VIETNAMESE FRONT FOR FATHERLAND UNION Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION CENTRAL COMMITTEE SHALL IMPLEMENT THE PLANS, PROGRAMS, AND CONTENT OF TRAINING AND CAPACITY BUILDING FOR FRONT ORGANIZATIONAL STAFF AT THE CENTRAL TRAINING AND CAPACITY BUILDING CENTER FOR FRONT ORGANIZATIONAL STAFF.
THE VIETNAMESE FRONT FOR FATHERLAND UNION AT THE PROVINCE AND DISTRICT LEVELS SHALL UNIFY THE PLANS, PROGRAMS, AND CONTENT OF TRAINING AND CAPACITY BUILDING FOR FRONT ORGANIZATIONAL STAFF AT THE LOCAL LEVEL. Article 16. Joint working sessions between state agencies and the Vietnam Fatherland Front
1. At sessions and meetings of the Government, People's Councils, People's Committees, where representatives of the Vietnam Fatherland Front and political-social organizations that are members of the Front directly raise petitions, the Government, People's Councils, and People's Committees shall be responsible for responding immediately at the session or meeting; in cases requiring further study, they shall respond in writing within no more than thirty days from the date of receiving the petition or at the next session or meeting. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front at the same level shall organize joint working sessions every six months or when necessary upon request from one side to exchange on issues related to matters that need to be resolved. The content, program, and time are agreed upon and implemented according to the Regulation on cooperation.
Article 17. Chapter III
ARTICLE ON CONDITIONS FOR THE OPERATIONS OF THE VIETNAM FOLKLORE FRONT
OF THE VIETNAM FATHERLAND FRONT
Article 18. Training and Capacity Building for Front Cadres
1. Front cadres shall be trained and capacity built to enhance their qualifications and professional skills to meet assigned requirements and tasks.
Annual training and capacity building funds for front cadres shall be utilized from the current budgetary training and capacity building funds according to the existing budget management hierarchy.
2. Central state agencies related shall cooperate to assist and create favorable conditions for the Central Executive Board of the Vietnam Folklore Front to implement plans, programs, and contents of training and capacity building for front cadres at the central training center for front cadres. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Central Committee of the Vietnam Fatherland Front shall implement plans, programs, and contents of training and capacity building for front cadres at the Central Training Center for Front Cadres.
3. Each year, the Provincial Political Academy and the County Political Center shall coordinate with the Provincial and County Executive Boards of the Vietnam Folklore Front to unify plans, programs, and contents of training and capacity building for front cadres at the local level. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front Committees at provincial and district levels shall unify plans, programs, and contents of training and capacity building for front cadres at the local level.
Article 19. On the Transfer and Assignment of Cadres and Civil Servants to Work at the Vietnam Folklore Front Agencies at Various Levels Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Fatherland Front Committees at all levels
State agencies shall consider and fulfill the Vietnam Folklore Front's requirements for the transfer or assignment of cadres and civil servants to work at the Vietnam Folklore Front agencies at various levels. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).when dispatching or seconding officials or civil servants to work at the agency of the Vietnam Fatherland Front Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).THE VIETNAMESE FRONT FOR FATHERLAND UNION AT ALL LEVELS
Article 20. Remuneration and Policies for Front Cadres and Cadres, Civil Servants Engaged in Front Work
1. The salaries, allowances, and other benefits of front cadres at all levels shall be implemented in accordance with the provisions of the law.
2. When cadres and civil servants are dispatched by the managing and using agencies to participate in the activities of the Vietnam Folklore Front agencies at various levels, those agencies shall ensure their entitlements according to the provisions of the law. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).at all levels of the Vietnam Fatherland Front, such agencies shall ensure their entitlements in accordance with the provisions of the law.
3. State cadres, civil servants, and employees who are members of the Vietnam Folklore Front agencies at various levels or are assigned to collaborate with these agencies shall be provided with favorable conditions by their cadre, civil servant, and employee managing agencies to perform their assigned tasks; their salaries, allowances, and other benefits during their participation in front work shall be paid by their cadre, civil servant, and employee managing agencies. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).members Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).at all levels of the Vietnam Fatherland Front or assigned to cooperate in work with Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front, the agency or unit managing officials, civil servants, and public officials shall provide conditions for them to fulfill their assigned tasks; salaries, allowances, and other entitlements during their participation in the Vietnam Fatherland Front activities shall be paid by the agency or unit managing such officials, civil servants, and public officials.
Article 21. Operating Funds for the Vietnam Folklore Front
1. The state budget shall ensure operating funds for the Vietnam Folklore Front agencies at various levels according to the existing budget management hierarchy. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Each year, based on the guidance of authorized state agencies and assigned tasks, the Vietnam Folklore Front agencies at various levels shall prepare budget estimates to submit to the financial authorities at the same level for review, consolidation, and submission to the authorized agency for decision-making.
Annually, based on the guidance of the competent state agency and the requirements of the assigned tasks, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front agencies at all levels shall prepare budget estimates to submit to the financial agency at the same level for review and consolidation in the general budget to be submitted to the competent authority for decision;
2. In cases of unexpected activities or newly emerging activities not yet allocated funds, the Vietnam Folklore Front agencies at various levels shall prepare supplementary budget estimates to request the Government, People's Councils, and financial authorities at the same level to review and supplement the funds for implementation. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front agencies at all levels shall prepare supplementary budget estimates to request the Government, Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the People's Council and the financial agency at the same level to consider and supplement the operating funds;
3. For matters conducted in collaboration with state agencies, based on the allocated funds for this activity (if any), the authorized state agency shall allocate funds to the Vietnam Folklore Front agencies at the same level according to specific assigned tasks. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).when the Vietnam Fatherland Front agency cooperates with state agencies to carry out the work, based on the funding allocated for this work (if any), the competent state agency shall allocate the funds to Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front agency at the same level according to specific tasks assigned;
4. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).The Vietnam Folklore Front agencies at various levels shall prepare, implement, and settle accounts according to the current state budget management regulations.
Article 22. Ensuring the conditions for the operation of the Vietnam Fatherland Front Executive Committee when there is a change in administrative level or administrative boundaries of administrative units and in special cases Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).When there is a decision by the competent state agency regarding the change in administrative level or administrative boundaries of administrative units and in special cases, the competent state agency within its scope of duties and authority shall be responsible for ensuring material resources and creating conditions for
the same-level Vietnam Fatherland Front Executive Committee to stabilize its organization and working conditions. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).the Vietnam Fatherland Front agency at the same level shall stabilize its organizational structure and working conditions.
Chapter IV
REWARD AND VIOLATION HANDLING
Article 23. Rewards and Handling of Violations
1. Organizations and individuals who have achievements in implementing policies and laws on the Vietnam Fatherland Front shall be rewarded according to the provisions of the law.
Organizations and individuals who have achievements in participating in coordination work with the Vietnam Fatherland Front shall be Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).proposed by the Vietnam Fatherland Front Executive Committee to the competent state agency for reward according to the provisions of the law.
2. Organizations that violate the provisions of the law on the Vietnam Fatherland Front shall be subject to administrative handling depending on the nature and extent of the violation; if damage is caused, they must compensate according to the provisions of the law.
Individuals who violate the provisions of the law on the Vietnam Fatherland Front shall be subject to administrative handling or criminal prosecution depending on the nature and extent of the violation; if damage is caused, they must compensate according to the provisions of the law.
Any person who takes advantage of their position or power to deliberately obstruct the activities of the Vietnam Fatherland Front shall be subject to disciplinary action or criminal prosecution depending on the nature and extent of the violation according to the provisions of the law.
Chapter V
IMPLEMENTING PROVISIONS
Article 24. Effective Date
This Decree takes effect fifteen days from the date of signature.
Article 25. Responsibilities for Implementation
Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Councils, Chairpersons Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Provincial People's Committees under the Central Government are responsible for implementing this Decree./.
