CIRCULAR
Regulations on the classification of surgical procedures and medical interventions and staffing levels for each surgical procedure and medical interventionpersonnel for each surgical procedure and medical intervention

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.
Pursuant to Decision No. 73/2011/QĐ-TTg dated December 28, 2011 of the Prime Minister on certain special allowances for civil servants, public officials, and workers in public health facilities and anti-epidemic allowances; stipulating certain special allowances for civil servants, public officials, and workers in public health facilities, and anti-epidemic allowances;
At the proposal of the Director of the Department of Medical Examination and Treatment,
The Minister of Health issues this Circular on the classification of surgical procedures and medical interventions and staffing levels for each surgical procedure and medical intervention.
Article 1. Scope of Regulation
1. Attached to this Circular is the List of Classification of Surgical Procedures and Medical Interventions according to 26 specialties and fields.
2. Specifies staffing levels for each surgical procedure and medical intervention.
Article 2. Conditions for Classifying Surgical Procedures and Medical Interventions
The classification of surgical procedures and medical interventions is based on the following conditions:
1. The level of difficulty and complexity of the surgical procedure or medical intervention.
2. The level of danger to the patient's life.
3. Requirements for medical equipment, tools, and devices used in the surgical procedure or medical intervention.
4. Requirements for the number of participants in the surgical procedure or medical intervention.
5. Duration of performing the surgical procedure or medical intervention.
Article 3. Classification of Levels of Surgical Procedures and Medical Interventions
1. Special Category Surgical Procedures and Medical Interventions
a) Very complex surgical procedures and medical interventions with high risk to the patient's life, requiring highly skilled healthcare professionals, mostly performed at central-level healthcare facilities.
b) Requirement for specialized medical equipment, tools, and devices.
c) Requirement for the number of participants in the surgical procedure or medical intervention as specified in Appendix No. 1 attached to this Circular.
d) Average duration of the technique from 3 to 4 hours or longer.
2. Category I Surgical Procedures and Medical Interventions
a) Relatively complex surgical procedures and medical interventions with significant risk to the patient's life, requiring highly skilled healthcare professionals, mostly performed at central-level and provincial-level healthcare facilities.
b) Requirement for specialized medical equipment, tools, and devices.
c) Requirement for the number of participants in the surgical procedure or medical intervention as specified in Appendix No. 1 attached to this Circular.
d) Average duration of the technique from 2 to 3 hours or longer.
3. Category II Surgical Procedures and Medical Interventions
a) Surgical procedures and medical interventions mostly performed at central-level, provincial-level, and some district-level healthcare facilities, with lower risk to the patient's life compared to Category I.
b) Requirement for general medical equipment, tools, and devices.
c) Requirement for the number of participants in the surgical procedure or medical intervention as specified in Appendix No. 1 attached to this Circular.
d) Average duration of the technique from 1 to 3 hours or longer.
4. Category III Surgical Procedures and Medical Interventions
a) Surgical procedures and medical interventions mostly performed at district-level healthcare facilities, with lower risk to the patient's life compared to Category II.
b) Requirement for general medical equipment, tools, and devices.
c) Requirement for the number of participants in the surgical procedure or medical intervention as specified in Appendix No. 1 attached to this Circular.
d) Average duration of the technique from 1 to 2 hours or longer.
Article 4. Application of the List of Classification of Surgical Procedures and Medical Interventions
The List of Classification of Surgical Procedures and Medical Interventions serves as the basis for healthcare facilities to pay allowances for surgical procedures and medical interventions and equivalent techniques according to Decision No. 73/2011/QĐ-TTg dated December 28, 2011 of the Prime Minister on certain special allowances for civil servants, public officials, and workers in public health facilities and anti-epidemic allowances.
Article 5. Staffing Standards for Each Surgical Procedure or Medical Intervention
1. The maximum number of people participating in a surgical procedure or medical intervention shall be calculated based on the classification of the surgical procedure or medical intervention and according to each specialty as stipulated in Appendix No. 1 attached hereto.
2. In cases where a surgical procedure or medical intervention is difficult and complex, such as organ transplantation, open-heart surgery, and other procedures requiring multiple teams and exceeding the staffing standards set forth in Clause 1 of this Article, the Head of the Medical Examination and Treatment Facility shall consider and decide. The payment for surgical allowances must be based on the actual number of participants and according to the staffing standards prescribed for each position.
3. The specific assignment of tasks for each person in each surgical procedure or medical intervention shall be decided by the Head of the Medical Examination and Treatment Facility.
Article 6. Effectiveness
1. This Circular shall take effect from February 15, 2015.
2. Decision No. 1904/1998/QD-BYT dated August 10, 1998 of the Minister of Health on the issuance of the surgical and medical intervention classification list and Decision No. 2590/2004/QD-BYT dated July 30, 2004 of the Minister of Health on the issuance of the medical intervention classification list for allowance benefits under Decision No. 155/QĐ-TTg dated July 30, 2003 of the Prime Minister regarding the amendment and supplementation of certain special allowances for civil servants and employees in the health sector shall cease to be effective from the date this Circular takes effect.
Article 7. Responsibility for Implementation
1. The Director of the Department of Medical Examination and Treatment shall take the lead and coordinate with relevant units to direct, organize, and inspect the implementation of this Circular at medical examination and treatment facilities.
2. The Director of the Department of Health of provinces and centrally-administered cities, the Heads of Health Departments of Ministries and sectors shall be responsible for directing, organizing, and supervising the implementation of this Circular at medical examination and treatment facilities under their jurisdiction.
3. The Head of the Medical Examination and Treatment Facility, based on the Surgical and Medical Intervention Classification List, shall be responsible for implementing the payment of surgical and medical intervention allowances to those performing surgical and medical interventions and equivalent techniques according to Decision No. 73/2011/QĐ-TTg dated December 28, 2011 of the Prime Minister on the regulation of certain special allowances for civil servants, employees, and workers in public health institutions and epidemic prevention allowances.
Any difficulties or obstacles encountered during the implementation should be promptly reported to the Department of Medical Examination and Treatment, Ministry of Health for guidance and resolution./.
