Regulations on maximum residue limits of plant protection products in food

On the basis of The Food Safety Law dated June 17, 2010;
Pursuant to Decree No. 38/2012/NĐ-CP dated April 25, 2012 of the Government detailing implementation of certain provisions of the Food Safety Law;
On the basis of Decree No. 63/2012/NĐ-CP dated August 31, 2012 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Food Safety Administration;
The Minister of Health issues this Circular prescribing maximum residue limits of plant protection products in food:
Article 1. Scope of Regulation and Applicability
1. This Circular prescribes maximum residue limits of plant protection products in food produced domestically and imported.
2. This Circular applies to organizations and individuals producing and trading in food, and relevant agencies, organizations, and individuals.
Article 2. Interpretation of Terms
In this Circular, the following terms are understood as follows:
1. Maximum Residue Level (MRL) is the highest permissible level of a plant protection product residue in food (unit of measurement: mg/kg of food).
2. Plant Protection Product Residue refers to residues of a plant protection product in food resulting from its use.
Plant protection product residues may originate from unknown sources that cannot be avoided (such as from the environment) or from the use of chemicals.
Plant protection product residues include derivatives of the plant protection product such as transformation products, metabolites, reaction products, and impurities considered significant in terms of toxicity.
3. Extraneous Maximum Residue Limit (EMRL) is the highest permissible level in food of a plant protection product residue or contaminant from the environment (including the use of chemicals in agriculture prior to the present), excluding residues from the direct or indirect application of plant protection products or contaminants to food (unit of measurement: mg/kg of food).
4. Acceptable Daily Intake (ADI) is the amount of a chemical that can be ingested daily over a lifetime without adverse health effects (unit of measurement: mg/kg body weight).
Plant Protection Product Code (Code) is the plant protection product code of the Codex Alimentarius Commission.
Article 3. Prescribing maximum residue limits of plant protection products in food
Maximum residue limits of plant protection products in food are prescribed in the Appendix attached to this Circular.
Article 4. Implementation provisions
1. This Circular takes effect from July 1, 2017.
Part 8 "Maximum Residue Limits of Plant Protection Products in Food" issued with Decision No. 46/2007/QĐ-BYT dated December 19, 2007 of the Minister of Health on "Regulations on Maximum Biological and Chemical Contamination Levels in Food" shall cease to be effective from the date this Circular takes effect.
2. The Food Safety Agency is responsible for organizing the implementation of this Circular in coordination with relevant competent agencies.
In the course of implementation, if there are difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Health (Food Safety Agency) for consideration and resolution./.
