Circular No. 50/2025/TT-BXD on announcing the port water areas and maritime zones under the jurisdiction of Quang Ninh Province and the management area of Ha Long Maritime Port Office

CIRCULAR

ANNOUNCEMENT OF PORT WATER ZONES AND MARITIME AREAS WITHIN THE PROVINCE OF QUANG NINH AND MANAGEMENT ZONE OF THE QUANG NINH PORT AUTHORITY

NINH AND THE JURISDICTIONAL AREA OF THE PORT DIRECTORATE OF QUANG NINH PORTS

On the basis of The Maritime Code of Vietnam dated November 25, 2015;

Decree No. Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of The Vietnam Maritime Code on maritime activity management and amendments to other decrees;

Decree No. Decree No. 33/2025/NĐ-CP dated February 25, 2025 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Construction;

Pursuant to the proposal of the Director General of the Vietnam Maritime Administration and Inland Waterway Administration;

The Minister of Construction issues this Circular to announce the port water zones and maritime areas within the province of Quang Ninh and the management zone of the Quang Ninh Port Authority.

Article 1. Announcement of the port water zones within the province of Quang Ninh

The port water zones within the province of Quang Ninh, based on the highest tidal level, include the following areas:

1. Van Gia - Hai Ha area with the scope:

a) From point VH1 with coordinates: 21°24’40,0”N, 108°01’10,0”E connected by straight lines in sequence to points VH2 to VH5 with the following coordinates:

VH2: 21°24’52,1”N, 108°03’35,3”E;

VH3: 21°18’03,6”N, 108°03’35,3”E;

VH4: 21°18’03,6”N, 107°59’53,2”E;

VH5: 21°23’45,6”N, 107°59’53,2”E.

b) From point VH5 running along the southern, eastern, and northern coasts of Vinh Thuc Island to point VH6 with coordinates: 21°23’01,2”N, 107°54’19,7”E.

c) From point VH6 continuing to connect by a straight line to point VH7 with coordinates: 21°23’01,2”N, 107°53’18,8”E.

d) From point VH7 running along the northern coast of Vinh Thuc Island to point VH8 with coordinates: 21°21’55,2”N, 107°49’31,6”E, from point VH8 continuing to connect by straight lines in sequence to points VH9 to VH16 with the following coordinates:

VH9: 21°20’27,4”N, 107°50’34,0”E;

VH10: 21°14’10,5”N, 107°56’46,0”E;

VH11: 21°11’31,4”N, 108°00’30,8”E;

f) From point VH19 running along the southern coast of Myao Island to point VH20 with coordinates: 21°22’23,3”N, 107°45’17,5”E, from point VH20 continuing to connect by straight lines in sequence to points VH21 to VH24 with the following coordinates:

VH21: 21°23’03,8”N, 107°45’51,4”E;

VH22: 21°24’45,7”N, 107°49’52,0”E;

2. Mui Chua area with the scope:

a) From point MC1 with coordinates: 21°17’05,4”N, 107°27’18,9”E connected by straight lines in sequence to points MC2 to MC3 with the following coordinates:

MC2: 21°17’12,6”N, 107°27’08,6”E;

MC3: 21°17’11,3”N, 107°27’05,0”E.

b) From point MC3 running along the bank of the Tien Yen River and the edge of the Mui Chua Port wharf to point MC4 with coordinates: 21°16’58,5”N, 107°26’52,6”E.

c) From point MC4 connecting by straight lines in sequence to points MC5 to MC6 with the following coordinates:

MC5: 21°16’47,6”N, 107°27’04,2”E;

4. Cam Pha area with the scope:

5. The Cuoi area with the scope:

a) From point CD1 with coordinates: 21°00’29,8”N, 107°33’17,6”E connecting with a straight line to point CD2 with coordinates: 21°00’29,8”N, 107°34’05,9”E.

b) From point CD2 running along the western shore of Cao Lo island to point CD3 with coordinates: 20°58’16,6”N, 107°33’41,5”E, from point CD3 continuing to connect with straight lines sequentially to points in order from CD4 to CD5 with the following coordinates:

CD4: 20°58’09,1”N, 107°33’25,8”E;

CD5: 20°59’05,1”N, 107°32’54,2”E.

c) From point CD5 connecting with a straight line to point CD1.

6. The Ga area with the scope:

a) From point HG1 with coordinates: 20°57’36,3”N, 107°03’55,6”E running along the southwestern shore of Hong Hai ward to point HG2 with coordinates: 20°56’46,1”N, 107°04’28,6”E.

b) From point HG2 connecting with straight lines sequentially to points in order from HG3 to HG23 with the following coordinates:

7. The Quang Yen area with the scope:

a) From point QY1 with coordinates: 20°50’07,8”N, 106°52’59,2”E connecting with straight lines sequentially to points in order from QY2 to QY3 with the following coordinates:

QY2: 20°50’11,6”N, 106°52’20,2”E;

QY3: 20°50’06,0”N, 106°52’04,6”E.

b) From QY3 running along the left bank of the Chan River (from the sea inward) to point QY4 with coordinates: 20°54’35,1”N, 106°49’58,8”E.

c) From point QY4 connecting with straight lines sequentially to points in order from QY5 to QY6 with the following coordinates:

QY5: 20°54’44,7”N, 106°50’08,5”E;

QY6: 20°54’18,1”N, 106°50’47,7”E.

d) From point QY6 running along the right bank of the Chan River (from the sea inward) to point QY7 with coordinates: 20°52’22,1”N, 106°51’31,7”E, continuing to connect with a straight line to point QY8 with coordinates: 20°51’26,8”N, 106°52’37,7”E.

đ) From point QY8 running along the western shore of Cong Island to point QY9 with coordinates: 20°50’50,2”N, 106°52’59,2”E, continuing to connect with a straight line to point QY1.

8. The boundaries of the maritime port area belonging to Quang Ninh province defined in this Circular are determined on nautical charts issued by Vietnam Navigation Safety Corporation, including: VN30001, VN50047, VN30037, VN30038 updated in 2024 and VN40001, VN40002, VN50003, VN50004, VN50005, VN50006, VN50007, VN50008 updated in 2025. Coordinates of points specified in this Circular are applied according to the VN-2000 coordinate system and converted to the WGS-84 coordinate system as set out in the Appendix attached to this Circular.

Article 2. Maritime areas within the jurisdiction of Quảng Ninh Province

The coastal waters of the seaports within the jurisdiction of Quảng Ninh Province include six maritime areas:

1. Vạn Gia - Hải Hà maritime area.

2. Mũi Chùa maritime area.

3. Cô Tô maritime area.

4. Cẩm Phả - Cửa Đối maritime area (including the Cẩm Phả area and the Cửa Đối area).

5. Hòn Gai maritime area.

6. Quảng Yên maritime area.

Article 3. Management Areas of the Quảng Ninh Marine Port Authority

The Quảng Ninh Marine Port Authority manages the following areas:

1. The Quảng Ninh Marine Port Authority oversees state management of marine affairs at seaports within the jurisdiction of Quảng Ninh Province and the maritime areas specified in Article 2 of this Circular.

2. The area where vessels can freely navigate at the Bắc Luân River mouth, Vietnam, is the water area on the Vietnamese side, defined by the "boundary of the vessel free navigation zone" and the "border line" stipulated in Appendix 1 of the Agreement on Vessel Navigation in the Free Navigation Zone at the Bắc Luân River Mouth between the Government of the Socialist Republic of Vietnam and the Government of the People's Republic of China signed on November 5, 2015.

3. Based on actual conditions, vessels entering or leaving seaports within the jurisdiction of Hải Phòng City but must anchor to unload part of their cargo before docking at berths within seaports within the jurisdiction of Hải Phòng City or transfer cargo to load additional goods after partially loading at berths within seaports within the jurisdiction of Hải Phòng City shall be arranged by the Quảng Ninh Marine Port Authority to one of the following positions within the coastal waters of Quảng Ninh Province:

a) For vessels carrying non-polluting and non-hazardous goods:

HL3-1: 20°50’28,1”N, 107°07’55,2”E;

HL3-5: 20°51’51,6”N, 107°06’41,7”E;

HL3-6: 20°51’59,1”N, 107°06’15,9”E.

Vessels are not permitted to load or unload bulk cargoes such as cement, clinker, wood chips, and limestone with sizes up to 4x6 cm at points HL3-1, HL3-5, and HL3-6 mentioned above.

b) For vessels carrying polluting and hazardous goods:

HN2-21: 20°55’59,1”N, 107°16’38,2”E.

The arrangement of vessels entering or leaving ports as provided for in this clause shall cease upon a decision by the competent authority.

4. The Quảng Ninh Marine Port Authority shall coordinate with the Hải Phòng Marine Port Authority to develop a Regulation on cooperation to implement the provisions of Clause 3 of this Article.

Article 4. Implementation provisions

1. This Circular takes effect from February 1, 2026.

2. Repeal Circular No. 01/2018/TT-BGTVT dated January 3, 2018 issued by the Minister of Transport regarding the announcement of coastal waters of seaports within the jurisdiction of Quảng Ninh Province and the management areas of the Quảng Ninh Marine Port Authority.

3. Repeal item number 01 in the List of maritime areas within the management scope of the Marine Port Authorities promulgated together with Circular No. 32/2019/TT-BGTVT dated September 4, 2019 issued by the Minister of Transport announcing the List of maritime areas within the management scope of Marine Port Authorities.
