Law Amending and Supplementing the Law on Military Service No. 50/LCT

The Law amending and supplementing the Law on Military Service stipulates the age for recruitment into the military, the term of active service for non-commissioned officers and soldiers in armed forces, annual reserve training systems, and the mobilization of reserve personnel during wartime. AMENDMENTS AND SUPPLEMENTS TO THE MILITARY SERVICE LAW

At the proposal of the Council of Ministers, this Law stipulates the following amendments and supplements to the Military Service Law dated April 15, 1960:

Article 1

Now amend Articles 7, 10, 28, and 32 of the Military Service Law dated April 15, 1960, and replace them with the following new provisions:

1. Article 7 (new): The age range for recruitment into the regular army during peacetime is from eighteen to twenty-five years old, and during wartime is from eighteen to forty-five years old.

The sequential call-up of different age groups for service during wartime shall be determined by the National Defense Council.

2. Article 10 (new): The term of active service for non-commissioned officers and soldiers in the Army is three years.

The term of active service for non-commissioned officers and soldiers in the Air Force is four years.

The term of active service for technical non-commissioned officers and technical soldiers in the Army is four years.

The term of active service for non-commissioned officers and soldiers in the Navy is five years.

The term of active service for non-commissioned officers and soldiers belonging to technical units in the People's Armed Public Security shall be the same as that for units and services in the People's Army.

In special cases, the Minister of National Defense and the Minister of Public Security may extend the term of active service for military personnel under their jurisdiction but not exceeding four months.

3. Article 28 (new): Reserve officers, non-commissioned officers, and soldiers must annually participate in military training according to the orders of the Minister of National Defense.

Reserve officers, reserve technical non-commissioned officers, reserve technical soldiers, and those selected for reserve officer training must annually participate in military training for twenty-five days.

Reserve infantry non-commissioned officers and soldiers must annually participate in military training for fifteen days.

In case of necessity, the Council of Ministers decides on organizing concentrated military training for reserve military personnel for a period not exceeding eight months.

4. Article 32 (new): After the President of the Democratic Republic of Vietnam announces the general mobilization or partial mobilization order, the Minister of National Defense issues necessary orders to implement it.

Administrative committees at all levels have the duty to enforce the mobilization orders issued by the Minister of National Defense.

Heads of agencies, schools, factories, construction sites, agricultural farms, forestry farms, and other organizations have the duty to ensure that reserve military personnel under their organization comply with the mobilization orders promptly.

Article 2

Now supplement the following Articles 27b, 32b, and 34b to Articles 27, 32, and 34 of the Military Service Law dated April 15, 1960:

1. Article 27b: The Minister of National Defense leads the national conscription work.

Administrative committees at all levels lead local military agencies and related sectors in organizing conscription in their respective areas.

Heads of agencies, schools, factories, construction sites, agricultural farms, forestry farms, and other organizations have the duty to ensure that conscription work within their organization proceeds smoothly.

2. Article 32b: The call-up of reserve military personnel for active service during wartime is regulated as follows:

The Prime Minister issues the order to call up reserve officers of general rank;

The Minister of National Defense issues the order to call up reserve military personnel of colonel rank and below;

According to the order of the Minister of National Defense, the Chairman of the Administrative Committee of autonomous regions, provinces, and centrally governed cities issues the order to call up reserve military personnel of lieutenant rank and below;

According to the order of the Minister of National Defense, the Chairman of the Administrative Committee of counties, towns, provincial cities, and wards issues the order to call up reserve non-commissioned officers and soldiers.

3. Article 34b: During peacetime, based on the decision of the Council of Ministers, the Minister of National Defense organizes practical mobilization exercises for localities, agencies, production units, and other organizations. Those subject to military service duties must strictly comply with the mobilization exercise orders of the Minister of National Defense and the Chairman of the Local Administrative Committee.

This Law was adopted by the Fifth Session of the Second National Assembly of the Democratic Republic of Vietnam on October 26, 1962.
