Pursuant to Decree No. 62/2003/NĐ-CP dated June 6, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 61/HĐBT dated June 16, 1983 of the Council of Ministers (now the Government) on the establishment of Competition Councils at all levels;

Pursuant to Decision No. 154/1998/QĐ-TTg dated August 25, 1998 of the Prime Minister amending and supplementing the tasks and members of Competition and Reward Councils at all levels;

Considering the proposal of the Chairman of the Competition and Reward Council of the Justice Sector;

Article 1. Issued herewith are the Regulations on the organization and operation of the Competition and Reward Council of the Justice Sector.

Article 2. This Decision shall take effect from the date of signing.

Article 3. The Chairmen of the Competition and Reward Council of the Justice Sector, the Director of the Office, Heads of Departments for Cadre and Civil Servant Organization, Planning and Finance, Heads of units under the Ministry, and Directors of Justice Departments of provinces and centrally governed cities shall be responsible for implementing this decision./.

REGULATIONS

On the organization and operation of

 the Competition and Reward Council of the Justice Sector

PART I

ORGANIZATION AND OPERATING PRINCIPLES

Article 1The Competition and Reward Council of the Justice Sector (hereinafter referred to as the Council) is established by the Minister of Justice's decision and has the function of advising and assisting the Minister of Justice in matters related to competition and reward activities within the Justice Sector.

Article 2.

1. The Council consists of the Chairman, Vice Chairmen, Members, and Standing Members of the Council:

a. The Chairman of the Council is the Deputy Minister in charge of competition and reward work in the Justice Sector;

b. The Vice Chairman of the Council is the Director of the Ministry's Office;

c. The Members of the Council include the Permanent Representative of the Women's Advancement Committee in the Justice Sector, Heads of units under the Ministry that have the function of directing professional activities in the sector at the local level;

d. Members of the Council operate on a part-time basis;

2. The Standing Members of the Council consist of the Chairman, Vice Chairmen, and Standing Members of the Council;

3. The Department of Competition and Reward serves as the working body for the Council and the Standing Members of the Council; the Head of the Department of Competition and Reward is the Secretary of the Council.

Article 3. The Council convenes regular meetings three times a year to review and summarize competition and reward work and consider rewards. In case of emergency, the Council may convene extraordinary meetings upon the decision of the Chairman of the Council or when at least one-third of the total number of Council members propose it.

Article 4. The Council operates as a collective body and implements democratic, transparent, and majority voting principles. A resolution of the Council is passed when more than half of the total number of Council members agree.

Chapter II

TASKS AND POWERS

Article 5. The Council has the following duties and powers:

1. To coordinate between agencies and mass organizations in organizing, guiding, and directing patriotic competition movements throughout the Justice Sector, aiming to develop these movements strongly, widely, correctly, and effectively;

2. To summarize practical experiences from competition movements, thereby researching and proposing directions, plans for organizing and directing competition movements, promoting exemplary models, and establishing regulations on competition and reward within the Justice Sector;

3. To monitor, guide, urge, and inspect the implementation of competition and reward work by agencies, organizations, and competition areas within the Justice Sector;

4. To select individuals and groups with outstanding achievements in the Justice Sector's competition movement and submit them to the Minister of Justice for rewards for commendation titles and reward forms within the Minister's authority, or to the Minister for submission to competent authorities for rewards for commendation titles and reward forms within the Prime Minister's or President's authority;

5. To submit to the Minister for rewarding Medals (or Commemorative Medals) "For the Cause of Justice" to individuals inside and outside the sector who have made positive contributions to the sector's activities;

6. To examine and recommend solutions to complaints, denunciations, and suggestions regarding competition and reward within the Justice Sector; To examine and submit to competent authorities for revocation of reward decisions in cases where violations of competition and reward regulations are discovered;

7. To perform other tasks related to competition and reward work assigned by the Minister of Justice.

Article 6The Standing Members of the Council have the following duties and powers:

1. To draft programs and plans for the Council's activities and prepare content for Council sessions; To implement the contents approved by the Council and handle daily Council affairs;

2. To compile situations and draft reports on competition and reward work for the first six months and the entire year of the Justice Sector;

3. To prepare decisions appointing heads and deputy heads of regions, decisions organizing regional competition conferences, and proposals for delegations attending regional competition conferences for approval by the Minister of Justice;

4. To estimate the budget for competition and reward activities of the entire Justice Sector as well as the annual operating budget of the Council for approval by the Minister;

5. To cooperate with units, localities, and relevant mass organizations to assess the achievements of collectives and individuals in the competition movement to:

a. Submit to the Minister of Justice for rewarding collectives and individuals with outstanding achievements unexpectedly or in a particular field of work, after a campaign, or a short-term competition period;

b. Submit to the Deputy Minister in charge of competition and reward work in the Justice Sector for signing endorsement letters recommending the Government, the President to reward collectives and individuals not within the Justice Sector's jurisdiction for commendation titles and reward forms according to the State Competition and Reward Committee's, Ministries', and provincial and centrally governed city People's Committees' recommendations.

Article 7. Members of the Council have the following duties and powers:

1. The Chairman of the Council leads and directs all activities of the Council and its Standing Members;

2. The Vice Chairman of the Council assists the Chairman in performing tasks as delegated by the Chairman. The Vice Chairman manages the Council's activities when the Chairman is absent.

3. The Council members perform their tasks according to the division of labor by the Chairman of the Council, are responsible for strictly implementing the Council's activity program, and attend all sessions of the Council fully;

4. The Council members are responsible for organizing and directing the implementation of commendation and reward tasks within their respective fields of responsibility, compiling the situation and results of implementation, and participating in discussions at Council sessions. Information, opinions, and evaluations put forward for discussion must be accurate and based on evidence.

Article 8. The Commendation and Reward Department has the duty to assist the Council and the Council Standing Committee in preparing contents within the functions and responsibilities of the Council and the Council Standing Committee; regularly providing information about the commendation and reward work to Council members. The specific functions and responsibilities of the Commendation and Reward Department are stipulated in the Decision establishing the Department by the Minister of Justice.

The Head of the Commendation and Reward Department serves as the Secretary of the Council, with the duty to record the minutes of the Council's session results.

Chapter III

WORKING REGIME

Article 9. The Council convenes three regular meetings annually, except in extraordinary cases: the first meeting in mid-March, the second meeting in mid-July, and the third meeting in mid-December each year.

Meeting materials must be sent to Council members at least three days before the Council meeting date, except in extraordinary cases.

Article 10. Council sessions are valid when at least two-thirds of the total number of members or more attend. In case of absence of a Council member, they may authorize a deputy to attend or submit written opinions before the Council meeting. Opinions of authorized deputies are considered as those of absent members.

Article 11. Participants in Council sessions include Council members. In necessary cases, the Chairman of the Council may invite representatives with authority from other units and organizations to attend Council sessions, Council Standing Committee sessions. Invited representatives do not have the right to participate in voting at sessions.

Article 12. During the period between two Council sessions, depending on the requirements of the commendation and reward work situation, the Chairman of the Council may decide to seek written opinions from individual Council members. Council members present suggestions and opinions to the Council through the Council Standing Committee.

Article 13. The Council decides on the form of voting by raising hands, secret ballot, or another form according to the resolution of the Council. Specifically, for the examination and awarding of Model Soldiers of the Sector, Model Soldiers of the Nation, Sector Competition Flags, Government Competition Flags, Prime Minister's Certificates of Merit, and various Orders, the form of voting is a secret ballot.

In case of conflicting opinions with equal vote counts, the Council resolves according to the opinion of the Chairman of the Council. Different opinions of Council members are retained and reported to the Minister for consideration and decision.

Article 14. Council members are responsible for informing about the contents of resolutions already adopted by the Council, without disclosing the opinions exchanged by individual members during Council sessions. Representatives of invited units and organizations and staff assisting Council sessions, Council Standing Committee sessions are not permitted to disclose opinions exchanged by Council members during sessions.

Article 15. The operating funds of the Council shall be provided from the annual commendation and reward budget of the Sector. The Ministry's Office shall be responsible for ensuring the necessary conditions to serve the activities of the Council./.
