Pursuant to the Ordinance on Quality of Goods dated December 24, 1999;
Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology and Environment;
Pursuant to Decree No. 86/CP dated December 8, 1995 of the Government stipulating the responsibilities for state management of product quality;
Pursuant to Resolution No. 10/2001/NQ-CP dated August 31, 2001 of the Government's regular session in August 2001;
At the request of the Director General of the Standardization, Measurement, and Quality Control Department,
DECISION:
Article 1. Domestically produced motorcycle helmets (hereinafter referred to as helmets) are products that must be declared as conforming to Vietnamese Standard TCVN 5756 - 2001 "Protective Helmets for Motorcyclists and Motorcycle Riders".
Article 2. The declaration of conformity of helmets with Vietnamese Standard TCVN 5756-2001 shall be carried out in accordance with the "Provisional Regulations on Declaration of Conformity of Products to Standards" issued together with Decision No. 2424/2000/QĐ-BKHCNMT dated December 12, 2000 of the Minister of Science, Technology and Environment.
For the testing of typical helmet samples, enterprises may take samples according to their plans and conduct self-testing if they have appropriate testing equipment in compliance with the provisions of Vietnamese Standard TCVN 5756-2001, or send samples to one of the organizations listed in the Appendix attached hereto for testing.
The list of organizations designated to test the quality of helmets will be adjusted and supplemented promptly when there are changes.
Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Enterprises producing helmets are responsible for implementing this Decision. Within ninety days from the date this Decision takes effect, all enterprises producing helmets must complete the declaration of conformity of helmets with Vietnamese Standard TCVN 5657-2001. The General Department of Standardization, Metrology and Quality Control is responsible for organizing and guiding the implementation of this Decision.
