Regarding the approval of the planning for the Van Phong Bay Economic Zone in Khanh Hoa Province until 2020

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Construction Law dated November 26, 2003;

Considering the proposal of the Minister of Construction at Circular No. 88/TTr-BXD dated December 6, 2004, and the Chairman of the People's Committee of Khanh Hoa Province at Circular No. 175/TT-UB dated January 16, 2004,

DECISION:

Article 1. Approve the Planning for the Van Phong Bay Economic Zone in Khanh Hoa Province until 2020 with the main contents as follows:

1. The scope of the Van Phong Bay Economic Zone Planning includes two districts of Van Ninh and Ninh Hoa, Khanh Hoa Province:

- North bordering Phu Yen Province;

- South bordering Hon Heo;

- South bordering Quynh Luu District, Nghe An Province;

- West bordering mountainous communes of Ninh Hoa and Van Ninh districts.

2. Nature:

It is a comprehensive economic zone where the international container transshipment port plays a leading role, combined with the development of multi-sector and multi-field comprehensive economy including tourism, services, industry, aquaculture, and other economic sectors.

3. Scale:

- Total planned area approximately 150,000 hectares, including approximately 80,000 hectares of water surface and approximately 70,000 hectares of land; of which approximately 8,000 to 10,000 hectares will be used for construction.

- Total population of the entire planned area by 2020 is approximately 400,000 people; of which urban population is approximately 275,000 people.

4. Main directions of development:

a) Northern part of Van Phong Bay:

- Develop marine tourism in the Dai Lang area.

- International transshipment port, marine eco-tourism, bay eco-tourism, commercial and financial center, and residential areas developed on Hon Gom peninsula, Hon Lon, and the entire water area of the bay.

- Urban residential area developed based on the city of Van Gia and Tu Bong area.

- Industrial zones located in Van Thang.

- Ecotourism areas developed on the eastern and southeast parts of Hon Gom peninsula.

b) Southern part of Van Phong Bay:

- Urban areas include Duc Le, Ninh Thuy, Ninh Phuoc connected with Ninh Hoa town, Hon Heo, and Nha Phu lagoon, developing into a third-class city with characteristics of a tourist, service, education, vocational training, and industrial city.

- Develop industrial zones in Ninh Thuy, combined with shipbuilding industrial zones. Construct oil terminal at Hon My Giang and bonded fuel storage; general-purpose port at Hon Khoi northwest of Duc Le.

5. Spatial organization:

The Van Phong Bay Economic Zone consists of two areas, which are also two urban areas: Bac Van Phong and Nam Van Phong.

a) Bac Van Phong Urban Area: a comprehensive economic zone including international container transshipment port - tourism - commerce - industry, comprising the Dai Lang area, Hon Gom peninsula, Hon Lon, Tu Bong, Van Gia town; construction land area approximately 4,500 to 5,300 hectares; population scale approximately 140,000 people.

b) Nam Van Phong Urban Area: a tourist-service-industrial city including Ninh Thuy, Ninh Phuoc, Duc Le, Ninh Hoa town; construction land area approximately 2,300 hectares; population scale approximately 135,000 people.

6. Functional zones:

a) Major port areas:

- Northern part of Van Phong Bay:

+ International container transshipment port area on the eastern shore of Dam Mon inlet: potential area during planning phase approximately 750 hectares; by 2020 approximately 400 hectares; by 2010 approximately 120 hectares; first construction phase in 2006 approximately 40 to 50 hectares.

+ Passenger cruise ship port on the eastern shore of Dam Mon inlet: area approximately 0.5 hectares.

+ Port service area on Hon Gom peninsula, an international container transshipment port service area, approximately 150 hectares.

- Southern part of Van Phong Bay:

+ Oil transshipment port and specialized port at Hon My Giang, including oil port and bonded oil storage with total area approximately 70 to 80 hectares, of which oil port and shipyard port approximately 50 hectares.

+ Hon Khoi port area northwest of Duc Le including provincial general-purpose port, passenger cruise ship port, approximately 4 to 5 hectares.

b) Tourist areas:

- Tourist areas in Bac Van Phong Urban Area include: Tu Week - Hon Ngang resort area (approximately 350 hectares); Cat Tam resort area (approximately 210 hectares); Hon Gom peninsula resort area (approximately 200 hectares); Dai Lang tourist area (approximately 40 hectares).

- Tourist areas in Nam Van Phong Urban Area at Duc Le - Muoi Du area (area approximately 150 hectares)

- In addition, tourist areas such as Ca Ong Mountain, Hon Dau Island, Khai Luong Mountain; Khai Luong fishing village, Hon Cho Cape, Hon Ko, Cuu Bo Cape, Geng Dragon Cape; Ninh Dao fishing village on Hon Lon...

c) Commercial and financial center: in the central area of Hon Gom peninsula, a multifunctional center focusing on service, commerce, finance, and banking; area approximately 400 hectares.

d) Urban residential areas:

- Bac Van Phong Urban Area with an area of approximately 2,150 hectares including new urban areas of Tu Bong, Dam Mon, Dai Lang (approximately 1,650 hectares) and Van Gia town (approximately 500 hectares).

- Nam Van Phong Urban Area with an area of approximately 1,600 hectares including Ninh Hoa town (approximately 500 hectares) and new urban areas of Ninh Thuy - Ninh Phuoc - Duc Le (approximately 1,100 hectares).

đ) Industrial zones:

- Van Thang Industrial Zone (approximately 200 hectares): a multi-sector industrial zone with minimal environmental pollution, utilizing advantages of port services and tourism.

- Ninh Thuy Industrial Zone (approximately 500 hectares): a multi-sector industrial zone.

e) Aquaculture zone: cultivating various seafood such as lobsters, cage fish, pearls, swiftlet nests, coral in Ben Goi anchorage, coastal and water areas along the western coast of Van Phong Bay.

7. Architectural and urban landscape planning:

Architectural and landscape design for each area is determined according to the direction:

- Ensuring harmony in architectural and landscape design among functional zones while maintaining modernity and suitability with the characteristics of the Central Coast region.

- Determining reasonable land use coefficient and building density; effectively utilizing sea space in the bay.

- Preserving natural landscapes and beneficial ecosystems, ensuring sustainable development of the area.

8. Orientation for technical infrastructure development:

a) Transportation:

- External transportation:

+ Air transport: using Cam Ranh airport and Dong Tac airport (Phu Yen); reserving land to form a taxiway airport on Hon Gom peninsula to directly serve the Van Phong Economic Zone.

+ Railways: transfer the existing Thong Nhat railway line out of the center of Van Ga town; construct a railway section to the international transshipment port (approximately 20 km); upgrade and renovate existing stations; build a new station at Lap Tau in Tu Bong and a new station at Van Ga.

+ Waterways: upgrade and renovate Hon Khoi port, Hyundai-Vinashin shipbuilding factory port; construct a new international container transshipment port at Dam Mon, an offshore oil storage facility on Hon My Giang island, and a cruise ship terminal at Dam Mon.

+ Roads: upgrade National Highway 1 to Class I standard, implement traffic safety measures when passing through urban areas and residential zones; for National Highway 26 leading to Dak Lak, connect Highway 26B with Highway 26 in Ninh Trung commune, reaching Class II standards, with a right-of-way of 58 meters; upgrade and renovate provincial roads LB, 6, and 7 in the Van Phong area; construct new bus stations for international services in Van Ga, Tu Bong, Ninh Hoa, and Dam Mon.

- Urban transportation:

+ Main roads: from National Highway 1 to Dam Mon, there are two routes, one for cargo transport serving the port running parallel to the railway, and another for tourism and residents east of the cargo route. The total right-of-way is 100 meters.

+ Upgrade Nguyen Hue Street from Van Ga town to meet National Highway 1 at Van Tho commune, with a right-of-way of 26 meters.

+ Upgrade the Van Ga - Da Ban Dam Road with a right-of-way of 26 meters; the town of Ninh Hoa's main road with a right-of-way of 30 meters; branch roads with a right-of-way of 15 to 17 meters.

b) Drainage:

- Direction of drainage: prohibit discharging wastewater into bathing beaches; wastewater must be treated to meet standards before being discharged into the sea at designated outlets; rainwater should be collected into the storm drain system and directed to rivers, streams, canals, and creeks flowing towards the sea.

- Use separate systems for stormwater and domestic sewage drainage.

c) Water supply:

- Total water demand:

+ In urban areas: by 2010 approximately 32,000 cubic meters/day-night; by 2020 approximately 100,000 cubic meters/day-night.3/per day/night; by 2020 approximately 100,000 m3/per day/night.

+ In rural residential areas: by 2010 approximately 9,000 cubic meters/day-night; by 2020 approximately 10,000 cubic meters/day-night.3+ Utilize water from Hoa Son Lake and Dong Dien Nam Lake for Van Ga town, Van Thang industrial zone, and the new urban area of Tu Bong and Hon Gom.3/per day/night.

- Water sources:

+ Utilize underground water sources, and lakes of Tien Du and Da Ban for the new urban area of Ninh Thuy - Ninh Phuoc and the town of Ninh Hoa.

- Power supply: initially construct a double-circuit line for the existing 110kV Nha Trang - Tuy Hoa transmission line; by 2020, construct a 220kV power source station in Ninh Hoa district.

d) Power supply:

- Distribution network: in urban areas and tourist zones, use underground cables; in suburban areas, use overhead lines.

Wastewater drainage:

đ) construct solid waste treatment facilities in the Hoa Son mountain area and Ninh An commune, Ninh Hoa district. Construct and renovate cemeteries in Van Ga, Van Thang, and Ninh Hoa; build and renovate memorial parks at Hon Vuong. e) Environmental sanitation:

- Determine environmental protection buffer zones for Hoa Son Lake, Tien Du Lake, and underground water extraction areas in Hon Gom peninsula.

- Ships and boats operating in the bay must have equipment to collect and treat waste. Discharge of untreated waste into the bay is prohibited.

- When constructing ports, equip with oil retention devices and emergency response solutions to prevent oil spills.

- Organize teams to manage the collection of marine waste. Establish environmental monitoring stations to track environmental changes in the Van Phong Bay area.

9. Priority investment projects for initial construction:

- Construct an international container transshipment port with a capacity of 0.5 million TEUs.

- Construct a transportation route from National Highway 1A to Dam Mon, including a railway line to the port.

- Construct Hoa Son Reservoir, Dong Dien Nam Reservoir, and Tien Du Reservoir.

- Construct a 110kV submarine cable branch and a 110kV substation at Dam Mon.

- Construct an oil transshipment port with a capacity of 1.5 to 2.0 million tons.

- Construct the My Giang fuel storage facility with a capacity of 0.5 million tons.

- Construct an international passenger port at Dam Mon with a capacity of 1.0 million passengers/year.

- Service projects, postal services, telecommunications, trade, tourism, reforestation projects, and mangrove forests...

- Assign the Ministry of Planning and Investment to lead and coordinate with the People's Committee of Khanh Hoa Province, the Ministry of Construction, the Ministry of Transport, and related ministries and sectors to study and submit to the Prime Minister for consideration and decision on establishing and issuing regulations for the operation of the Van Phong Economic Zone, allowing the Van Phong Economic Zone to enjoy preferential policies similar to those granted to the Chu Lai Open Economic Zone and Dung Quat Economic Zone, and special mechanisms for the international transshipment port.

Article 2. Implementation

- Assign the Ministry of Transport:

+ Lead and coordinate with relevant ministries and sectors and the People's Committee of Khanh Hoa Province to complete detailed planning for the international transshipment port until 2010 and orientation until 2020; prepare an investment report for the development project of the international transshipment port (initial phase) to submit to the Prime Minister for consideration and decision;

+ Lead and coordinate with the Ministry of Planning and Investment to attract potential foreign investors to participate in investing and managing the international transshipment port in Van Phong Bay.

- Assign the Ministry of Agriculture and Rural Development to invest in building Hoa Son Reservoir, Dong Dien Nam Reservoir, and Tien Du Reservoir according to phases of the Van Phong Bay Economic Zone development.

- Assign the Ministry of Trade to review and approve the investment project for the My Giang offshore fuel storage facility.

- Assign the Ministry of Industry to invest in building the power grid according to phases of the Van Phong Bay Economic Zone development.

- Assign the People's Committee of Khanh Hoa Province to announce and organize management of the Van Phong Bay Economic Zone planning in accordance with the law.

This Decision replaces Decision No. 301/QD-TTg dated April 22, 2002 of the Prime Minister approving the general planning orientation for the Van Phong Bay area, Khanh Hoa Province, until 2020.

Article 3. The Ministers of Construction, Transport, Planning and Investment, Finance, Trade, Industry, Agriculture and Rural Development; the Director-General of the Tourism General Administration; heads of related agencies and the Chairman of the People's Committee of Khanh Hoa Province are responsible for implementing this Decision./.

The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Minister of Construction, Ministry of Transport, Ministry of Planning and Investment, Ministry of Finance, Ministry of Trade, Ministry of Industry, Ministry of Agriculture and Rural Development; Director General of the National Administration of Tourism; Heads of relevant agencies and Chairman of the People's Committee of Khanh Hoa Province are responsible for implementing this Decision./.
