Pursuant to the Law on Organization of the Government dated December 25, 2001;
Article 1. Scope of Regulation
This Decision regulates allowances and uniforms for physical education teachers and instructors at public educational institutions within the national education system.
Article 2. Applicability
This Decision applies to physical education teachers and instructors at public educational institutions within the national education system including: general education, vocational education, higher education, specialized schools, and continuing education centers.
Article 3. Allowance System
The allowance is paid in cash and calculated at 1% of the minimum wage for each practical lesson. The cash allowance does not apply to physical education teachers and instructors at educational institutions under the People's Army and Public Security.
Article 4. Uniform System
1. For full-time physical education teachers and instructors teaching physical education and sports subjects, two long-sleeved sport outfits/year, two pairs of sports shoes/year, four pairs of sports socks/year, and four short-sleeved sport shirts/year will be provided.
2. For part-time teachers and instructors (teachers teaching other subjects and concurrently teaching physical education and sports), one long-sleeved sport outfit/year, one pair of sports shoes/year, two pairs of sports socks/year, and two short-sleeved sport shirts/year will be provided. Sports uniforms must be produced in Vietnam and suitable for the climate of each region.
3. The Ministry of Education and Training shall specify the models, types, and quality of sports uniforms to be uniformly implemented at educational institutions.
Article 5. Funding and Payment Methods
1. The funding for the allowances stipulated in Articles 3 and 4 of this Decision shall be implemented according to the following principles:
a) For educational institutions fully funded by the state budget: The funding for payment shall be guaranteed by the state budget and included in the annual budget estimate of the educational institution according to the current state budget management hierarchy;
b) For educational institutions partially self-funded: The funding for payment shall be guaranteed from the unit's operating revenue and the regular operating funds provided by the state budget according to the current state budget management hierarchy;
c) For private educational institutions: Based on legitimate sources of income to implement the allowances and uniform regulations set forth in this Decision.
2. Implementation methods:
a) Cash allowances are paid together with monthly salaries;
b) Uniforms are issued once a year at the beginning of the academic year.
Article 6. Implementation Organization
1. The Ministry of Education and Training and the Ministry of Finance shall direct inspections of the implementation of this Decision.
2. The Ministry of Finance shall be responsible for allocating the annual budget and guiding prices for uniforms to implement the payment system as prescribed by the State Budget Law.
3. Provincial and municipal people's committees shall organize guidance, inspection, and supervision of the implementation of allowances and uniforms at public educational institutions within their jurisdictions.
Article 7. Effective Date
This Decision takes effect from January 1, 2013. All provisions contrary to this Decision are abolished.
Article 8. Responsibility for Implementation
THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
