Provincial Health Prevention Centers under the Central Government

This Circular prescribes procedures for receiving, providing health care for domestic violence victims and statistical reports on domestic violence victims at medical facilities.

Pursuant to Decree No. 85/2012/NĐ-CP dated October 15, 2012 of the Government on the operational mechanism, financial mechanism for public health institutions and service fees for medical examination and treatment at public medical facilities;

Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;

Considering the proposal of the Director of the Department of Organization and Cadres and the Director of the Preventive Health Department;

The Minister of Health issues this Circular stipulating the functions, tasks, powers, and organizational structure of Provincial Health Prevention Centers under the Central Government.

Article 1. Position and Functions

Article 1. Provincial Health Prevention Centers under the Central Government (hereinafter referred to as Provincial Health Prevention Centers) are public health institutions directly under the Provincial Health Departments, with the function of directing and organizing the implementation of specialized and technical tasks related to preventive healthcare within their province; organizing public health services according to the laws.

Article 2. Provincial Health Prevention Centers have legal personality, seals, separate bank accounts, and working premises as prescribed by law.

Article 3. Provincial Health Prevention Centers are subject to the direction and management of organization, operation, and resources by the Provincial Health Departments; they are also subject to professional and technical guidance, inspection, and supervision by the Ministry of Health.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

Clause 1. Develop plans and implement specialized and technical tasks related to preventive healthcare based on the orientation, policies, strategies, and plans of the Ministry of Health and the actual situation of the locality, to be submitted to the Provincial Health Department for approval: disease surveillance, prevention and control of infectious diseases, non-communicable diseases, social diseases; quarantine; environmental health, occupational health, school health; quality of drinking water and domestic water; food safety testing; community nutrition; hygiene and disease prevention; vaccine and medical product management and use; biosafety; prevention of accidents and injuries; activities to improve health and prevent risk factors affecting health; early screening and outpatient management and treatment of infectious and non-communicable diseases.

Clause 2. Direct, guide, and supervise the professional and technical work related to preventive healthcare for district health centers or district health prevention centers, medical facilities, and commune health stations within the province.

Clause 3. Implement risk communication activities; coordinate with relevant units to organize and implement information, communication, and health education activities in the field of preventive healthcare.

Clause 4. Develop training plans and continuously train staff in professional and technical skills; participate in training and continuous training in professional and technical fields according to provincial and central plans; serve as a practical base for health training institutions in the province and at the central level in the field of preventive healthcare.

Clause 5. Conduct research and participate in scientific research and application of technological advancements in the field of preventive healthcare.

Clause 6. Propose, manage, and implement projects, programs, national health targets, and international cooperation in preventive healthcare within the province when authorized and approved by competent authorities.

Clause 7. Organize the implementation of preventive healthcare services, community health care, and early screening and outpatient management and treatment of infectious and non-communicable diseases.

Clause 8. Organize the implementation of inspection and evaluation activities in the field of preventive healthcare within the province.

Clause 9. Implement personnel management, civil servant management, employee management, and financial and asset management of the unit according to the provisions of the law.

10. Implement statistical and reporting systems as prescribed by law.

Clause 11. Perform other rights and duties assigned by the Provincial Health Department and competent state agencies.

Article 3. Organizational Structure

1. Leadership of the Center

Point a) Provincial Health Prevention Centers shall have a Director and Deputy Directors as prescribed by law;

Point b) The Director of the Provincial Health Prevention Center is responsible before the Director of the Provincial Health Department and the law for all activities of the Center;

Point c) Deputy Directors of the Provincial Health Prevention Center are responsible for one or more areas of work assigned by the Director; they are responsible before the Director and the law for the tasks assigned to them. When the Director is absent, a Deputy Director may be delegated by the Director to manage the operations of the Center;

Point d) The appointment and removal of the Director and Deputy Directors of the Provincial Health Prevention Center shall be carried out according to the law and the delegation of cadre management by the provincial People's Committee.

2. Functional Departments

b) Planning and Finance Department.

3. Specialized Departments

Point a) Infectious Disease Control Department;

Point b) Non-Infectious Disease Control and Nutrition Department;

Point c) Environmental Health and School Health Department;

Point d) Occupational Health Department (established in provinces without a Labor and Environment Health Center);

Point đ) Malaria, Parasites, and Insects Department (established in provinces without a Malaria, Parasites, and Insects Center);

Point e) Health Quarantine Department (established in provinces with health quarantine activities but without an International Health Quarantine Center);

Point g) Outpatient Consultation and Preventive Treatment Room. For the multi-specialty outpatient room, it can only be established when meeting the conditions prescribed by relevant laws and being approved by the competent authority;

Point h) Laboratory Department.

In addition to the above departments and rooms, depending on the specific needs and capabilities of the Center, some other departments and rooms will be established by the competent authority when meeting the conditions and according to the law.

Article 4. Job positions and number of staff

1. The position, number of staff, and structure of civil servants according to occupational titles of the Provincial Preventive Health Center shall be determined based on the job position plan of the Center, which has been reviewed and approved by the competent state agency in accordance with the provisions of the law. In addition to the assigned personnel, the Director of the Provincial Preventive Health Center may enter into labor contracts to meet the needs of performing tasks and workload as prescribed by law.

2. The management and utilization of human resources of the Provincial Preventive Health Center shall be carried out in accordance with the provisions of the law.

Article 5. Effective Date

This Circular takes effect from March 1, 2015.

Abolish Decision No. 05/2006/QĐ-BYT dated January 17, 2006 of the Minister of Health stipulating the functions, duties, powers, and organizational structure of the Provincial Preventive Health Center from the date this Circular takes effect.

Article 6. Responsibility for Implementation

1. The Department of Preventive Medicine, Ministry of Health shall take the lead in organizing, guiding, and inspecting the implementation of this Circular.

2. Departments of Health of provinces and centrally-run cities shall base on the guidance provided in this Circular to specify concretely the tasks, powers, and organizational structure of the Provincial Preventive Health Center of provinces and centrally-run cities for submission to the People's Committee of the province.

Any issues arising or difficulties encountered during the implementation process shall be promptly reported to the Ministry of Health for consideration and resolution within its authority./.
