Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 66/2005/NĐ-CP dated May 19, 2005 of the Government on ensuring safety for persons and fishing vessels engaged in aquatic activities;

Pursuant to Decree No. 89/2015/ND-CP dated October 7, 2015 of the Government amending and supplementing certain articles of Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on some policies for developing fisheries;

Pursuant to Decree No. 89/2015/NĐ-CP dated October 7, 2015 of the Government amending and supplementing certain articles of Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies for developing aquaculture;

At the proposal of is a record made on paper or electronically documenting daily fishing operations at sea of fishing vessels.

The Minister of Agriculture and Rural Development issues this Circular stipulating technical requirements and safety technical inspection of second-hand marine engines installed on fishing vessels.

Article 1. Scope of Regulation

This Circular stipulates technical requirements and safety technical inspection of second-hand marine engines installed on fishing vessels in cases where the main engine power of the second-hand marine engines is upgraded to 400 HP or more according to Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies for developing aquaculture and Decree No. 89/2015/NĐ-CP of the Government amending and supplementing certain articles of Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies for developing aquaculture (hereinafter referred to as Decree No. 67/2014/NĐ-CP and Decree No. 89/2015/NĐ-CP).

Article 2. Applicability

This Circular applies to organizations and individuals related to upgrading the power of fishing vessel engines and inspecting the safety technical condition of second-hand marine engines before installation on fishing vessels according to Decree No. 67/2014/NĐ-CP and Decree No. 89/2015/NĐ-CP.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Second-hand marine engine is a type of engine designed and manufactured for installation as the main engine driving the propeller on watercraft, bearing specific marks according to the product type defined by the manufacturer, which has been used as the main engine installed on other watercraft (hereinafter referred to as old marine engine).

2. Technical requirements for old marine engines are the specifications and criteria that the old marine engines must meet when installed on fishing vessels to ensure safety for persons and fishing vessels engaged in aquatic activities.

3. Safety technical inspection of old marine engines is the task carried out by the Fishing Vessel Inspection Authority to inspect and evaluate the conformity of the technical parameters of old marine engines with current standards and technical documentation of the manufacturer.

Article 4. Technical requirements for old marine engines

1. Usage period not exceeding 10 years from the date of production.

2. Produced in accordance with standards compatible with the provisions of National Technical Regulation QCVN 21:2010/BGTVT - Classification and Construction Standards for Steel-Hulled Seagoing Ships, Vietnamese Standard TCVN 6718:2000 - Classification and Construction Standards for Seagoing Fishing Vessels, Vietnamese Standard TCVN 7111:2002 - Classification and Construction Standards for Small Seagoing Fishing Vessels, or compatible with the standards of G7 countries regarding safety, energy efficiency, and environmental protection.

3. Crankshaft, cylinder, and piston wear does not exceed the repair limits specified by the manufacturer.

4. Technical documentation accompanying the engine

a) For imported old marine engines

Original Certificate of Appraisal regarding the year of manufacture and production standards of the old marine engine in compliance with Clause 1 and Clause 2 of this Article issued by an appraisal organization announced on the website of the Ministry of Science and Technology or the original Confirmation Letter from the manufacturer regarding the year of manufacture and production standards of the old marine engine; technical manuals for installation, operation, and maintenance of the engine provided by the manufacturer; a record of some technical parameters of the engine established by the supplier according to the model prescribed in Appendix I attached to this Circular.

b) For old marine engines already used in Vietnam

The most recent initial, periodic, or annual technical inspection report issued by the registration authority.

Article 5. Technical Safety Inspection of Used Marine Machinery

1. Pre-installation inspection before mounting on vessels

a) External inspection

The machinery shall not have cracks, fractures, welding repairs, dents; the letters and numbers printed on the machinery label must be clear and consistent with the technical documentation of the machinery; all gauges must be complete and intact.

b) Operational testing

Test starting the machine, test the lowest stable RPM and the highest RPM, test sudden acceleration and deceleration; technical indicators such as lubricating oil pressure, coolant temperature, exhaust gas temperature must remain within the limits allowed by the manufacturer.

c) Inspection results

When the used marine machinery meets all technical requirements stipulated in Article 4 and Clause 1, Clause 2 of this Article, the Fisheries Registration Authority shall issue a Technical Inspection Report for Used Marine Machinery before installation on vessels (in accordance with Form II attached to this Circular).

2. Post-installation inspection after mounting on vessels

To be carried out in accordance with the Fisheries Registration Regulations issued together with Decision No. 96/2007/QĐ-BNN dated November 28, 2007 of the Ministry of Agriculture and Rural Development.

Article 6. Implementation Organization

1. Responsibilities of the Fisheries General Department

a) Organize the dissemination, promotion, and implementation of this Circular to relevant units, organizations, and individuals;

b) Guide and organize the technical safety inspection of used marine machinery in accordance with the provisions of this Circular.

2. Responsibilities of the Departments of Agriculture and Rural Development

a) Organize the dissemination and promotion of this Circular to relevant units, organizations, and individuals under their management jurisdiction;

b) Organize the technical safety inspection of used marine machinery according to the分级管理 (management levels);

c) Report the implementation status of this Circular to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) when required.

3. Responsibilities of the vessel owners

a) Provide registration files to the registration authority as prescribed in Clause 4, Article 4 of this Circular;

b) Cooperate with the registration authority to carry out the technical safety inspection of used marine machinery as prescribed.

Article 7. Implementation Provisions

1. This Circular takes effect from February 15, 2016.

2. Units under the Ministry of Agriculture and Rural Development, Departments of Agriculture and Rural Development of provinces and centrally-administered cities, and related organizations and individuals are responsible for implementing this Circular.

3. In the course of implementation, if any issues arise, organizations and individuals shall promptly report them to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for review and adjustment to ensure appropriateness./.
