Pursuant to DecreeNo. The Government issues this Decision on some special financial mechanisms for the Vietnam Civil Aviation Authority.1This Decision stipulates some special financial mechanisms for the Vietnam Civil Aviation Authority.on Article 2. Some Special Financial Mechanisms of the Vietnam Civil Aviation Authority

At the proposal of the Minister of Transport;

The Prime Minister"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."1. The Vietnam Civil Aviation Authority (excluding Air Port Control Units and public service organizations) shall implement some special mechanisms as follows:urinary catheter đNo.a) Contents of special expenses included in the operating budget under the self-management regime:

Article 1. Scope of Regulation and Applicability

- Adjustment factor for basic salary increase:

Officials and civil servants within the authorized staffing quota and those working under labor contracts as prescribed in Decree No. 68/2000/ND-CP dated November 17, 2000 of the Government shall be subject to an adjustment factor of 0.8 times the basic salary set by the Government. The increased salary includes the salary according to rank, grade, position, and current allowances, excluding night shift pay and overtime pay. The increased salary shall not be used for social insurance, health insurance, unemployment insurance, and trade union fees.

The subjects specified herein shall not apply during the following periods:

+ On overseas trips, work, or study receiving 40% of their salary as prescribed in Clause 4, Article 8 of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regulations for officials, civil servants, public employees, and armed forces;

+ Studying domestically for three consecutive months or more;

+ Taking leave without pay;

+ Being on sick leave or maternity leave exceeding the period prescribed by laws on social insurance;

+ Being suspended from duty or detained.

- Safety bonus system:

Officials and civil servants directly involved in air traffic management, supervision, and safety assurance shall be entitled to a safety bonus of 15% of their current salary according to rank, grade, plus leadership position allowance (excluding other allowances).

The Ministry of Transport shall issue the safety bonus regulation for air traffic in accordance with safety standards, procedures, and norms established by competent state authorities and supervise its implementation.

b) Contents of special expenses not included in the operating budget under the self-management regime:

- Hiring flight safety supervisors and qualified flight safety inspectors working regularly at the Vietnam Civil Aviation Authority.

Based on job requirements, the Ministry of Transport shall decide on hiring supervisors at appropriate rates.

- Training costs, international cooperation costs, and costs for organizing quality service evaluations in specialized aviation fields.

Based on the annual budget approved by the competent authority, the Ministry of Transport shall allocate the budget for the Vietnam Civil Aviation Authority to implement in accordance with the law.

- Uniform costs:

The Ministry of Transport shall establish uniform regulations in accordance with current provisions.

c) If there is any surplus in the self-managed budget, it may be used for expenditures as prescribed in Decree No. 130/2005/ND-CP dated October 17, 2005 of the Government on the self-management and self-responsibility system regarding staffing and administrative management budgets for state agencies, and Decree No. 117/2013/ND-CP dated October 7, 2013 of the Government amending and supplementing certain articles of Decree No. 130/2005/ND-CP dated October 17, 2005 of the Government on the self-management and self-responsibility system regarding staffing and administrative management budgets for state agencies; in which, additional income for officials and civil servants shall not exceed 1.0 times the basic salary according to rank, grade, and position prescribed by the State.

d) Sources of funds to ensure special expenditure regimes:

- From the state budget allocated for administrative management expenses.

- Fees from airport concession operations retained by Air Port Control Units as prescribed.

- Fees retained in the aviation sector and other revenues as prescribed by law (if any).

The Ministry of Finance shall be responsible for guiding the sources of funds mentioned above.

2. Air Port Control Units shall implement the self-management regime as prescribed in Decree No. 141/2016/ND-CP dated October 10, 2016 of the Government on the self-management mechanism for public service organizations in economic services and other services.

1. This Decision shall take effect from January 15, 2017 and apply from the 2017 fiscal year, replacing Decision No. 12/2012/QD-TTg dated February 15, 2012 of the Prime Minister on piloting some special financial mechanisms for the Vietnam Civil Aviation Authority.

- Revenue from aviation fees retained in the aviation sector and other revenues as prescribed by law (if any).

The Ministry of Finance shall be responsible for guiding the sources of funds to ensure the special expenditure regime mentioned above.

2. Civil Aviation Control Stations shall implement the autonomy regime pursuant to Decree No. 141/2016/NĐ-CP dated October 10, 2016 of the Government on the mechanism of autonomy for public service units in the economic service and other services sectors.

Article 3. Implementation Organization

1. This Decision takes effect from January 15, 2017 and applies from the 2017 budget year; replacing Decision No. 12/2012/QĐ-TTg dated February 15, 2012 of the Prime Minister on piloting certain special financial mechanisms of the Vietnam Civil Aviation Authority.

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
