DECISION OF THE MINISTER OF SCIENCE, TECHNOLOGY AND ENVIRONMENT
On the management of the quality of imported motorcycle helmets
MINISTER OF THE MINISTRY OF SCIENCE AND TECHNOLOGY AND ENVIRONMENT
Pursuant to the Quality of Goods Ordinance on December 24, 1999;
Pursuant to the Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry;of Science, Technology, and Environment;
Pursuant to the Decree No. 86/CP dated December 8, 1995 of the Government stipulating the division of responsibilities for state management of goods quality;
Pursuant to the Resolution of the regular meeting of the Government in August 2001 No. 10/2001/NQ-CP dated August 31, 2001;
At the proposal of the Director General of the Standard Metrology Quality Control Department,
DECISION:
Article 1. Imported motorcycle helmets (hereinafter referred to as imported helmets) must comply with the Vietnamese Standard TCVN 5756 - 2001 "Protective Helmets for Motorcyclists and Motor Vehicle Riders" or equivalent national standards of the exporting country.5756 - 2001 "Protective Helmets for Motorcyclists and Motor Vehicle Riders" or equivalent national standards of the exporting country.
Article 2. Imported helmets must be inspected for quality and certified as compliant with TCVN 5756 - 2001.
The quality inspection of imported helmets shall be carried out by one of the designated certification organizations or testing laboratories of the exporting country.
Article 3. The aforementioned quality inspection shall be conducted on each batch of imported goods into Vietnam. Imported helmets certified/tested as compliant with TCVN 5756 - 2001 must be marked with a certification label or logo of the designated certification organization/testing laboratory before importation into Vietnam. 5756 - 2001 must be marked with a certification label or logo of the designated certification organization/testing laboratory before importation into Vietnam.
A batch of imported helmets will meet the conditions for importation when all helmets in the batch are marked with a certification label or logo of the designated certification organization/testing laboratory.
Article 4. Entrust the Standard Metrology Quality Control Department to designate certification organizations/testing laboratories of the exporting country to conduct quality inspections of helmets.
The Standard Metrology Quality Control Department shall announce the list of such certification organizations/testing laboratories to importing enterprises and relevant state agencies for coordinated management.
Article 5This Decision takes effect from December 1, 2001.
Importing enterprises of motorcycle helmets are responsible for implementing this Decision.
The Standard Metrology Quality Control Department is responsible for organizing and guiding the implementation of this Decision./.
