Regarding amending and supplementing Circular No. 106/2009/TT-BTC dated May 26, 2009 on the amount of road usage fee collection, payment, management, and utilization at the Nam Haivan Toll Station and Decision No. 43/2005/QD-BTC dated July 8, 2005 on the amount of road usage fee collection, payment, management, and utilization for passing through the Haivan Tunnel on National Highway 1A

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges;

Pursuant to Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing some articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges;
After considering the opinions of the Ministry of Transport in Circular No. 9231/BGTVT-TC dated December 31, 2009 and Circular No. 795/BGTVT-TC dated February 12, 2010;
Pursuant to the Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
The Ministry of Finance hereby stipulates the road usage fee at the Nam Haivan Tunnel toll station and the North Haivan Tunnel toll station, National Highway 1A, as follows:
- Replacing the Table of Road Usage Fee Amounts for the Nam Haivan Toll Station issued together with Circular No. 106/2009/TT-BTC dated May 26, 2009 of the Ministry of Finance on the amount of road usage fee collection, payment, management, and utilization at the Nam Haivan Tunnel toll station and Hoaphuoc toll station, National Highway 1A, Da Nang City, and replacing the Table of Road Usage Fee Amounts for the Haivan Tunnel specified in Decision No. 43/2005/QD-BTC dated July 8, 2005 of the Ministry of Finance on the amount of road usage fee collection, payment, management, and utilization for passing through the Haivan Tunnel, National Highway 1A with the Table of Road Usage Fee Amounts attached to this Circular.
Article 1.
- Monthly tickets and quarterly tickets prescribed in this Circular shall only apply to vehicles traveling through a specific station (Vehicles passing through the North Haivan Tunnel station purchase tickets from the North Haivan Tunnel station, vehicles passing through the Nam Haivan Tunnel station purchase tickets from the Nam Haivan Tunnel station).
2. Other provisions regarding road usage fees shall continue to be implemented according to the provisions of Decision No. 43/2005/QD-BTC dated July 8, 2005 of the Ministry of Finance on the amount of road usage fee collection, payment, management, and utilization for passing through the Haivan Tunnel, National Highway 1A and Circular No. 106/2009/TT-BTC dated May 26, 2009 on the amount of road usage fee collection, payment, management, and utilization at the Nam Haivan Tunnel toll station and Hoaphuoc toll station, National Highway 1A, Da Nang City.
Article 2. Implementation clause
1. This Circular shall take effect 45 days from the date of signature.
3. In the course of implementation, if there are any difficulties, it is requested that relevant agencies, organizations, and individuals promptly report to the Ministry of Finance for research and supplementary guidance.

- For the application of fee levels for container-carrying vehicles (including dedicated tractor-trailers): The fee level shall be applied based on the designed load capacity of the vehicle, regardless of whether it is loaded or not, including cases where the container's load capacity is less than the designed load capacity, the fee level shall still be applied based on the designed load capacity. / .
