Pursuant to the Law Torganization C"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."pursuant to the Government's Resolution dated December 25, 2001;

Article 1. Scope of Regulation
||| Retiring (including cases where they wait until the age to receive the pension and retain the social insurance payment period to receive the pension) within the period from January 1, 1994, to May 31, 2011;
Article 2. Applicability
||| Receiving the pension at the time of January 1, 2012. In cases where the pension is temporarily suspended according to the Social Insurance Law, they will receive the allowance after resuming the pension.
Article 3. Conditions for receiving subsidies
||| The amount of one-time allowance in cash is determined according to the following formula:

B||| The funding for implementing the allowance stipulated in Article 4 of this Decision shall be guaranteed by the central budget in accordance with the laws on state budget.
Article 4. Level of Allowance

If the Social Security does not approve, it must provide a written response and specify the reasons.

Article 5. Source of funds for implementation

a) ||| The Ministry of Education and Training and the Ministry of Finance shall inspect the implementation of the provisions of this Decision.
b) A copy of the decision on receiving retirement benefits of those entitled to allowances as stipulated in Article 2 of this Decision.
2. Deadline for Resolution
a) Within thirty working days from the date when the Social Insurance agency receives complete application files from persons meeting the conditions for allowance entitlement as provided for in Clause 1 of this Article.onems.developmentied writing and clearly state the reasons.amendprovide n copies and specify the reasons.
b) The allowance shall be paid in the month immediately following the month in which the allowance entitlement was resolved.
Article 7. Effective Date
This Decision takes effect from October 15, 2013.
Article 8. Responsibility for Implementation
1. The Ministry of Finance shall allocate funds from the State budget for the Vietnam Social Security to implement the provisions set forth in this Decision.
2. The Vietnam Social Security has the responsibility to guide and organize the implementation of allowance payments as prescribed in this Decision.
3. The Ministry of Education and Training and the Ministry of Finance shall inspect the implementation of the provisions set forth in this Decision.
4. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
