Issuing the "National Technical Regulation on Electromagnetic Compatibility for Terminal Equipment and Accessories in Mobile Communication Systems"

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Telecommunications dated November 24, 2023;

Pursuant to the Law on Radio Frequency dated November 23, 2009 and the Law Amending and Supplementing Certain Provisions of the Law on Radio Frequency dated November 9, 2022;

Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 78/2018/NĐ-CP amending and supplementing certain provisions of Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

At the proposal of the Director of the Radio Frequency Management Department and the Head of the Legal Department;

The Minister of Science and Technology issues this Circular issuing the "National Technical Regulation on Electromagnetic Compatibility for Terminal Equipment and Accessories in Mobile Communication Systems".

Article 1.The National Technical Regulation on Electromagnetic Compatibility for Terminal Equipment and Accessories in Mobile Communication Systems (QCVN 86:2025/BKHCN) is hereby promulgated together with this Circular.

Article 2. Effective Date

1. This Circular shall take effect from February 15, 2026.

2. Circular No. 10/2019/TT-BTTTT dated October 4, 2019 of the Minister of Information and Communications promulgating the "National Technical Regulation on Electromagnetic Compatibility for Terminal Equipment and Accessories in Mobile Communication Systems"

Article3. Implementation Schedule

1. Terminal equipment and accessories listed in Item 1.1.1 of Appendix I and terminal equipment and accessories listed in Item 4.9 of Appendix II of Circular No. 29/2025/TT-BKHCN dated November 13, 2025 of the Minister of Science and Technology stipulating the list of products and goods that may cause safety risks in the field of information technology and telecommunications under the management responsibility of the Ministry of Science and Technology, having Harmonized System (HS) codes 8517.13.00; 8517.14.00; 8517.62.59:

a) Apply QCVN 86:2025/BKHCN to replace QCVN 86:2019/BTTTT from January 1, 2027.

b) Enterprises, organizations, and individuals may choose to test according to QCVN 86:2025/BKHCN or QCVN 86:2019/BTTTT to serve conformity declaration from the effective date of this Circular until December 31, 2026.

2. Terminal equipment and accessories listed in Item 1.1.2 of Appendix I and terminal equipment and accessories listed in Item 1.1.11 of Appendix I of Circular No. 29/2025/TT-BKHCN dated November 13, 2025 of the Minister of Science and Technology stipulating the list of products and goods that may cause safety risks in the field of information technology and telecommunications under the management responsibility of the Ministry of Science and Technology, having HS codes 8517.13.00; 8517.14.00; 8517.62.59:

a) Apply QCVN 86:2025/BKHCN to replace QCVN 18:2022/BTTTT from January 1, 2027.

b) Enterprises, organizations, and individuals may choose to test according to QCVN 86:2025/BKHCN or QCVN 18:2022/BTTTT to serve conformity declaration from the effective date of this Circular until December 31, 2026.

3. The technical requirements for GSM technology (2G and 2.5G) will not be applied in QCVN 86:2025/BKHCN and QCVN 86:2019/BTTTT from September 16, 2026.

Article4Implementation Organization

1. The Chairman of the National Standardization, Metrology, and Quality Control Committee, the Director of the Office, the Director of the Radio Frequency Management Department, the Director of the Telecommunications Department, the Heads of agencies and units under the Ministry of Science and Technology, the Directors of Provincial and Municipal Science and Technology Departments, and related organizations and individuals are responsible for implementing this Circular.

2. In the course of implementation, if any difficulties arise, agencies, organizations, and individuals shall promptly report in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as appropriate./.
