CIRCULAR

AMENDING AND ADDING CERTAIN PROVISIONS OF CIRCULAR NO. 39/2016/TT-NHNN

DATED DECEMBER 30, 2016 ISSUED BY THE GOVERNOR OF THE STATE BANK OF VIETNAM

ON LENDING ACTIVITIES OF CREDIT ORGANIZATIONS,

FOREIGN-BANK BRANCHES FOR CUSTOMERS

BASED ON THE LAW ON THE STATE BANK OF VIETNAM NO. 46/2010/QH12;

BASED ON THE LAW ON CREDIT ORGANIZATIONS No. 32/2024/QH15;

BASED ON DECREE No. 26/2025/NĐ-CP OF THE GOVERNMENT ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATION STRUCTURE OF THE STATE BANK OF VIETNAM;

AT THE RECOMMENDATION OF THE DIRECTOR OF THE DEPARTMENT OF MONETARY POLICY;

THE GOVERNOR OF THE STATE BANK OF VIETNAM ISSUES THIS CIRCULAR AMENDING AND ADDING CERTAIN PROVISIONS OF CIRCULAR No. 39/2016/TT-NHNN DATED DECEMBER 30, 2016 ON LENDING ACTIVITIES OF CREDIT ORGANIZATIONS, FOREIGN-BANK BRANCHES FOR CUSTOMERS.

ARTICLE 1. AMEND AND SUPPLEMENT Clause 3 of Article 22

“3. Within 10 (ten) working days from the date of issuance or amendment and supplementation of internal regulations on lending, credit organizations subject to micro-prudential supervision by the State Bank shall submit such internal regulations to the State Bank Branch Area; other credit organizations shall submit them to the State Bank of Vietnam (Department for Management and Supervision of Credit Organizations).”.

ARTICLE 2. AMEND AND SUPPLEMENT Clause 2 of Article 35

“The heads of units under the State Bank of Vietnam, credit organizations, foreign-bank branches shall be responsible for implementing this Circular.”.

ARTICLE 3. RESPONSIBILITY FOR IMPLEMENTATIONThe heads of units under the State Bank of Vietnam, credit organizations, foreign-bank branches shall be responsible for implementing this Circular.

ARTICLE 4. EFFECTIVE DATE

This Circular takes effect from December 25, 2025./. DIRECTOR
