Pursuant to Decree No. 81/CP dated November 8, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Culture and Information;
Pursuant to Decree No. 48/CP dated July 17, 1995 of the Government on the organization and operation of the film industry;

Article 1.- Attached hereto is the "Regulation on the Organization and Operation of Central Film Review Boards" to replace the "Regulation on the Organization and Operation of the Central Film Review Board" issued together with Decision No. 869/QĐ-VP dated September 8, 1990 of the Minister of the Ministry of Culture and Information - Sports and Tourism.
Article 2.- THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Article 3.- The Heads of the Ministry's Office, Heads of Departments for Organization and Cadres, Directors of the Cinema Department, Directors of film production units throughout the country, Directors of Fafim Vietnam Company, and members of the Central Film Review Boards are responsible for implementing this Decision.
REGULATIONS
ORGANIZATION AND OPERATION OF THE CENTRAL FILM REVIEW BOARDS
(Issued together with Decision No.: 527/QĐ/ĐA dated March 7, 1997 of the Minister of the Ministry of Culture and Information)
Article 1.- The Central Film Review Boards are organizations of the Ministry of Culture and Information with the function of advising the Minister of Culture and Information on reviewing and evaluating films produced domestically or imported from abroad.
Article 2.- The Minister of Culture and Information authorizes the Director of the Cinema Department to consider the advisory opinions of the Central Film Review Boards to decide whether to permit or not permit the distribution of those films within and outside the territory of the Socialist Republic of Vietnam.
Article 3.- The Central Film Review Boards consist of members who are experts in cinema (management officials, theoretical critics, artists...), appointed or invited by the Minister of Culture and Information (if the member belongs to an organization outside the Ministry).
Each Central Film Review Board includes:
- Chairperson of the Council.
- A number of Deputy Chairmen.
- Other Members.
For films related to other sectors, representatives of those sectors may be invited when reviewing films.
Article 4.- The Cinema Department is the permanent body of the Central Film Review Boards, responsible for organizing and ensuring all activities of the Boards.
Article 5.- The Central Film Review Boards operate according to the following principles:
1. All members have the right to contribute opinions and are responsible for their evaluation and commentary on each film presented for review and for all activities of the Board, and have the right to reserve their opinion after the Chairman of the Board has concluded.
2. The Chairman of the Board presides over the meetings of the Board. In the absence of the Chairman, the Deputy Chairman of the Board is authorized to preside.
3. When reviewing films, members of the Board must record their full opinions on the comment form and transfer it to the Board secretary to complete the film review file.
The film review file includes:
- The registration form for presentation accompanied by the self-assessment and evaluation of the production company (for production companies outside the Ministry of Culture and Information, there must be confirmation from the immediate superior supervisory agency).
- Comment forms of the Board members.
- Minutes summarizing the opinions of the Board signed by the Chairman or Deputy Chairman of the Board.
The film review file must be submitted to the Director of the Cinema Department for consideration and decision at the latest two days after the film review.
4. A film review session is considered valid if at least one of the Chairmen or Deputy Chairmen and three regular members of the Board are present.
Article 6.- When there is a complaint from the author or the film production unit and at the request of the Director of the Cinema Department, the Central Film Review Board shall be responsible for reviewing its conclusions regarding the work so that the Director of the Cinema Department may decide or report to the leadership of the Ministry of Culture and Information.
Article 7.- In addition to film review sessions, the Central Film Review Boards must organize two meetings annually to assess, evaluate, and draw lessons from the activities of each member and the Board.
The leadership of the Cinema Department is responsible for attending film review sessions and regular meetings of the Boards.
Article 8.- To ensure democracy and objectivity in the evaluation and comments on films, members of the Board and other participants, when not authorized, must absolutely refrain from casually disseminating discussions of the Board.
Article 9.- Members of the Board are entitled to remuneration for each film review session according to the regulations of the Ministry of Culture and Information. The Cinema Department is responsible for monitoring and implementing payment of remuneration to each member of the Board. Leaders of the Cinema Department who attend film reviews and staff serving the review Boards also receive remuneration when participating in film reviews. The amount of remuneration for each category above is proposed by the Director of the Cinema Department to the Minister of Culture and Information for approval.
Article 10.-
1. Members of the Central Film Review Board must fully participate in all film review sessions and other activities of the Board and must comply with the provisions of this regulation. When absent for a long period, they must report in advance to the Chairman or Vice-Chairman of the Board.
It is strictly prohibited for members of the Board to abuse their responsibilities and powers to engage in actions contrary to this regulation.
2. Based on the actual performance results of each member, upon the recommendation of the Chairman of the Board and the Director of the Cinema Department, the Minister of Culture and Information will consider rewarding members of the Board with achievements, handling those complained about in writing by film production and distribution units regarding their quality and work capacity, and removing from office those who miss more than half of the Board's working sessions in a year.
Article 11.- The term of operation of the Central Film Review Boards is two years.
Article 12.- This regulation replaces the Regulation on the Organization and Operation of the Central Film Review Board (annexed to Decision No. 869/QĐ-VHTT dated September 8, 1990 of the Minister of Culture and Information - Sports and Tourism) and takes effect fifteen days after the date of issuance.
All provisions contrary to this regulation are abolished.
