JOINT CIRCULAR
GUIDELINES FOR IMPLEMENTING CERTAIN REGIMES AND POLICIES FOR MANAGEMENT STAFF, TEACHERS, AND INSTRUCTORS OF NATIONAL DEFENSE AND SECURITY EDUCATION
Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 186/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor - War Invalids and Social Affairs;
Pursuant to Decision No. 257/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating regulations on frequency band allocation for economic and social purposes, national defense, and security;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
BASED ON DECREE NO. 116/2007/NĐ-CP OF JULY 10, 2007, ISSUED BY THE GOVERNMENT ON NATIONAL DEFENSE AND SECURITY EDUCATION;
The Ministry of Education and Training, the Ministry of Labor, Invalids and Social Affairs, the Ministry of National Defense, and the Ministry of Finance jointly issue guidelines for implementing certain regimes and policies for management staff, teachers, and instructors of national defense and security education as follows:
Article 1. Scope of Regulation and Applicability
1. This Circular provides guidance on the regime of lecture subsidies, uniform allowances; standard teaching hours for teachers and instructors of national defense and security education; framework standards for management staff of national defense and security education; other benefits for management staff and instructors of national defense and security education who are seconded officers.
2. This Circular applies to:
a) Full-time or part-time teachers and instructors of national defense and security education in secondary schools, general schools with multiple levels including secondary level, vocational colleges, vocational training centers, vocational colleges, universities, and student national defense and security education centers (hereinafter referred to as teachers and instructors of national defense and security education);
b) Subject department management staff, faculty management staff of national defense and security education; subject course management staff of national defense and security education under provincial education and training departments; management staff of student national defense and security education centers (hereinafter referred to as management staff of national defense and security education).
Article 2: Lecture Subsidy Regime
1. The subjects specified in point a, Clause 2, Article 1 of this Circular (including instructors who are seconded officers) shall be entitled to a subsidy of 1% of the general minimum wage for each lecture hour or class hour (hereinafter collectively referred to as lecture hour).
This subsidy regime does not overlap with existing allowances included in the salary regime. For guest lecturers, substitute teachers, and substitute instructors, this subsidy regime shall not apply.
2. The lecture hours stipulated in Clause 1 of this Article refer to actual classroom teaching hours, field training hours, and drill ground teaching hours prescribed in the national defense and security education curriculum and teaching plan, and when calculating the lecture hour subsidy, there is no need for conversion.
Clause 2. Uniform regulations do not apply to management cadres, teachers, and invited lecturers; military officers and police officers seconded; and teachers assigned to teach integrated NDSE content at primary and junior high schools.
1. The subjects specified in Clause 2, Article 1 of this Circular (excluding management staff and instructors who are seconded officers) shall be provided with a set of uniforms consistent with the current officer uniform style. A set of uniforms includes: long pants, long-sleeved shirt, belt, soft cap (or hard cap), leather shoes, socks, name badge.
Name badges shall be defined by educational and training institutions in accordance with the name badges of civil servants, based on the current titles of management staff, teachers, and instructors of national defense and security education.
2. Management staff, teachers, and instructors of national defense and security education who concurrently hold positions for the first year shall be provided with one set of spring and summer uniforms and one set of autumn and winter uniforms, and from the second year onwards, they shall be provided with one set of either spring and summer uniforms or autumn and winter uniforms annually. Full-time teachers and instructors of national defense and security education shall be provided with one set of spring and summer uniforms and one set of autumn and winter uniforms annually.
Article 4. Standard teaching hours quota for teachers and lecturers in national defense and security education
The standard teaching hours quota, conversion to standard teaching hours, tasks, and other benefits for teachers and lecturers in national defense and security education shall be implemented according to the current regulations of the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs.
Article 5. Framework for standard teaching hours quota for educational management staff in national defense and security
1. The framework for standard teaching hours quota for teachers and lecturers in national defense and security who concurrently hold management positions shall be implemented according to the current regulations of the Ministry of Education and Training and the Ministry of Labor, Invalids and Social Affairs.
2. Lecturers at student national defense and security education centers who concurrently hold managerial positions have the obligation to directly teach according to the following framework (calculated as a percentage of the annual standard teaching hours quota of their current lecturer position):

3. Positions not specified in Clause 2 of this Article and other concurrent positions of lecturers at student national defense and security education centers shall be implemented according to the provisions for university lecturers in current documents. Centers that do not organize departments or faculties shall apply the quota for centers with less than 20,000 students per year.
Article 6. Other benefits for management staff and lecturers in national defense and security education who are assigned officers
1. Agencies, units, and schools are responsible for ensuring working conditions, equipment, housing, travel expenses, welfare benefits for management staff and lecturers who are assigned officers as for staff and lecturers of the same rank.
2. Assigned officers are eligible for selection to study and enhance professional skills; provided with information; participate in educational and training activities; considered for commendation and disciplinary actions as for staff and lecturers of the same rank.
3. Lecturers who are assigned officers performing teaching duties shall enjoy overtime pay beyond the standard teaching hours quota like other lecturers.
Article 7. Source of funds
1. Funds for the implementation of allowances, uniforms, and policies for management staff, teachers, and lecturers in national defense and security education shall be allocated in the annual state budget and legitimate income sources of educational and training institutions.
2. Management and utilization of these funds shall be carried out according to the current financial management system.
Article 8. Implementation organization
This Circular takes effect from January 2, 2012. This Circular replaces Circular Joint No. 41/2004/TTLT-BGD&ĐT-BTC-BQP-BLĐTB&XH dated December 31, 2004 of the Ministry of Education and Training, Ministry of Finance, Ministry of Defense, and Ministry of Labor, Invalids and Social Affairs guiding the implementation of certain systems and policies for management staff, lecturers, and teachers in national defense education.
During the implementation process, if there are any difficulties, agencies, units, and schools are requested to promptly report to the Ministry of Education and Training for coordination with the Ministry of Labor, Invalids and Social Affairs, Ministry of Defense, and Ministry of Finance to study and resolve them.
