DECREE

Article 24Regarding retirement at an older age for cadres and civil servantsspecialized agency under the People's Committee of the province/city.

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on the Labor Code dated June 18, 2012;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

At the request of the Minister of Home Affairs,

The Government promulgates this Decree on retirement at an older age for cadres and civil servants.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates retirement at an older age for cadres and civil servants as provided for in Clause 3, Article 187 of the Labor Code.

Article 2. Applicability

1. Female officials and civil servants holding the following positions:

a) Deputy Heads of Central Party Committees; Deputy Heads of Central Party Office; Deputy Heads of the Central Party Inspection Committee; Deputy Heads of the Steering Committees: Northwest, Central Highlands, Southwest;

b) Deputy Heads of the Office

c) Deputy Chairpersons specializing in the National Ethnic Council of the National Assembly; Deputy Heads specializing in the Committees of the National Assembly;

d) Deputy Ministers; deputies of heads of ministerial-level agencies; heads of government agencies;

đ) Deputy Chairpersons specializing in the Vietnam Fatherland Front Central Committee; deputies of central political-social organizations;

e) Deputy Directors of the Ho Chi Minh National Political Academy; Deputy Editors-in-Chief of the People's Newspaper, Deputy Editors-in-Chief of the Communist Review; Director of the National Political Publishing House - Truth;

g) Officers in the armed forces with general rank;

h) Deputy Secretaries of provincial party committees; Chairpersons of Provincial People's Councils, Chairpersons of Provincial People's Committees of centrally governed cities;

i) Deputy Chairpersons of the People's Councils, Deputy Chairpersons of the People's Committees of Hanoi and Ho Chi Minh City;

k) Members of the Standing Committee concurrently serving as Heads of Party Committees of Hanoi and Ho Chi Minh City Municipalities.

2. Those appointed to positions of Supreme People's Court Judge and Supreme People's Procuracy Prosecutor.

Chapter II

 SPECIFIC PROVISIONS

Article 3. Principles for Implementing Retirement at an Advanced Age

1. Ensuring objectivity, fairness, transparency, and compliance with regulations.

2. The competent authority deciding retirement at an older age for cadres and civil servants as provided for in Clause 3, Article 187 of the Labor Code must ensure that the retirement age does not exceed 65 years for males and 60 years for females.

3. Cadres and civil servants specified in Clause 1, Article 2 of this Decree, when decided by the competent authority to retire at an older age, continue to hold leadership and management positions.

4. During the implementation period of the policy of retirement at a higher age, if officials and civil servants wish to stop working, they will be granted pension benefits according to the provisions of the law.

Article 4. Conditions for Retirement at an Older Age

Cadres and civil servants subject to retirement at an older age as prescribed in this Decree must meet the following conditions:

1. Possess sufficient health to perform their duties and responsibilities;

2. Not be under investigation, prosecution, trial, or disciplinary action by the party or administrative authorities.

Article 5. Length of Service upon Retirement at an Older Age

1. For cadres and civil servants specified in Clause 1, Article 2 of this Decree, the length of service upon retirement at an older age shall not exceed five years, but shall not exceed 60 years of age.

2. For cases specified in Clause 2, Article 2 of this Decree, the length of service upon retirement at an older age shall not exceed five years, but shall not exceed 65 years for males and 60 years for females.

Chapter III

IMPLEMENTATION PROVISIONS

Article 6. Effectiveness

1. This Decree takes effect from July 15, 2015.

2. The provisions regarding retirement at an older age for those appointed to positions of Supreme People's Court Judge as stipulated in Clause 2, Article 2 of this Decree take effect from June 1, 2015.

3. Abolish provisions on retirement at an older age for cadres and civil servants issued contrary to this Decree.

Article 7. Implementation Organization

1. Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial people's committees of centrally governed cities, and heads of other agencies and organizations decide or propose to the competent authority to decide retirement at an older age for cadres and civil servants according to the分级任务的翻译结果已提供,确保了每个段落的准确性和一致性。
