PURSUANTPursuant to the Law on Government Organization dated December 25, 2000"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."Pursuant to the Vocational Education Law dated July 27, 20091;

Pursuant to the Education Law dated June 14, 2005, and the Law Amending and Supplementing Certain Provisions of the Education Law dated December 25, 2001 11 year 2014;

Based on Decree No. 13/2014/NĐ-CP dated February 25, 2014 of the Government detailing and providing implementation measures for the Law on National Defense Education and Security;June 2024;The Government promulgates this Decision on residential policy 11 ARTICLE 4. Finished traditional medicine is a form of traditional medicine that has undergone production processes, including packaging and labeling, using traditional or modern methods, belonging to one of the following forms: pills, liquids, tea, powder, extract, and other forms.

At the proposal of the Minister of Labor, Invalids and Social Affairs,

Recipients of residential policy benefits, Recipients of residential policy benefits when participating in vocational college or intermediate level training programs at vocational education institutions include:

Article 1. Scope of Regulation

1. Ethnic minority members from poor households or near-poor households, and persons with disabilities;

2. Graduates of boarding schools for ethnic minorities;

3. Members of the Kinh ethnic group from poor households or near-poor households, or persons with disabilities residing in areas with particularly difficult socio-economic conditions, ethnic minority regions, border areas, and islands.

Article 3. Scholarship levels and other support amounts

1. Scholarship levels

a) 100% of the basic salary/month for ethnic minority students from poor or near-poor households and persons with disabilities;

b) 80% of the basic salary/month for graduates of boarding schools for ethnic minorities; Kinh ethnic students with disabilities residing in areas with particularly difficult socio-economic conditions, ethnic minority regions, border areas, and islands;

c) 60% of the basic salary/month for Kinh ethnic students from poor or near-poor households residing in areas with particularly difficult socio-economic conditions, ethnic minority regions, border areas, and islands.

2. Other support amounts

a) One-time support of VND 1,000,000 per training course for purchasing personal items such as: personal quilt, warm coat (if necessary), personal mosquito net, personal mat, raincoat, and protective clothing according to the training profession;

b) Support of VND 150,000 for students staying at school during the Tet holiday;

c) Each student receives annual travel support once a year from their place of study to their family and vice versa:

- VND 300,000/year for students in areas with particularly difficult socio-economic conditions;

- VND 200,000/year for other recipients.

Recipients specified in Article 2 of this Decision are exempted from tuition fees; supported for educational expenses; examination registration fees; provided with health record books and annual health check-ups; issued health insurance cards; and awarded scholarships for academic encouragement according to current regulations.

Article 4. Principles for implementing the policy

1. Each student can only receive support once when participating in a vocational college or intermediate level training program under the policy stipulated in this Decision.

2. In cases where students belong to multiple recipient categories simultaneously, they can only benefit from the highest policy or if studying concurrently at multiple vocational education institutions, they can only benefit from the policy at one institution.

3. Within one academic year, the scholarship is fully granted for 12 months. For training programs lasting less than one year or having a final year study period shorter than 12 months, the scholarship is granted based on the actual number of months studied in that academic year. For credit-based training programs, the scholarship is granted based on the converted training duration but does not exceed the training duration of the profession and equivalent level of training under the semester system.

4. The scholarship levels and other support amounts stipulated in this Decision will be adjusted to suit changes in living costs.

5. Students cannot receive scholarships and other support in the following cases:

a) Being disciplined with compulsory withdrawal from school or taking leave due to illness or accidents preventing them from continuing their studies. The period without policy benefits starts from the effective date of the compulsory withdrawal or leave decision.

b) During the suspension of studies (with a time limit), except for cases of suspending studies due to illness or accidents, retaking courses, or suspending studies for objective reasons confirmed by the school.

c) During temporary detention or arrest.

a) Being disciplined with compulsory withdrawal from school or suspension of studies due to illness or accidents that prevent continued study. The period during which the residential policy is not applicable shall be calculated from the date on which the decision on compulsory withdrawal from school or the suspension decision takes effect.

b) During the period of suspended studies (with a time limit), except in cases of suspending studies due to illness or accidents, or for objective reasons confirmed by the school.

c) During the period of pre-trial detention or temporary holding.

Article 5. Payment Methods

1. For students studying at public vocational education institutions: The state budget will be allocated through such public vocational education institutions for beneficiaries entitled to residential policy benefits as stipulated in this Decision.

2. For students studying at non-public vocational education institutions: The state budget will directly provide residential policy benefits to eligible students as stipulated in this Decision through the Department of Labor, Invalids, and Social Affairs at the district level.

Article 6. Financial Resources

1. The funds to implement the policies prescribed in this Decision shall be balanced within the annual state budget estimate for the education and training sector according to the分级管理的预算管理体制。

2. The central government budget will support localities that cannot balance their budgets to implement the policies prescribed in this Decision.

Article 7. Implementation Organization

1. The Ministry of Labor, Invalids, and Social Affairs, and the Ministry of Education and Training:

a) Shall take the lead and coordinate with the Ministry of Finance to guide the implementation of the residential policy prescribed in this Decision;

b) Shall inspect, evaluate, and compile the situation regarding the implementation of the residential policy for students studying at vocational colleges and secondary vocational schools; report annually.

2. Ministry of Finance:

a) Shall allocate funds to implement the residential policy for students as stipulated in this Decision in the annual state budget estimate according to the current分级管理体制;

b) Shall take the lead and coordinate with relevant ministries and agencies to inspect the use of funds to implement the residential policy prescribed in this Decision.

3. People's Committees of provinces and centrally-administered cities, and relevant ministries and agencies shall, based on their assigned functions and tasks, direct and organize the implementation of the residential policy for students as stipulated in this Decision.

Article 8. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from January 1, 2016.

2. From the date this Decision takes effect, newly admitted students studying at vocational colleges and secondary vocational schools (vocational colleges, vocational high schools, and secondary specialized schools) who fall under the categories specified in Article 2 shall enjoy the policies as prescribed in Article 3 of this Decision.

3. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities, heads of agencies, organizations, and individuals related to this matter are responsible for implementing this Decision./.
