Pursuant to DecreeNo. ening special aircraft flights;on Based on the proposal of the Director of the Transport Department and the Director of the Civil Aviation Authority of Vietnam,policiesthe Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 28/2010/TT-BGTVT dated September 13, 2010 detailing the work of ensuring special aircraft flights.

Pursuant to the proposal of the Director of the Department of Ethnic Affairs and Religion Propaganda;on Amending and supplementing some articles of Circular No. 28/2010/TT-BGTVT dated September 13, 2010 of the Minister of Transport detailing the work of ensuring special aircraft flights

Amended and supplemented clauses 2 and 3, point d of Article 5 as follows:supplemented,, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP a) Amending and supplementing point c clause 2 of Article 5 as follows: number “c) Having accumulated at least 500 flight hours on the type of aircraft used for special aircraft missions in the position of pilot, and 300 hours in cases where the average flight time of the aircraft type is less than two hours.i tipoliciesiotechnological oon For new aircraft types, within one year from the date of operation commencement, if there is a requirement to perform special aircraft missions, the aircraft operator shall be responsible for assessing the pilot's capability based on the total flight hours accumulated as stipulated herein for the previous aircraft type used for special aircraft missions and report to the Civil Aviation Authority of Vietnam for supervision.”

Article 1. b) Amending and supplementing point d clause 3 of Article 5 as follows:

1. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP “d) Meeting the standards for special aircraft pilots as prescribed in points b, c, d, and đ of clause 2 of this Article;”developmentAmending and supplementing clause 4 of Article 6 as follows:development“4. Having accumulated at least 100 hours of service as cabin crew on the type of aircraft used for special aircraft missions.

For new aircraft types, within one year from the date of operation commencement, if there is a requirement to perform special aircraft missions, the aircraft operator shall be responsible for assessing the cabin crew's capability based on the total flight hours accumulated as stipulated herein for the previous aircraft type used for special aircraft missions and report to the Civil Aviation Authority of Vietnam for supervision.”

Amending and supplementing clause 3 and clause 4 of Article 10 as follows:

“3. The airport operator shall determine in the airport operation manual the procedures for operating the apron area, parking positions, taxiways, and passenger terminals serving special aircraft flights at the airport under its management.

4. The airport operator shall take the lead and coordinate with air service providers at the airport to determine the areas and procedures for handling cargo and baggage of special aircraft delegations in the airport operation manual to ensure convenience, speed, and compliance with relevant aviation security and safety regulations.”

Amending and supplementing clause 1 and clause 2 of Article 12 as follows:

2. “1. For arrival flights: five minutes before the aircraft lands, the designated runway for special aircraft operations shall be reserved exclusively; after the aircraft has landed and vacated the runway, it shall return to normal operation, and the designated taxiway and apron area shall be reserved exclusively for special aircraft operations; the taxiway may only resume normal operation after the special aircraft has moved into the apron area.

2. For departure flights: the parking position of the special aircraft shall be protected and isolated from the moment the aircraft arrives at the position to prepare for the flight; from the moment the engine start-up command is given, the air traffic control unit shall reserve the designated taxiway for the special aircraft flight, and the apron area may resume normal operation once the special aircraft has started moving on the taxiway. Five minutes before the special aircraft takes off, the air traffic control unit shall reserve the designated runway for the special aircraft flight; after the special aircraft has reached the takeoff hold point, the taxiway may resume normal operation. After the special aircraft has taken off, the runway may resume normal operation. At airports with multiple runways, the runways not scheduled for special aircraft takeoffs and landings may operate normally according to the regulations governing parallel runway operations.”

Amending and supplementing clause 2 of Article 13 as follows:

3. “2. When the actual takeoff or landing time of the special aircraft differs from the planned time in the air traffic control plan by more than ten minutes, the following actions shall be taken:

a) For arrival flights: the regional air traffic control company shall promptly notify the airport operator; the airport operator shall promptly notify the Air Traffic Control Station, the Air Traffic Information Service Center, and the aircraft operator;

b) For departure flights: the airline shall promptly notify the airport operator; the airport operator shall promptly notify the Air Traffic Control Station, the regional air traffic control company, and the Air Traffic Information Service Center;

4. Amending and supplementing Article 3 of Circular No. 187/2016/TT-BTC, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP c) Relevant units shall implement the special aircraft service procedures according to the adjusted plan based on their respective functions and responsibilities.”

Amending and supplementing clause 3 and clause 6 of Article 14 as follows:

“3. Having continuously managed air traffic control operations at air navigation service facilities for at least three years.

5. Amending and supplementing Article 3 of Circular No. 187/2016/TT-BTC, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP 6. Being assessed and authorized in writing by the head of the air navigation service provider or his/her delegate to perform special aircraft support duties for air traffic controllers.”

Amending the name of Article 15 and amending and supplementing clause 4 of Article 15 as follows:

“Separation between special aircraft and other aircraft and separation between special aircraft”

7. Amend the name of Article 15 and amend, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Clause 4 of Article 15 as follows:

a) Amend the name of Article 15 as follows: "Separation between state aircraft and other aircraft and separation between state aircraft"

b) Amend and supplement Clause 4 of Article 15 as follows:

"4. The separation between state aircraft shall be applied according to the current air traffic control standards."

8. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Supplement Article 16 as follows:

"Article 16. Management of the list of air traffic controllers serving state flights"developmentinspection for state flightspoliciesc) For units refueling, personnel must be assigned to operate equipment and perform refueling tasks with high skills and good moral character; strictly follow the procedures for inspecting refueling vehicles and equipment before performing refueling operations. subject, organization, unit under the People's Committee of the commune level

||| Business entities providing air traffic service support or persons authorized shall be responsible for establishing and managing the list of air traffic controllers permitted to operate executive aircraft flights.

9. Amending and supplementing Article 3 of Circular No. 187/2016/TT-BTC, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP ||| Supplement Article 18 as follows:

||| "Article 18. Security cards and permits for civil aviation airports issued to individuals and means of transport serving executive aircraft flights.N ||| declaration of customs import procedures.||| Convenience for specialized services subject, organization, unit under the People's Committee of the commune level

1\. The objects, authority to issue, manage, and use security cards and permits for individuals and means of transport serving executive aircraft flights shall be regulated in detail in the Civil Aviation Security Program and quality control of civil aviation security issued by the Minister of Transport.

2\. Heads of units participating in serving executive aircraft flights or serving passengers of such flights shall register a list of regular service personnel with the Vietnam Civil Aviation Authority and regional airport authorities to obtain multiple-use cards, specifying the regular duties of the card applicants and the total number of multiple-use security cards.

3\. Heads of units managing means of transport operating within the flight area directly serving executive aircraft flights shall register a list of such means of transport with the regional airport authorities to obtain multiple-use permits, specifying the functions of the transport means for the executive aircraft flights.

4\. Heads or authorized persons of units participating in serving executive aircraft flights shall register with the airport authorities a list of individuals and means of transport requesting single-use cards and permits, presenting security control cards or identification documents, signing off on the issuance logbook. After completing their service tasks, those who signed for the cards have the responsibility to collect and return the issued cards and permits to the airport authorities and sign to confirm full return.

5\. Heads or authorized persons of units responsible for serving and welcoming passengers of executive aircraft flights shall register with the airport authorities a list of individuals and means of transport requesting single-use cards and permits, presenting security control cards or identification documents; submit identification documents of card applicants, sign off on the issuance logbook. After completing their tasks, those who signed for the cards have the responsibility to collect and return the issued cards and permits to the airport authorities and sign to confirm full return and reclaim submitted identification documents.

6\. Locations for issuing single-use cards and permits must be outside the areas serving executive aircraft flights. Signatures of card and permit recipients mentioned in Clause 4 and Clause 5 of this Article must be registered in advance with the airport authorities. Issuance and recovery of cards and permits must be recorded and kept in the issuance logbook by the issuing authority, including: name of the recipient, workplace, duty performed, card and permit number, signature, issuance and return."

10. ||| Supplement Article 18a as follows:

||| "Article 18a. Exemption from civil aviation security checksdevelopment||| 1\. Exemption from civil aviation security checks for individuals and carry-on baggage of those served by executive aircraft flights as stipulated in Article 5 of Decree No. 03/2009/NĐ-CP dated January 9, 2009 of the Government on ensuring executive aircraft flights.

3\. Security check forces shall cooperate with units under the Command of Guard - Ministry of Public Security in conducting security checks and monitoring civil aviation security for executive aircraft flights according to regulations on ensuring executive aircraft flights."

2. Aviation security inspection shall be exempted for high-ranking Party officials, State officials, and foreign diplomatic representatives coming to receive or see off subjects served on special aircraft flights, including:

a) Heads of Party bodies under the Central Committee and equivalent positions or higher;

b) Ministers and equivalent positions or higher;

c) Secretaries and Chairmen of provincial-level cities directly under the Central Government and equivalent positions or higher;

d) Heads of foreign diplomatic agencies in Vietnam.

11. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP||| "Article 19. Ensuring public order and civil aviation security in public areas and restricted zones of airports when there are executive aircraft flights

||| In public areas and restricted zones of airports during executive aircraft flightsperiod1\. Civil aviation security forces shall coordinate with local police to set up checkpoints at entrances and exits and public areas of airports; deploy security personnel, equipment, and tools in conjunction with local police to patrol, monitor, and maintain order in public areas of airports throughout the preparation and service of executive aircraft flights; promptly detect, prevent, and handle actions that threaten the security and safety of executive aircraft flights.itself2\. Business entities providing civil aviation security services at airports shall allocate sufficient security personnel and equipment to monitor and control the entry and exit of people and means of transport, activities in the service area of executive aircraft flights; luggage and goods when entering the service area of executive aircraft flights; prevent, detect, and stop actions that threaten the security and safety of executive aircraft flights."

Civil aviation security forces shall be responsible for coordinating with airlines operating executive aircraft flights and catering companies to visually inspect meals for executive aircraft flights departing from Vietnam before placing them in the aircraft meal storage compartment, sealing the storage compartment securely, and arranging civil aviation security personnel to escort the meals from the production site to the aircraft."

12. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP supplement Clause 4 and Clause 5 of Article 21 as follows:

||| "4\. Security inspection work for fuel transportation vehicles and their operators before entering the flight area in Vietnam:

13. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPb\. Airport civil aviation security forces shall be responsible for inspecting the entire fuel transportation vehicle, ensuring that all discharge and refueling ports remain sealed before entering the restricted area;

c\. Refueling units shall assign skilled and morally upright personnel to operate the vehicle and perform refueling tasks; strictly follow the pre-refueling inspection procedures for the refueling vehicle and other refueling equipment.

a) In cases where fuel transport vehicles pass through public areas, they must be accompanied by security personnel from the fueling unit.

5\. Security and safety inspection and supervision work before and during the refueling process of executive aircraft:"

5. Security and safety inspection work before and during the refueling process of state aircraft:

c) For state flights at Vietnam

a) The refueling of aircraft at airports in Vietnam shall be carried out under the direct supervision of the inspection team consisting of the following representatives: representative of the Port Authority; representative of the technical preparation team for special aircraft; representative of the airport operator; representative of the aviation security unit at the airport; representative of the fueling unit for special aircraft; there shall be a record made by the representative of the Port Authority.

b) The refueling of aircraft abroad shall be carried out under the direct supervision of the inspection team consisting of the following representatives: representative of the technical preparation team for special aircraft; representative of the Escort Command.

The inspection team is responsible for: checking the legality of the Fuel Quality Inspection Certificate; inspecting the sealing of the fueling and venting ports of the fueling equipment; supervising the entire process of fueling the aircraft; supervising the sampling and sealing of samples after fueling in cases where the fueling is carried out in Vietnam.

The Fuel Quality Inspection Certificate according to the standard TCVN ISO/IEC 17025 specified in point c clause of this Article must be signed and confirmed by the head or authorized person of the fuel supply unit or the person in charge of the testing laboratory.

14. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPm, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP amending Articles 1, 2 and Article 3 of Article 22 as follows:

"1. The enterprise providing air transport security services at airports shall arrange security forces to guard, supervise, and protect special aircraft from the time the aircraft is positioned for preparation until the end of the service for the special aircraft.

2. In the case of overnight parking of special aircraft, the airline must seal the aircraft doors and hand over to the security force of the enterprise providing air transport security services at the airport; the area where the aircraft is parked must have sufficient lighting and be guarded by personnel or monitored by cameras to detect and prevent unauthorized access to the aircraft. Stairs, airstairs, conveyor belts, and other service equipment must be removed from the aircraft.

3. Security checks, screening, and monitoring of aircraft, passengers, baggage, and cargo of special flights, ensuring air transport security on the flight shall be carried out in accordance with the provisions of the Civil Aviation Security Program and quality control of civil aviation security, except for the cases provided for in clauses 1 and 2 of Article 18a of this Circular."

15. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPamending Article 23 as follows:

"Article 23. Ensuring security for foreign special flightsớ1. The air transport security inspection force at the airport is responsible for conducting security checks on all persons, baggage, cargo, and items of the special delegation at the airport; coordinating with the security of the special delegation to escort checked baggage and cargo from the security check point to the special aircraft.

2. For separate special flights, if the foreign side sends a diplomatic note to notify Vietnam or the Ministry of Foreign Affairs requests in writing not to conduct air transport security checks, the Civil Aviation Administration of Vietnam shall issue a document requesting the air transport security inspection force at the airport to implement the content of the diplomatic note or request regarding persons, baggage, and cargo of the special delegation.

3. The airport operator and the enterprise providing air transport security services at the airport shall be responsible for coordinating with relevant agencies of the Ministry of Foreign Affairs and the Escort Command to implement enhanced security measures for the special aircraft, guests, baggage, and cargo of the foreign special delegation in the airport area when required by competent authorities or agreed upon with the foreign representative agency."

16. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP"Article 24. Management of the list of security staff and support staff for special flights in Vietnam

Air transport agencies and units shall establish a list of their staff participating in serving special flights, and report the list to the Port Authority and the air transport security inspection force for supervision."|||Relevant aviation authorities and units shall establish a list of their personnel participating in the service of state flights and notify such lists to the Civil Aviation Authority and aviation security forces for supervision.

i) Airports where state aircraft take off and land

17. Amending and supplementing some articles of Decree No. 60/2021/NĐ-CP dated June 21, 2021 of the Government on the financial autonomy mechanism for public service units, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPamending Article 25 as follows:

"Article 25. Responsibilities of the Civil Aviation Administration of Vietnam

1. Receiving and implementing tasks to ensure special flights conducted by Vietnamese airlines, foreign special flights, and related changes to the special flight plans to be communicated to the following agencies and units:

a) Civil Aviation Port Authorities;

b) Vietnam Air Traffic Control Corporation;

c) Vietnam Airports Corporation and the airport operators with special aircraft taking off and landing.

2. The deadlines for receiving and transmitting notifications of special aircraft flights of Vietnam are as follows:

a) For flights using separate aircraft: at least five days before the planned date for domestic flights; at least ten days before the planned date for international flights;

b) For combined commercial flights: at least twenty-four hours before the scheduled departure time for domestic flights; at least five days before the implementation date for international flights;

c) For sudden special flights notified without meeting the deadlines specified in points a and b of clause 2 of this Article, the Civil Aviation Administration of Vietnam shall directly coordinate with competent authorities to notify the special flight of Vietnam as stipulated in Article 7 of Decree No. 03/2009/NĐ-CP dated January 9, 2009 of the Government on the implementation of special aircraft standards for aircraft, crews, and aircraft fuel; disseminate to relevant units and organizations to monitor the implementation.

3. Coordinate and unify the implementation plan for special aircraft flights with the airline assigned the task of executing the special aircraft flight and supervise the execution of the plan.

4. Organizing the supervision of the implementation of security and safety measures for special flights; urging and monitoring the preparation for serving special flights, and coordinating to handle abnormal situations during the execution of special missions.

5. Implementing the issuance of permits for special flights within its authority; coordinating and supporting Vietnamese airlines in obtaining permits for special flights from foreign countries."

18. Amending Article 27 as follows:

"Article 27. Responsibilities of airport enterprises, airport operators, and enterprises providing air transport security services having special aircraft taking off and landingohaving state aircraft taking off and landing

1. Responsibilities of Airport Enterprises: direct, inspect, urge, and supervise the implementation of special aircraft guaranteeing tasks.

2. Responsibilities of Airport Operators

a) Taking the lead in ensuring fire prevention and explosion safety for special aircraft, special guests, and cargo and baggage of the special delegation in the airport area; coordinating in ensuring security for special flights."

b) Arrange dedicated parking areas and security guards for special aircraft and lead coordination for guarding special aircraft;

c) Provide all favorable conditions for departments serving and preparing special aircraft to perform their duties, ensuring the schedule for takeoff and landing of special aircraft;

d) Coordinate the organization of appropriate welcoming and farewell ceremonies suitable to the nature of special aircraft tasks, meeting the requirements of competent authorities;

d) For foreign state aircraft flights, the airport operator shall cooperate with the responsible agencies of the Ministry of Foreign Affairs and the Ministry of Public Security to ensure enhanced security and fire prevention for the foreign state aircraft and their passengers in the Vietnamese airport area upon request from the foreign side.

3. Responsibilities of Air Cargo Security Service Providers

a) Lead coordination for the security assurance of special aircraft, special aircraft passengers, and cargo and baggage of special aircraft passenger groups in the airport area;

b) For foreign state aircraft flights, the air transport security service provider shall cooperate with the responsible agencies of the Ministry of Foreign Affairs and the Ministry of Public Security to ensure enhanced security for the foreign state aircraft and their passengers in the Vietnamese airport area upon request from the foreign side.”

19. Amend and supplement Article 28 as follows:

"Article 28. Responsibilities of Air Carriers in Performing State Aircraft Duties

1. Accept and implement tasks to ensure the operation of official aircraft flights.

2. Develop plans for serving state aircraft, including: identifying the aircraft performing the state aircraft mission, backup aircraft for the state aircraft mission, flight routes, lists of countries requesting permission to fly through, land in, enter, and exit, and details related to operation and technical support, and report to the Civil Aviation Administration of Vietnam as follows:

a) For flights using separate aircraft: at least two days before the planned date for domestic flights; at least three days before the planned date for international flights;

b) For combined commercial flights: at least twelve hours before the scheduled departure time for domestic flights; at least two days before the planned date for international flights.

3. Organize the implementation of urgent state aircraft missions according to regulations applicable to the aircraft, engines, and crew performing the state aircraft mission for urgent state aircraft flights notified outside the time limit specified in point c, Clause 2, Article 25 of this Circular, and report to the Civil Aviation Administration of Vietnam as soon as possible.

4. Apply for flight permits for domestic Vietnamese state aircraft flights conducted by the carrier in accordance with current regulations. Coordinate with the Consular Department of the Ministry of Foreign Affairs to apply for flight permits for international Vietnamese state aircraft flights.

5. Establish procedures for serving, seating arrangements, and selecting guests when serving state aircraft passengers together with regular passengers, notify the Central Party Office, National Assembly Office, President's Office, Government Office, State Reception Bureau, Civil Aviation Administration of Vietnam, and implement accordingly.

6. Take the lead in coordinating with relevant units to ensure safety, security, and flight schedules for Vietnamese state aircraft throughout the mission; closely coordinate with the Central Party Office, National Assembly Office, President's Office, Government Office, State Reception Bureau, and advance teams to develop service plans at foreign airports.

7. Lead and coordinate with relevant agencies and units to serve state aircraft passengers thoroughly and safely, meeting the requirements of authorized agencies; take the lead in guiding, maintaining order, and ensuring security on state aircraft when there are attendants and other individuals flying with the state aircraft passengers.

8. Coordinate to ensure safety and security for the cargo, luggage, documents, and property of the official aircraft passenger group.

9. Coordinate with the Security Guard Command to ensure security for the official aircraft, official passengers, luggage, and cargo of the official aircraft passenger group abroad.

10. For combined state aircraft and commercial passenger flights, Vietnamese air carriers shall be responsible for coordinating with relevant agencies and units to implement effective measures to minimize risks of compromising the security and safety of state aircraft passengers; do not carry special passengers as required by aviation security regulations on combined state aircraft and commercial passenger flights.”

Article 2. Effective Date

This Circular takes effect from December 1, 2015.

Article 3. Responsibility for Implementation

The Head of the Ministry’s Office, the Inspector General of the Ministry, the Directors of the Departments, the Director of the Civil Aviation Administration of Vietnam, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
